At a Public Hearing of the Nantucket Zoning Board of Appeals held
at 1:00 P.M., Friday, April 10, 1998, in the Conference Room, Town Annex
Building, 37 Washington Street, Nantucket, Massachusetts, on the
Application of WEST CREEK REALTY TRUST, MATTHEW G .FEE, TRUSTEE, of 50
Cliff Road, Nantucket, MA 02554, Board of Appeals File No. 037-98, the
Board made the following Decision:
1. Applicant is seeking a MODIFICATION of a SPECIAL PERMIT granted in
a Board of Appeals Decision in File No. 038-93, which modified a Decision
in File No. 075-91. Applicant proposes to construct a 168+ square-foot
addition onto the southeasterly front portion of the existing structure,
known as the "Nantucket Bagel Company", that would be used for
refrigeration purposes with no access by the public allowed. In addition
and to the extent necessary, Applicant is also seeking SPECIAL PERMIT
relief under Nantucket Zoning By-Law §139-18A (Parking Requirements),
§139-18B(1) (off-site parking spaces), §139-18B(2), §139-18B(4) and
§139-20C (loading zone).
The premises is located at 5 AND 7 WEST CREEK ROAD, Assessor's Map
55, Parcels 289 and 167, Plan Book 25, Page 13, Lots 1 and 2. The
property is zoned Residential-Commercial.
2. The Decision is based upon the Application and materials submitted
with it and the testimony and evidence presented at the Hearing. The
Planning Board made a favorable recommendation provided Applicant define
the entrance to the parking area with other minor site plan revisions.
There was one (1) letter from the Wannacomet Water Company Manager, dated
April 1, 1998, stating that, upon review of the Application, the proposed
site/parking plan was acceptable to the Company. There were no other
letters for or against the proposed plan on file.
3. Applicant, through counsel, represented that the new 168±
square-foot addition would meet all dimensional zoning requirements and
would not require an additional parking space above the ten (10) provided
on site. The new space would not be accessible by the public and would be
used for additional refrigeration purposes in conjunction with the
existing take-out food establishment. The Locus consisted of two (2)
conforming lots, with westerly Lot #7 containing a single-family dwelling
and four (4) of the required parking spaces, and easterly Lot #5
containing the subject structure and six (6) parking spaces and a loading

zone per parking plan "A". Relief had been granted in the Decision in BOA
File No. 038-93 to allow off-site parking on Lot #7 to meet the parking
requirement calculation. Applicant submitted two (2) different parking
plans at the Hearing for the Board's review. The first plan, marked as
"B" and done by Charles W. Hart & Associates, Inc., dated March 30, 1998,
showed a parking configuration similar to the parking plan submitted with
the Application in BOA File No. 038-93. The second plan, marked as "A"
and also done by Charles W. Hart Associates, Inc., dated March 30, 1998,
showed a substantially reconfigured parking plan with the loading zone
located within the required five-foot side yard setback area. Applicant
proposed to modify the Decision in BOA File No. 038-93 by substituting
the preferred plan marked as "A", in place of the plan specified in
paragraph #6, condition (a) marked as "Exhibit C". In response to the
Board's concerns, Applicant further represented that a fence would be
provided along West Creek Road to discourage parking along the street and
the entrance to the parking area would be more clearly defined with an
asphalt apron.
4. Therefore, the Board finds that the Modification of the Decision
in BOA File No. 038-93 would be in harmony with the general purposes and
intent of the Zoning By-Law and in keeping with the character of the
neighborhood. Applicant is providing all of the required parking spaces
for the uses on the combined lots and the addition would not be in
violation of the dimensional requirements of the By-Law. The Board
further finds that a grant of Special Permit relief to waive the loading
zone requirement that the space be sited outside of the required setback
area and to allow off-site parking to the extent necessary would be in
harmony with the general purposes and intent of the Zoning By-Law.
5. Accordingly, by a unanimous vote, the Board GRANTS the requested
MODIFICATION of the Decision issued in BOA File No. 038-93, which
modified a Decision issued in BOA File No. 075-91, to allow substitution
of a new parking plan, in place of Exhibit C as specified in the Decision
in BOA File No. 038-93, paragraph #6, condition (a), and allow
construction of the 168+ square-foot addition, and further GRANTS relief
by SPECIAL PERMIT under Nantucket Zoning By-Law §139-20C, allowing the
loading zone to be sited within the northeasterly five-foot side yard
setback area, and to the extent necessary, a SPECIAL PERMIT under
Nantucket Zoning By-Law §139-18B(1) to allow off-site parking on Lot #7,
upon the following conditions:
a. The parking layout and addition shall be constructed in
substantial conformance with the plan done by Charles W. Hart &
Associates, Inc., dated March 30, 1998, marked as Exhibit A and attached
hereto;
b. There shall be a fence constructed and maintained at the
front of the property along West Creek Road to discourage parking on the
street;
c. There shall be signs clearly indicating that there is no
parking on the street placed on the aforementioned fence;
d. The entrance to the parking area shall be no more than 24±
feet and be clearly delineated by a fence as per the Plan;
e. An asphalt apron shall be constructed and maintained from
West Creek Road into the entrance of the parking area; and
f. The privet hedge located along the southwesterly property
line shall be maintained along with the fences along the rear and
northeasterly side yard lot lines.
