Box 2669, Nantucket, MA 02584, Board of Appeals File No. 038-98, the Board made the following Decision: 1. Applicant is seeking a SPECIAL PERMIT under Nantucket Zoning By-Law §139-33A(4) and (5) (alteration/expansion of a pre-existing non-conforming structure/use). Applicant proposes to alter an existing single-family dwelling by removing and replacing a porch roof, removing and replacing a deck, and replacing a hinged garage door with an overhead garage door. This work will take place within the front yard setback, but will not project into the setback as far as other portions of the existing structure. Other work includes adding a new shed dormer and a partition for the existing outdoor shower, neither of which will affect zoning compliance. The Locus is non-conforming as to front yard setback with the structure being sited 2.0+ feet at its closest point from the front yard lot line and with the deck extending over the front yard lot line into Chicago Street by 2.7+ feet at the most. In addition, in the alternative, Applicant also requests relief by VARIANCE pursuant to Nantucket Zoning By-Law §139-32A from the Intensity regulations of §139-16A, in order to validate the siting of the existing structure and deck and, if required, to allow completion of the project as proposed. The Premises is located at 5 CHICAGO STREET, Assessor's Map 60, Parcel 124, Lot 599, Land Court Plan 3092-46. The Property is zoned Residential-2. 2. The Decision is based upon the Application and materials submitted with it and the testimony and evidence presented at the Hearing. The Planning Board made no recommendation without the benefit of a public hearing. There were no letters in the file. 3. Applicant, through counsel, represented that the single-family dwelling was constructed 1975 on this conforming lot by a former owner pursuant to a validly-issued Building Permit with a Certificate of Occupancy having been issued in 1977, at a time when surveyed plot plans, "as-builts" were not required to ascertain exact location of a structure upon a lot in order to obtain said permit. Upon Applicant's purchase of the property in 1997 the zoning violations were brought to light. Applicant stated that Certificate of Appropriateness No. 31,306 had been issued by the Historic District Commission. Applicant argued that Special Permit relief is appropriate inasmuch as the structure was protected by the 10-year curative statute and is accordingly exempt from zoning enforcement, which then would make Special Permit relief available to expand/alter an existing dwelling irregardless of the fact that the structure is not pre-existing the zoning requirements with which it does not conform. Applicant proposed to remove the existing roof over the front entry and add a new porch roof that would project further into the 30-foot required front yard setback area but would not come any closer to the front yard lot line than other portions of the structure. The new second floor deck would also be constructed further into the front yard setback area but come no closer than other portions of the existing structure. The new shed dormer on the rear northwesterly portion of the house would be partially within the front yard setback area but no closer than other portions of the structure. The new partition for the existing outdoor shower would be outside of said setback area and have no effect on zoning. The replacement of the garage door would take place within the front yard setback area but would not change the dimensions of the structure or come any closer to that lot line. Applicant also requested that the Board validate the siting of the existing structure by Variance in order to cure the zoning violations, and if necessary approve the proposed work should the Board determine that the alterations .and extensions within the setback area cannot be done by Special Permit. 4. Therefore, the Board finds that the structure is non-complying and not non-conforming which gives the dwelling no pre-existing non-conforming status, i.e., "grandfathered" protection, being constructed after the July 27, 1972 enactment of the Nantucket Zoning By-Law. The definition of non-conforming in the By-Law reads in such a manner that to have the benefit of Special Permit relief available for this Lot, the non-conformities would have to have been lawfully in existence on said date, or in the case of a structure, use or lot made non-conforming by an amendment of this Zoning By-Law, on the effective date of such amendment. The non-conformities on the subject Lot do not meet either test, making relief by Variance the only option available to complete the alterations and extensions as proposed. The Board further finds that a grant of relief by Variance to validate the existing siting of the