DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Friday, March 13, 1998, at 1:00 P.M., in the
Conference Room, Town Annex Building, 37 Washington Street,
Nantucket, Massachusetts, the Board made the following decision
on the application of WHITNEY A. GIFFORD, as Trustee of FLAGGSHIP
NOMINEE TRUST I, c/o Reade & Alger Professional Corporation, Post
Office Box 2669, Nantucket, Massachusetts 02584, File No. 029-
98:
2. The applicant is seeking a SPECIAL PERMIT under
Nantucket Zoning By-law §139-33.A(4)(b), for the alteration of a
nonconforming single-family dwelling upon the subject property
(the "Locus"), said to pre-exist the provisions of the By-law
with which it does not conform, supported by a finding under
§139-33.A(4)(a) that the alteration will not be substantially
more detrimental to the neighborhood than the existing
nonconformities. The applicant proposes to place a new basement
foundation under the structure, in the course thereof moving the
structure about two (2) feet closer to Baxter Road, and perform
general renovations; also, to demolish an existing addition not
within the setback and add a new porch not within the setback.
The relocated structure will be set back 20± feet from the front
lot line along Baxter Road, but new steps at the front (westerly)
side of the structure will be set back 18± feet from Baxter Road.
The existing structure is nonconforming as to front yard setback,
having a setback of 19.8± feet in a district that requires a
minimum setback of 30 feet; and as to lot area, having area of
13,202± square feet in a district where minimum lot area is
20,000 square feet. In addition or in the alternative, to. the
extent necessary, the applicant seeks relief by VARIANCE from the
requirements of Nantucket Zoning By-law X139-16.A (Intensity
Regulations) to allow relocation and alteration of the structure
and siting of the front steps within the front yard setback as
proposed. The Locus is situated at 55 BAXTER ROAD, SIASCONSET,
Assessor's Map 49, Parcels 18 and 19, shown upon plan recorded
with Nantucket Deeds in Plan Book 20, Page 90, as Lots 4 and 5.
The Locus is situated in a Residential-2 zoning district.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at" our public hearing. There was no Planning Board
recommendation; the Planning Board referral resulted in the
response that the application did not involve a matter of
planning concern. There was neither support nor opposition, save
that presented by the applicant and his representatives,
presented in person or by correspondence at the public hearing.
4. As presented by the applicant, the Locus is situated on
the easterly side of Baxter Road. Because of the long-term
erosion of the coastal bank to the east of Baxter Road, and
wetlands regulations existing pursuant to the Massachusetts
Wetlands Protection Act and the Nantucket Wetlands Protection By-
law requiring separation of structures from an eroding coastal
bank, the Board of Appeals has in several other cases granted
relief to relocate structures on the easterly side of Baxter Road
within the front yard setback as.measured from Baxter Road. The
applicant's plans to place the remaining portion of the existing
structure farther away from the coastal bank than it now is, with
removal of an addition which will reduce the overall footprint of
the structure, will mitigate the effect of the proposed
alterations. Plans for the proposed changes have been presented
to and approved by the Nantucket Historic District Commission
("HDC") in Certificates of Appropriateness Nos. 31,631 and
31,679. The only portion of the altered structure that will be
closer to Baxter Road than the existing structure will be the new
front steps.
5. Based upon the foregoing facts, the Board voted
UNANIMOUSLY to grant relief ~j V I~NCF~fro the front yard
setback requirement of the S` B~y~la~ ~''E~ app~rcY"ve the proposed
alterations, subject to the condition that the alterations be
performed in substantial conformity to the plan drawn by
Nantucket Surveyors, Inc., dated February 5, 1998, a copy of
which was submitted to the Board of Appeals and a reduced copy of
which is attached hereto as Exhibit A, and to the plans submitted
to the HDC and approved in Certificates of Appropriateness Nos.
31,631 and 31,679. In support of this action, the Board of
Appeals found that, owing to circumstances of the physical
conditions of soil conditions and topography affecting the Locus
and not generally affecting the Residential-2 zoning district,
consisting of the location of the coastal bank in close proximity
to the Locus, a literal enforcement of the provisions of the
Zoning By-law would involve substantial hardship to the
applicant, and that desirable relief could be granted to support
the requested variance without derogating from the purpose and
intent of the By-law, in that the maintenance of separation from
the coastal bank and consequent attention to wetlands concerns,
and the reduction in overall footprint of the structure, address
important public concerns and justify the granting of variance
relief.

6. Based upon the granting of the above variance relief,
and determining that relief by variance, rather than by special
permit, was necessary for the proposed alterations, the Board of
Appeals took no action upon the appl' request for a special
permit.