6. The Board, by a unanimous vote, approves the site plan per
Nantucket Zoning By-Law §139-23, done by Charles W. Hart & Associates,
Inc., dated March 30 ,1998.

At a public hearing of the Zoning Board of Appeals held at
1:00 p.m. on Tuesday, April 13, 1993, in the Town and County
Building, Broad Street, Nantucket, Massachusetts 02254, on the
application of Kathleen A. Brosnan, Trustee of NBC Realty Trust
u/d/t dated November 30, 1992 and recorded in Book 406, Page 3 at
the Nantucket Registry which trust has a mailing address c/o
Vaughan, Dale & Philbrick, P.C., Post Office Box 659, Nantucket,
Massachusetts 02554 (Board of Appeals File No. 038-93) in
connection with property located at 5 and 7 West Creek Road,
Nantucket (Assessors Map 55, Parcel 289 and 167), the Board made
the following DECISION:
1. The applicant seeks to modify the special permit dated
January 29, 1992 recorded in Book 403, Page 114 at the Nantucket
Registry of Deeds ("1992 Special Permit") which allows the
commercial use of the existing structure on the property for food
processing, manufacturing, and packaging, and as a take-out food
establishment under Sections 139-9.B.(2)(i) and (o). The 1992
Special Permit also granted relief under Section 139-18.B.(1)
allowing some of the parking for this use to be provided on the
adjacent lot.
2. The 1992 Special Permit governs the uses of the
commercial structure located at 5 West Creek Road. Asingle-family
dwelling also exists on the property situated at 7 West Creek Road.
Both properties are zoned Residential-Commercial. The applicant
seeks to add approximately 288 square feet of additional commercial
space to the commercial structure which would be utilized in
conjunction with the take-out food establishment and the food
processing, manufacturing and packaging uses on the property.
3. The decision of the Board is based upon the application
and the materials submitted therewith, the testimony and evidence
presented at the public hearing and the favorable recommendation
from the Nantucket Planning Board.
4. The proposed addition and handicapped access ramps are
shown on the site plan attached hereto as Exhibit A. The proposed
interior layout from which the parking calculations are derived is
attached hereto as Exhibit B. The single retail use proposed,
including the additional commercial space, as well as the
residential use on the adjacent lot results in a requirement of ten
(10) parking spaces for both lots. The applicant proposes to use
the parking plan approved in connection with the 1992 Special
Permit, a copy of which parking plan is attached hereto as Exhi i~
C . ~ 11151 ~ ~ ~ o`~v.
5. The applicant is proposing no outsides seating in
connection with this take-out food establishment and will comply
with the screening and lighting requirements for parking areas of
this size under Section 139-19.
6. The Board reviewed the proposed plans and finds the
proposed uses in harmony with the general purposes and intent of
the zoning bylaw, that the uses are not inherently in violation of
Section 139-7E(4), and that practical difficulties prevent locating
the required off-street parking on the same lot with the uses
requiring them. Accordingly the Board, by unanimous vote, grants
the relief requested by special permit (hereby modifying the 1992
Special Permit) to allow the use of the commercial structure at 5
West Creek Road as expanded by the proposed addition for a take-out
food establishment under Section 139-98(2)(0) and for food
processing, manufacturing and packaging under Section 139-9B(2)(i)
and for off-site parking under Section 139-18B.(1) upon the
following conditions:
(a) the proposed addition shall be
substantially in conformity with the
plans submitted as Exhibit A and B,
with the parking provided
substantially shown on the plan
submitted as Exhibit C on file;c2,9'~
(b) the applicant shall provide screening
and lighting for the parking area as
required by Section 139-19F; and
(c) the premises shall not be open for
business serving the public between
the hours of 9:30 p.m. and 5:30
a.m.; and
(d) the hours specified in (c) above do
not preclude the owner and/or the
owner's his employees or agents from
working on the premises at other
hours; and
(e) there shall
