At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, March 13, 1998, at 1:00 P.M., in the Conference Room, Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, the Board made the following decision on the joint application of NANTUCKET ISLAND SCHOOL OF DESIGN AND THE ARTS, INC. ("NISDA"), and DAVID B. The relocation of ''.~~.e `kaoundary line as proposed by the applicants-will result in the creation of two lots. One (the "New NISDA Lot"), to be init`allywned by NISDA, will have area of 88,370± square feet, 210,.84± f t of frontage on Wauwinet Road, and ground cover ratio of g:.5±o. The other (the "New Voorhees/Murphy Lot"), to be initially owned by Voorhees/Murphy., will have area of 145,427± square feet, at least 200 feet of continuous frontage on Wauwinet Road, and ground cover ratio of 4.9±0. Current zoning requirements for the Limited Use General-3 zoning district include minimum lot area of 120,000 square feet, frontage of 200 feet, front yard setback of 35 feet, and side and rear yard setbacks of 20 feet. If the requested zoning relief is granted, the conveyance of land between the parties as proposed will result in the parties having cured all zoning nonconformities which the parties have the ability to cure, given the size, shape and topography of the parcels comprising the Locus and the structures thereon; no new zoning nonconformity being created; and no existing zoning nonconformity being intensified. The applicants further request that any decision granting such relief set forth that the Special Permit relief granted in Board of Appeals File No. 027-80 shall henceforth apply only to the New NISDA Lot and not to the New Voorhees/Murphy Lot. The subject parcels (together, the "Locus") are located at 19, 21, and 23 WAUWINET ROAD; Assessor's Map 20, Parcels 35, 8.9, and 36; Lots 26 and 27 on Land Court Plan 6283-Q and Lot 65 on Land Court Plan 6283-3; and are situated in a LIMITED USE GENERAL-3 zoning district. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. There was no Planning Board recommendation; the communication received by the Board of Appeals from the Planning Board set forth that the application did not raise an issue of planning concern. Several neighbors appeared in support of the application; no opposition was presented in person or by communication at the public hearing. Two letters were received by the Board of Appeals from neighbors, indicating that the writers were not opposed to granting of the requested relief, provided that no expansion of the existing structures on the New NISDA Lot would occur without further relief from the Board of Appeals. 4. The Locus includes two parcels that were formerly in common ownership, Lots 26 and 27 on Land Court Plan 6283-Q (Lot 26 now being owned by NISDA and Lot 27 now being owned by Voorhees/Murphy), and Lot 65, an adjacent parcel subsequently acquired by the owner of the Voorhees/Murphy land and automatically merged with Lot 27. Lots 26 and 27 are portions of an old farm, and many of the farm buildings remain. Subsequent to the effective date of the adoption of the zoning provisions that placed the Locus in a Limited Use General-3 zoning district, Lots 26 and 27 were created by a plan endorsed as "approval not required" by the Nantucket Planning Board, presumably on the basis that each lot contained buildings pre-existing the 1955 adoption of subdivision control in Nantucket, and these lots were conveyed into separate ownership; however, no relief was obtained with respect to the zoning nonconformities of either lot that were created by this conveyance. The Voorhees/Murphy property is used for permitted residential purposes, with a dwelling and appurtenant structures; the NISDA property is used for educational purposes by NISDA, a nonprofit educational corporation; exempt from use requirements under the Massachusetts Zoning Act. At the inception of NISDA's use, a Special Permit 2 was issued by the Board of Appeals in Case No. 027-80, which established parking requirements and set forth certain conditions with respect to NISDA's use. Representatives of NISDA stated at the public hearing that the proposed reconfiguration would facilitate continuing compliance with the conditions in Case No. 027-80 and permit several aesthetic improvements, including restoration of one of the existing silos and the replacement of its roof structure. As set forth above, the present owners of the Voorhees/Murphy property and of the NISDA property have brought this application jointly in order to seek variance relief necessary to approve the reconfiguration of the boundary line between these properties in a manner which cures or minimizes the zoning nonconformities of each parcel to the extent that the parties have the ability so to do considering the existing configuration and topography of ,the Locus and the structures thereon, while not increasing any existing nonconformity nor creating any new one. 5. By a UNANIMOU~~~~e,~~~e`Bo~r,~~~ Appeals voted to grant relief by VARIANCE o a w h reconfiguration of the applicants' properties as requested, subject to the conditions set forth below, based upon the finding that owing to circumstances relating to the soil .conditions, shape, and topography of the existing land and the pre-existing structures thereon, and especially affecting the Locus but not generally affecting land in the Limited Use General-3 district, a literal enforcement of the provisions of the Zoning By-law would involve substantial hardship to the applicants, and that desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the By-law (in that the existing structures are protected, and the reconfiguration of lot lines as proposed will have a beneficial effect upon zoning compliance). 6. The relief granted hereby is upon the following conditions: (a) The Special Permit relief granted in Case No. 027- 80 shall henceforth apply to all of the New NISDA Lot, and no.t to the New Voorhees/Murphy Lot. NISDA must provide a minimum of 19 on-site parking spaces, based upon a peak use on-site of seven teachers and staff persons, and 36 students. NISDA must comply with all other conditions of the relief granted in Case No. 027- 80. (b) The redivision of the Locus shall be done in substantial conformity with the plan drawn by Hayes Engineering, Inc., dated February 4, 1998, revised February 6, 1998, a copy of which was submitted to the Board of Appeals, and a reduced copy of which is attached hereto as Exhibit A. 3 (c) No exterior-expansion of the existing structures on the New NISDA Lot, as shown on Exhibit A, shall take place without further relief from the Board eals. VOORHEES and SUSAN E. MURPHY This is a joint application by Nantucket Island School of Design and the Arts, Inc. ("NISDA") and David B. Voorhees and Susan E. Murphy ("Voorhees/Murphy"), owners of adjacent properties situated on the southerly side of Wauwinet Road, for Variance relief, for the alteration of their parcels containing pre- existing, nonconforming structures by changes in the boundary lines which will reduce nonconformities of the lots and buildings thereon but will not eliminate these nonconformities. The NISDA land, consisting of Lot 26 on Land Court Plan 6283-Q, having a lot area of 50,055± square feet in a zoning district requiring minimum lot area of 120,000 square feet, is improved with buildings used in connection with educational facilities operated by NISDA, a nonprofit educational corporation. These structures are nonconforming as to ground cover {5,795± square feet, for a ground cover ratio of 11.80±, in a district where 30 is the maximum permitted) and side and rear yard setback (18± feet of westerly side yard setback and 10± feet of rear yard setback at the closest points, in a district where 20 feet is the minimum setback, the subject properties not being lots of record) . The Voorhees/Murphy land, consisting of Lot 27 on Land Court Plan 6283-Q and Lot 65 on Land Court Plan 6283-3, treated as a single lot for zoning purposes, is conforming as to lot area, containing 183,742± square feet, but is nonconforming as to frontage, with 183.64± feet of continuous frontage on Wauwinet Road and 49.27± feet of frontage on Wauwinet Road in another location. This property is improved with a single-family dwelling and numerous outbuildings used as ancillary thereto, most of which reflect the historic use of the property as a farm. These structures are nonconforming as to front yard setback, with 26± feet at the closest point in a district requiring minimum front yard setback of 35 feet, side yard setback (8± feet from the northerly side of a silo, and 4± feet from the westerly side of a shed), and ground cover ratio (8,932± square feet, or 4.9%±). The applicants propose to relocate the boundary line between their respective lots, as shown upon the plan submitted herewith, with a portion of the NISDA land being conveyed to Voorhees/Murphy to cure the frontage nonconformity of the Voorhees/Murphy land, and a portion of the Voorhees/Murphy land being conveyed to NISDA to reduce the area nonconformity of the NISDA land. Certain of the buildings upon the Voorhees/Murphy land will be on the portion conveyed to NISDA. The setback nonconformities of the NISDA land will be eliminated, and the northerly side yard setback nonconformity of the Voorhees/Murphy land will be eliminated (the other setback nonconformities of the 1 s Voorhees/Murphy land being beyond the power of the parties to cure). The NISDA land after the conveyances will have lot area of 88,370± square feet, and ground cover of 8,437± square feet, for a ground cover ratio of 9.50±. The Voorhees/Murphy land after the conveyances will have lot area of 145,427± square feet, and ground cover of 7,191± square feet, for a ground cover ratio of 4.90±. The reasons that the area of land proposed to be conveyed by Voorhees/Murphy to NISDA is less than the entire excess lot area of the Voorhees/Murphy land over the 120,000 square feet of minimum lot area are (a) that any additional conveyance above that proposed would result in increase of the ground cover ratio of the Voorhees/Murphy land above the present nonconforming 4.90±, and (b) wetlands found on both properties make it impossible for e~~ lot, to comply with the definitional requirement that each newly-created lot contain 900 of the required lot area as land exclusive of wetlands as defined under the Massachusetts Wetlands Protection Act. Accordingly, the result of the proposed conveyances, if the variance relief necessary to make them is approved, will be that all existing zoning nonconformities which the parties have the ability to cure will be cured, no new zoning nonconformity will be created, and no existing zoning nonconformity will be intensified. As to the NISDA land, the nonconforming lot area will be increased, the nonconforming ground cover ratio will be reduced, and the setback nonconformities will be eliminated. As to the Voorhees/Murphy land, the frontage nonconformity will be cured, the nonconforming ground cover ratio will stay the same, one setback nonconformity will be eliminated, and the other two setback nonconformities, neither of which is a setback from the NISDA land, will not be affected. No modification is sought from the provisions of the existing Special Permit in Board of Appeals Case No. 027-80, affecting the NISDA land, establishing parking requirements and setting certain conditions, except that the parties request that the Board of Appeals decision granting relief in this case set forth that the provisions of that Special Permit shall henceforth apply to the reconfigured NISDA land and not to the reconfigured Voorhees/Murphy land.
