Estate Drive, Avon, CT 06001, Board of Appeals File No. 030-98, the Board made the following Decision: 1. Applicant is seeking a SPECIAL PERMIT under Nantucket Zoning By-Law §139-33A (alteration/expansion of a pre-existing non-conforming use/structure). Applicant proposes to expand the said to be pre-existing single-family dwelling upon the Locus by raising the roof ridge height to create a second floor over the westerly portion of the structure. A portion of the addition will be located within the front yard setback without coming any closer to the lot line than the existing structure. The structure is non-conforming as to front yard setback being sited 20.6+ feet at its closest point in a district that requires a minimum front yard setback of 30 feet; and as to lot size with the Lot having an area of 19,945+ square feet in a district that requires a minimum lot size of 20,000 square feet. The Premises is located at 12 OSPREY WAY, Assessor's Map 82, Parcel 44, Land Court Plan 37073-B, Lot 3. The property is zoned Residential-2. 2. The Decision is based upon the Application and materials submitted with it and the testimony and evidence presented at the Hearing. The Planning Board made no recommendation as the matter was not of planning concern. There was one (1) letter on file in favor of the project and three (3) letters in opposition expressing concerns relating to matters outside of this Board's purview. One (1) abutter, the author of one (1) of the aforementioned letters, was represented at the Hearing by counsel who stated that the proposed alterations would by substantially more detrimental to the neighborhood than the existing house and that Applicant needed to explore other design options. 3. Applicant represented that the single-family dwelling was constructed in 1974 pursuant to a validly issued building permit, when the front yard setback requirement was 20 feet. The front stoop of the structure is sited 20.6± feet at its closest point from the front yard lot line along Osprey Way with the main structure being sited 24.7+ feet at its closest point from that lot line. In 1979 the front yard requirement was raised to 30 feet. Therefore the structure is g~randfathered as to the pre-existing non-conforming front yard setback of 20.6+ feet. The Applicant proposes to add a second floor over the westerly portion of the structure without coming any closer to the front yard lot line, as part of an overall upgrading of the house, raising the roof ridge to a maximum height of 23+ feet. A portion of the new addition will be done over a 1.7+ square-foot section of the existing structure that lies within the front yard setback. The Historic District Commission has issued a Certificate of Appropriateness No. 31,509 for the proposed project as submitted. 4. Therefore the Board finds that the proposed addition will not come any closer to the front yard lot line than the existing structure and due to the de minimous nature of the new intrusion, the addition will not be substantially more detrimental to the neighborhood than the existing non-conforming structure. 5. Accordingly, by a unanimous vote, the Board GRANTS the requested SPECIAL PERMIT under Nantucket Zoning By-Law §139-33A to alter and expand the single-family dwelling as proposed upon the following conditions: a. The additions shall be constructed in substantial conformance with the plan, done by Emack Surveying and dated January 14, 1998 and attached hereto and marked as Exhibit A; and b.
