Applicants are seeking a SPECIAL PERMIT under Nantucket Zoning By-Law §139-33A (alteration/expansion of a pre-existing non-conforming structure/use). Applicants propose to alter a said to be pre-existing detached "carport" by converting the one-story structure to an enclosed studio space with a bathroom, not for human habitation, on the current footprint. The Locus is non-conforming as to lot size, having an area of 3,288+ square feet in a district that requires a minimum lot area of 5,000 square feet; as to side and rear yard setbacks, with the subject structure being sited 0.8+ feet at its closest point from the northeasterly side yard lot line and 3.3+ feet at its closest point from the westerly rear yard lot line along Center Street, and with the principal structure being sited 2.5+ feet at-its closest point from the westerly rear yard lot line, in a district that requires a minimum side and rear yard setback of five (5) feet; and as to ground cover, with the Lot containing 48+% in a district that allows a maximum ground cover ratio of 30% for undersized lots. In the alternative, to the extent necessary, Applicants are seeking relief by VARIANCE from the Intensity Regulations of Nantucket Zoning By-Law §139-16A to complete the project as proposed. In addition, to the extent necessary, Applicants are seeking relief by VARIANCE from the Parking Requirements of Nantucket Zoning By-Law §139-18A. One (1) space is currently provided on site and one (1) space will be provided with the conversion. However, Applicants wish to provide a space that will be 9' x 17.9' rather than the required 9' x 20'. The Premises is located at 2 BROADWAY STREET, SIASCONSET, Assessor's Map 73.2.4, Parcel 3, Plan File 46-N. The property is zoned Residential-Old-Historic. 2. The Decision is based upon the Application and the materials submitted with it and the testimony and evidence presented at the Hearing. The Planning Board made a favorable recommendation. There were five (5) letters in opposition on file and none in favor. The concerns expressed related to traffic congestion, parking problems, regulation of the use, and alteration of the character of the neighborhood. The nearest abutter to the north was preset at the Hearing and spoke in opposition as well as an area resident who felt that the structure should be left as a carport. 3. Applicants, through counsel, represented that the structure pre-dated the 1972 enactment of the Zoning By-Law, having been constructed in 1958 and thus was benefited by grandfathered status. Applicants proposed renovating the existing carport, an open-sided structure, by enclosing it, adding a bathroom and put a new foundation under it. The structure would have the same footprint and come no closer to the side, rear or front yard lot lines than the existing structure. Applicant further represented that there would be no impact on parking as one (1) space would continue to be provided on site. Applicants proposed relocating the existing parking space to the space between the reconstructed carport and the single-family dwelling, with access via Center Street. They wished to avoid cutting down the trees on the southerly side of the house along Main Street to provide a conforming parking space, which would have a far greater impact on the street-shape in the center of Siasconset Village as well as making access to such a space more dangerous. One (1) of the Applicants was an artist and would use the studio for her own purposes and would not use it for living space or as a guest cottage. In response to the northerly abutters' concerns, Applicant agreed to have no windows on that side of the studio and maintain the structure's appearance as a garage, keeping garage doors on the Center Street facade. 4. Therefore, a simple majority of the Board finds that a grant of Special Permit relief to allow conversion of the carport as proposed, would be in harmony with the general purposes and intent of the By-Law and would not be substantially more detrimental to the neighborhood than the existing structure. The rehabilitation of the existing structure, without demolition and reconstruction, would be a benefit to the neighborhood as the current structure is out of character with the surrounding area. Applicants would maintain the garage appearance and there would be no human habitation, thus no increased impact. The one (1) required parking space would continue to be provided, thus no impact on the parking or traffic situation in the area. Renovation of the structure with conversion to studio space would be consistent with other structures and lot coverage within the immediate district and relief granted by this Board. The waiver, by a grant of Variance relief, of the parking space dimensional requirement allowing a truncated space to be provided on site, could be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the By-Law. The uniqueness of lot shape, area and located would support a grant of said relief. The Locus is bordered by three (3) public ways and is subminimum in size minimizing options to relocate the structure and parking space. There are several significant trees located on the site where a parking space that met requirements could be placed that would have an adverse effect upon the character of the neighborhood, making it more desirable to locate the space as proposed by the Applicants. Two (2) members find that it would be substantially more detrimental to the neighborhood to alter the structure and use and that it is a very congested location. 5. Accordingly, upon a motion made and seconded to grant the requested relief upon the following conditions: the structure shall be built in substantial conformance with a Certificate of Appropriateness issued by the Historic District Commission; that one (1) 9' x 17.9' parking space be provided on site as proposed; that there be no bathtub or shower, just a sink and toilet in the studio; and that no exterior construction take place between Memorial Day and Columbus Day of any given year; by a vote of three (3) in favor of said grant (Williams, O'Mara and Sevrens) and two (2) opposed (Waine and Hourihan) the requested relief by SPECIAL PERMIT is DENIED by the Board, with a grant of relief needing a minimum of four (4) in favor. ADDENDUM TO APPLICATION OF FRANK SWAIN and SALLY WALLACE The Applicants are the owners of 2 Broadway Street, Siasconset, shown as land on Plan File 46-N at the Nantucket Registry of Deeds (Tax Map 73.2.4, Parcel 3), a reduced copy of which plan is attached as Exhibit A. The property consists of approximately 3,288 square feet with 70.42 feet of frontage on Broadway Street. The lot, c-iwelling and carport on the property have existed in their present location since prior to 1972. As shown on the mortgage plot plan prepared for the Applicants and attached hereto as Exhibit B, the carport is approximately .8 and 1.3 feet from the northeasterly property line and 3.3 feet from the northwesterly property line, where a 10 foot setback is currently required in the Residential Old Historic District. The total ground cover on the lot is 48%, where 30% is permitted pursuant to Nantucket Zoning By-Law section 139-33E(2). The Applicants seek a Special Permit under Section 139-33A to convert the one- story carport to enclosed studio space not for human habitation, with a bathroom, within its present perimeter. The Applicants plan to move the parking for the dwelling to the yard area labeled "new parking space" on Exhibit B. This change will not result in any increase in a violation of the Nantucket Zoning By-law and does not result in any new violation of the By-law.
