At a Public Hearing of the Nantucket Zoning Board of Appeals held
at 1:00 P.M., Friday, April 10, 1998, in the Conference Room, Town Annex
Building, 37 Washington Street, Nantucket, Massachusetts, on the
Application of SOUTH WATER ASSOCIATES REALTY TRUST, c/o Theodore L.
Tillotson, P.C., P.O. Box 1530, Nantucket, MA 02554, Board of Appeals
File No. 036-98, the Board made the following Decision:
1. Applicant is seeking a MODIFICATION of a SPECIAL PERMIT' granted in
a Board of Appeals Decision in File No. 043-95, and modified in File No.
040-96, to strike condition "a" of paragraph No.6, which prohibits food
service establishments on the premises. Applicant proposes to change the
use of Unit No.6 from retail to use as a take-out establishment.
Applicant now seeks a SPECIAL PERMIT under Nantucket Zoning By-Law
~139-9B2(0) (take-out food establishment). Applicant also asks that the
Board amend condition "d" of paragraph No.6, as amended in File No.
040-96, which limits uses on the Locus to those that would not require
more than a total of 41 parking spaces. The proposed use would require
six (6) spaces with three (3) having been waived in the previous
Decisions for retail use. Applicant hereby seeks a SPECIAL PERMIT under
Nantucket Zoning By-Law ~139-18B(2) and (3) (Parking Requirements) to
waive three (3) parking spaces. In addition, to the extent necessary,
Applicant is seeking a SPECIAL PERMIT under Nantucket Zoning By-Law
@138-20C to waive the loading zone requirement for the proposed change in
use.
The premises is located at 5 SOUTH WATER STREET, Assessor's Map
42.3.1, Parcel 132, Land Court Plan 35745-B, Lot 1. The property is zoned
Residential-Commercial.
2. The Decision is based upon the Application and the materials
submitted with it and the testimony and evidence presented at the
Hearing. The Planning Board made a favorable recommendation on the
proviso that the Applicant provide trash receptacles as the site would
generate more litter than the current use. There was one (1) letter in
opposition in the file, expressing concerns relative to additional
traffic generated by the change in use. The potential lessee was present
at the Hearing, as well as the owner of a neighboring food service
establishment, who spoke in favor of the Application.
3. Applicant, through counsel, represented that the owner wished to
change the use in Unit No.6, of a six (6) unit structures, from retail
use, currently used as a kite shop, to a take-out food establishment for
the sale of beverages and prepared food with no food preparation on the
premises. The Decision in BOA File No. 043-95, as modified in File No.
040-96, limited the uses in the structure to those that would not
increase the overall parking requirement beyond 41 and prohibited any
food service uses in the building. The proposed use would raise the total
required spaces to 44, necessitating additional relief. There would be no
more than four (4) employees on-site at peak shift. There is a loading
zone in the street directly in front of said Unit No.6. One (1) of the
principals of the Realty Trust, represented that Unit No. 6 was situated
somewhat separate from the other five (5) units and had no real relation
to the other retail uses in the other units. They would continue to
prohibit food service establishments from the rest of the property.
Applicant further represented that the change in use would not generate
more traffic in the area as they were primarily targeting walk-by
customers.
4. Therefore, after an extensive discussion about exactly what would
be allowed in the space relative to food preparation, the Board finds
that the change in use from retail to a take-out foo~ service
establishment, would no be substantially more detrimental and would be in
harmony with the purpose and intent of the By-LAw. The change in use
would not have an adverse impact on the area, which predominately
consisted of take-out food establishments and retail shops. In addition,
the impact would be mitigated with the restriction on food preparation
on-site, being limited to the baking of cookies in a convection oven.
While the Board is generally not in favor of allowing take-out food
service establishments in multi-use commercial structures in the downtown
area, this particular space space was not created through the recent
reorganization of interior space and has been a separate space from a
time prior to at least 1970 and has a separate history. The Board further
finds that a waiver of the three (3) additional parking spaces would be
consistent with other permits granted in the downtown area and would be
in harmony with the purpose and intent of the By-law and not contrary to
sound traffic and safety considerations, with parking being physically
impossible to provide on-site. The Board also finds that a waiver of the
loading zone would be in harmony with the purpose and intent of the
By-Law as there is an on-street loading zone immediately proximate the
structure and the business in particular.
5. Accordingly, by a vote of four (4) in favor (Waine, Williams,
Madden and Toole) and one (1) opposed (Sevrens), the Board GRANTS the
requested MODIFICATION and SPECIAL PERMIT relief under Nantucket Zoning
By-Law ~139-9B(2)(0) to allow a change in use to a take-out food service
establishment and under Zoning By-Law ~138-18B(2) and (3) and ~139-20C
waiving three (3) parking spaces and a loading zone, on the following
conditions:
a. Food preparation on-site shall be limited to the baking of
cookies in a convection oven, with all other food being prepared
off-sitei
b. The hours of being open to the public shall be between 5:45
A.M. and 11:00 P.Mi and

c. Relief is hereby predicated upon the particular Lessee
operating the business, i.e, Something Natural, Inc., owned by Matt Fee,
and managed by an employee of said company or an affiliated company,
i.e., Nantucket Bagel Co., and should said Lessee relinquish the lease
to Unit No.6, any relief granted under this Decision shall expire and
the space shall then be governed by those conditions as stated in the
Board of Appeals' Decision in File No. 043-95, as modified in File
No. 040-96.

Applicant seeks Special Per.mits as follows:
A. Under Section l39-33A, Applicant seeks Special per.mit and
modification of Special Per.mit No. 043-95 to strike the condition
therein which states:
"There shall be no food service establishments on the
Premises."
Applicant proposes to change the use of retail space No. 6
from the sale of kites to the sale of coffee, tea and other
beverages and prepared food for take-out. There will be no food
preparation on Premises.
B. Under Section 139-18(3), Applicant seeks Special per.mit and
modification of Special per.mit No. 040-96 to amend the condition
therein which states:
