KESSLER AND JANE R. KESSLER, c/o Vaughan and Dale, P.C., P.O. Box 659, Nantucket, MA 02554, Board of Appeals File No. 025-98, the Board made the following Decision: 1. Applicants are seeking a SPECIAL PERMIT under Nantucket Zoning Bu-Law §139-16C(2) to validate an unintentional front and side yard setback intrusion not greater than five (5) feet and not closer than four (4) feet from a lot line and to allow the alteration of the single-family dwelling within the front and side yard setback areas. As a part of an overall renovation of the structure, which would raise the ground cover from 979+ square feet to 1,020+ square feet, Applicants wish to add a second story, which includes removing the existing deck on the north side of the house and building an enclosed foyer and entrance way as well as a new smaller deck that would be sited no closer to the front yard lot line than the existing structure which is sited 34.E + feet at its closest point in a district that requires a minimum front yard setback of 35 feet. The addition would also raise the roof ridge height within the required 10-foot easterly side yard setback area though come no closer than the existing structure which is sited 7.3 + feet at its closest point from that side yard lot line. The Locus is also non-conforming as to lot size having a lot area of 8,882+ square feet in a district that requires a minimum lot area of 120,000 square feet; and as to frontage, having 50 feet of frontage along Wanoma Way in a district that requires a minimum of 200 feet. In addition, or in the alternative, to the extent necessary, Applicants are seeking relief by VARIANCE from the requirements of Nantucket Zoning By-Law §139-16A to validate the siting of the structure and to allow the additions as proposed. The premises is located at 19 WANOMA WAY, TOM NEVERS, Assessor's Map 92.4, Parcel 303, Land Court Plan 5004-D, Lot 15. The property is zoned Limited-Use-General-3. 2. The Decision is based upon the Application and the materials submitted with it and the testimony and evidence presented at the Hearing. The Planning Board made no recommendation as the matter was not of planning concern. There were two (2) letters in opposition and one (1) letter in support in the file. The direct abutter to the west, also represented by counsel at the meeting, was present and spoke in opposition to the project. He expressed concern about further encroachment into the setback areas and stated that there were insufficient grounds to support a finding of uniqueness and hardship and a grant of Variance relief. Applicants, through counsel, offered to plant a thick vegetative buffer between the subject structure and the neighbor's property to minimize the impact of the new additions. 3. Applicants, through counsel, represented that the single-family dwelling was constructed in 1979 pursuant to a validly issued Building Permit. At that time no certified plot plan, or "as-built", was required and a Certificate of Occupancy was issued with the representation made that the structure met the required 35-foot front yard setback and the 10-foot side yard setback. Upon a new certified plot plan being done, the structure was found to be sited 34.3 feet and 7.3 from those lot lines. Applicants are seeking validation of the existing siting of the structure as well as permission to extend the setback intrusions without coming any closer to the front or easterly side yard lot lines. Applicants represented that they had received an Order of Conditions, DEP File No. SE48-1116, from the Conservation Commission for the alterations as proposed and a Certificate of Appropriateness, No. 30831, from the Historic District Commission, and stated that it would be a financial hardship to move the house for the sake of such diminimous unintentional setback intrusions. Applicant further stated that they had no other option, other than the plans submitted with the Application, if they wished to expand the structure, due to the close proximity of the bluff. 4. Therefore, the Board finds that the front yard setback intrusion of less than one (1) foot and easterly side yard setback intrusion of 2.9+ feet are unintentional and a grant of Special Permit relief to validate the existing siting of the structure would be in harmony with the purpose and intent of the Zoning By-Law and the burden of correcting the intrusions substantially outweigh any benefit to an abutter of eliminating the intrusion. Further, the Board finds that the structure does not receive any benefit from any grandfathered provisions as the structure was constructed after the time of the 1972 enactment of the Zoning By-Law and subsequent to upzoning in the area, making the structure non-complying and not pre-existing non-conforming. Thus, any expansion in the setback areas, as proposed by Applicants, would necessitate a grant of Variance relief not Special Permit relief. Therefore, the Board finds that there is insufficient grounds to support a grant of Variance relief for the additions within the setback areas as proposed in this Application. The Board notes that Applicant could expand the structure up to 1500 square feet outside of the required setback areas without further relief from this Board. 