structure may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of such By-Law, with moving of the structure providing no public benefit, and owing to circumstances relating to the topography of the structure as it relates to the siting on the Lot, and especially affecting such land or structures but not affecting generally the zoning district in which it is located, a literal enforcement of the provisions of this Zoning By-Law would involve substantial hardship, financial or otherwise, to the Applicant. In addition, the Board finds there are insufficient facts to support a grant of Variance relief to allow alteration and expansion of the structure as proposed. The Board notes that the Building Commissioner stated that he would issue a Building Permit to replace the garage door and add the partition to the outdoor shower without relief from this Board as well as for other maintenance necessities. 5. Accordingly, the Board took the following votes: i. The Board, by a unanimous under Nantucket Zoning By-Law §139-16A the structure up to the front yard lot does not have jurisdiction to validate structure that extends over the front vote, GRANTS the requested VARIANCE to validate the existing siting of line with the Board noting that it or approve that portion of the yard lot line into Chicago Street; ii. Upon a motion made and seconded to allow the additions as proposed by a grant of VARIANCE relief under Nantucket Zoning By-Law §139-16A, one (1) member (Hourihan) voted in favor with four (4) members (Waine, Williams, O'Mara and Sevrens) voting in the negative. Relief is hereby DENIED; iii. Upon a motion made and seconded to allow certain alterations, specifically: replacing the porch roof, removing and replacing the deck and replacing the hinged garage door, by a grant of VARIANCE relief under Nantucket Zoning By-Law §139-16A, two (2) members (O'Mara and Hourihan) voted in favor and three (3) members (Waine, Williams and Sevrens) voted in the negative. Relief is hereby DENIED. To grant relief a minimum of four (4) votes in the affirmative are necessary; and iv. Upon Applicants request to WITHDRAW WITHOUT PREJUDICE the request for relief by SPECIAL PERMIT under Nantucket Zoning By-Law §139-33A(4) and (5), the Board, by unanimo vote, GRANTS s~icl1request. ADDENDUM TO APPLICATION OF IRWIN GROSSMAN, TRUSTEE OF I AND G NOMINEE TRUST This application is a request for relief to alter a nonconforming single-family dwelling at 5 Chicago Street, Madaket, which was constructed in 1975 by its former owner pursuant to a validly- issued building permit; a Certificate of Occupancy was issued in 1977. The existing dwelling is nonconforming as to front yard setback, being at its closest point about 2.0 feet from the line of Chicago Street. Front yard setback is 30 feet in this zoning district. A deck on the front of the house extends a maximum of about 2.7 feet into Chicago Street, an abutters way owned to the midline by the applicant. There are no other nonconformities. The applicant wishes to alter the structure by doing the following work, as shown upon the plans attached hereto; this work has already been approved by the Nantucket Historic District Commission. 1. Remove the existing roof over the front entry and adding a new porch roof. This roof will project farther into the front yard than the existing roof, but will not project as far as other portions of the existing structure. 2. Remove the existing cantilevered second floor deck and add a new deck with supporting columns. This work will be done within the required setback area but will not project as far as other portions of the existing structure. 3. Adding a new shed dormer; this will be on the rear side of the house and will be entirely, or nearly so, outside the front yard setback area. 4. Adding a partition for an existing outdoor shower. This will have no effect upon zoning compliance. 5. Replacing the existing hinged garage door with an overhead door. This will take place within the front yard setback area but will not change the dimensions of the structure. The existing nonconforming dwelling was constructed more than ten years ago, and accordingly is exempt from enforcement as to its zoning nonconformities. Under case law, the applicant is therefore entitled to request a special permit for its alteration under Nantucket Zoning By-law §139-33.A(4), on the basis of a finding that the alteration will not be substantially more detrimental to the neighborhood than the existing nonconformity. In addition, X139-33.A(5) permits the Board of Appeals to issue a special permit for the extension of an existing structure which violates a setback distance, making no requirement that such a structure be pre-existing of the zoning requirements with which it does not conform.