5. Accordingly, by a unanimous vote, the Board GRANTS the requested SPECIAL PERMIT under Nantucket Zoning By-Law §139-16C(2) to validate the unintentional front yard setback intrusion of 8.4+ inches and easterly side yard setback intrusion of 2.9± feet upon the following condition: - There shall be no further construction within the required 35-foot front yard setback area or the required 10-foot side yard setback areas. 6. Accordingly, upon a motion made to grant the requested Variance relief under Nantucket Zoning By-Law §139-16A to expand the structure as proposed with the conditions of plantings being provided along the westerly side yard lot line and that there be no construction within twelve (12) feet of that side line, there were no votes in favor and five (5) votes in the negative (Waine, Williams, Hourihan, Sevrens and Toole). Kessler, seek a SPECIAL PERMIT pursuant to Section 139-16C(2) of the Nantucket Zoning By-Law to validate unintentional front and side yard setback intrusions not greater than five (5) feet into a requ~ ar~~~~g~~ x rior alteration of the structure. Kessler, seek a VARIANCE from the front and sid yard requirements of Section 139-16A pursuant to Section 139-32 of the Nantucket Zoning By-Law to establish and approve the present siting of the wood frame house at 9 Wanoma Way, Nantucket, with respect to a front and side yard setback and to allow the exterior alteration as proposed. The premises is in the LUG-3 Zoning District. The Premises consists of a story and a half wood frame, single-family dwelling located on apre-existing non-conforming lot of record with a land area of 8, 883 +/- square feet. The house is non-complying as to front yard setback having a front yard setback of 34.3+/- feet in a Zoning District that requires a front yard setback of 35 feet. The house is non-complying as to side yard setback, being 7.3+/- feet from the easterly property line at its closest point in a Zoning District that requires a 10 foot setback for lots of record. The premises is conforming as to ground cover having a present ground cover of 979+/- square feet in a Zoning District that allows ground cover ratio of 3 % or, in the case of a pre-existing undersized lot of record ground cover of no greater than 1,500 square feet. The structure was built pursuant to a validly issued building permit dated April 4, 1979. On that date, the setback requirements for this Zoning District were 35 feet for the front yard setback and 3 feet for the side and rear yard setbacks. Applicants now wish to alter the structure by adding a second story, removing the existing deck on the north side of the house, and building an enclosed foyer and entrance way on the north side of the house as well as a small deck. The enclosed foyer will come no closer to the front yard lot line than 34.3 +/- feet. The deck will comply with the front yard setback requirement. The ground cover of the house with the addition of the enclosed foyer and entrance way will increase from 979+/- square feet to approximately 1,020+/- square feet, substantially less than the 1,500 square feet allowed by the By-Law. The structure is non-complying as to front yard setback, however, it is sited approximately 44 +/- feet from the constructed edge of Wanoma Way. Applicants opine that the setback intrusion is unintentional and respectfully request a SPECIAL PERMIT to validate the siting of the dwelling. In the alternatively. G2c~Pc~Qi9`r ~ Applicant requests a VARIANCE to establish and approve the siting of the structure with respect to the front yard setback in order to bring the building as constructed into compliance with the requirements of the Zoning By-Law. Locus is 50+/- feet wide by 177+/- long. The viable building area on locus is limited by a coastal bank that begins approximately 90 +/- feet from the front property line. Locus then drops off 24 +/- feet vertically over a distance of 35 +/- feet horizontally. The requested VARIANCE from the requirements of the Zoning By-Law is de minimis and may be granted owing to the shape of topography of the locus without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Nantucket Zoning By-Law. A literal enforcement of the provisions of this By- Law would involve substantial hardship to the Applicants. Applicant further respectfully requests a SPECIAL PERMIT, to the extent one is required and the relief is appropriate, to allow the construction of a second story on a portion of a structure that violates a side and front yard setback. The non- complying distance from the property line will not be made more non-complying and the extension will not be substantially more detrimental to the neighborhood than the existing non-conforming structure. To the extent that VARIANCE relief is required, with respect to the side and front yard setback violation, the Applicant respectfully requests that the Board grants such relief to validate the siting of the house and complete the project as proposed.
