Applicant is seeking a MODIFICATION of the VARIANCE granted in BOA File No. 139-86 as amended in BOA File No. 014-88. Applicant proposes to change, in part, the uses on the first floor of the structure. The Lot contains a three-story structure that contains a retail record store in the basement area; a 100+ square-foot retail shop on the first floor; six (6) guest rooms on part of the first floor and all of the second floor; and an apartment on the third floor. Applicant wishes to alter the uses by eliminating three (3) guest rooms on the first floor and replacing them with one (1) retail space and office space. The current uses in the structure require nine (9) spaces. There is one (1) space currently provided on site. No change in footprint is proposed. The Locus is non-conforming as to lot area, having an area of 1,885+ square feet in a district that requires a minimum of 5,000 square feet; as to front yard setback with the front steps encroaching into the street by 6+ inches at their farthest point; as to side and rear yard setback, with the structure being sited 2.3+ feet at its closest point from the southwesterly side yard lot line and closer than five (5) feet at its closest point to the rear yard lot line, in a district that requires a minimum side and rear yard setback of five (5) feet; as to ground cover ratio, having a ratio of 52+°~ in a district that allows a maximum ground cover ratio of 30% for undersized lots; and as to parking and loading zone requirements. Applicant further seeks a SPECIAL PERMIT under Nantucket Zoning By-Law §139-20C (loading zone) and to the extent necessary, under §139-18B(2) and (3) (Parking Requirements). The premises is located at 4 EAST CHESTNUT STREET, Assessor's Map 42.3.1, Parcel 10.1, Plan Book 20, Page 37, Lot 4. The property is zoned Residential-Commercial. 2. The Decision is based upon the Application and materials submitted with it and the testimony and evidence presented at the Hearing. The Planning Board made a favorable recommendation on the condition that a loading zone be provided in the existing brick parking area. There was one (1) letter on file in support of the Application, stating that it would be a potential improvement. 3. Applicant, through counsel, represented that the premises was subject to two (2) Decisions duly issued by the Nantucket Zoning Board of Appeals. In Board of Appeals File No. 139-86, the Board granted Variance relief to validate the Locus as a separately marketable undersized lot as well as validate the structure as sited upon the Lot, conditioned on there being no further expansion or change of use of the structure without further relief from the Board of Appeals. In Board of Appeals File No. 014-88, the Board granted Special Permit relief for parking to allow expansion of the basement retail area to 659+ square feet. No relief for a loading zone was asked for or granted in either previous Decision, when such relief should have been sought. The proposed changes upon the premises consist of the elimination of three (3) guest rooms on the first floor, allowing the expansion of the existing retail shop from 111+ square feet to 281+ square-feet and creation of a separate 245+ square-foot office space, with no change in the uses in the basement or on the second and third floors. One (1) parking space would continue to be provided on-site. Applicant further represented that there would be no change in the parking requirement, i.e., the current uses require ten (10) spaces with the new uses requiring ten (10). With the proposed change in use there would be 653+ square feet of retail space in the basement, 281+ square feet of retail space on the first and 245+ square feet of office space on the first floor, three (3) guest rooms on the second floor and one dwelling unit on the third floor, with a total number of employees on site not to exceed four (4). 4. Therefore, the Board finds that a grant of a Modification of the Variance granted in BOA File No. 139-86 to allow interior changes as proposed and detailed above, may be done without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the By-Law. There will be no expansion of the structure and any changes will be made to the floor plan of the structure, not triggering any further parking requirements. As to relief for parking spaces and loading zone, the Board finds that it is physically impossible to provide parking space and a loading zone on site, and that a waiver of nine (9) spaces with one (1) provided on site, as well as the loading zone, would be in harmony with the general purpose and intent off the By-Law and would not be contrary to sound traffic, parking or safety considerations. The Board notes that there are several on-street designated loading zones proximate the Locus from which deliveries can be made. 5. Accordingly, by a unanimous vote, the Board GRANTS the requested MODIFICATION of the VARIANCE granted in BOA File No. 139-86 as amended in BOA File No. 014-88, to allow conversion of interior space as detailed above and further GRANTS a SPECIAL PERMIT under Nantucket Zoning By-Law §139-20C, waiving the loading zone and, to the extent necessary, a SPECIAL PERMIT under Nantucket Zoning By-Law §139-18B(2) and (3) waiving nine (9) parking spaces, upon the following condition: - One (1) on-site parking space shall be provided and said space shall be for the sole use of the tenant(s) in the third floor dwelling unit. Walsh, Trustee of 4 Chestnut Nominee Trust, seeks MODIFICATION OF THE VARIANCE RELIEF granted in Board of Appeals Decision 139-86 to change, in part, the uses on the first floor of the pre-existing, non-conforming structure. Applicant also seeks a SPECIAL PERMIT waiving the requirement of providing off-street loading requirements pursuant to the Nantucket Zoning By-Law 139-20C. Additionally, Applicant also seeks a SPECIAL PERMIT, to the extent needed, waiving the off-street parking requirements pursuant to Nantucket Zoning By-Law, Section 139-18B (2) and (3). The Premises include apre-existing, non-conforming lotcontaining 1,885+/- square feet in a Zoning District with a minimum lot size of 5,000 square feet and a three story wood frame building non-conforming as to front yard setback, having steps that encroach on the northerly property line by 6+/- inches in a Zoning District that has a front yard setback requirement of 0 feet. Additionally, the structure is non-conforming as to side yard setbacks, having a setback of 2.3+/- feet at its closest point on its southwesterly property line. The Premises is non-conforming as to ground cover, having a ground cover ratio of 52+/- % in a Zoning District that allows a ground cover of no greater than 50% of land area. The current uses in the building consist of a retail record store [Musicall] in the basement area; a retail shop approximately 100 square feet in size on the first floor; six guest rooms divided over the balance of the first floor and the second floor; and an owner's apartment on the third floor. The uses on the Premises in its present configuration require nine parking spaces. Applicant proposes the elimination of three guest rooms on the first floor. The first floor space would be then dedicated to one retail space on the Chestnut Street side of the building and an office space on the back of the building, in other words, the southerly side of the building. The elimination of the three guest rooms and addition of the retail space and office space does not generate any new parking. In their proposed configuration, the uses of the building would generate the need for nine off-street parking spaces. Applicant provides one now. Applicant seeks a SPECIAL PERMIT waiving the requirement of providing off- street parking spaces pursuant to Nantucket Zoning By-Law 139-18B (2) and (3). Compliance with the parking requirements, other than the single-space already provided at this location, is physically impossible for the Applicant to provide. Additionally, such relief would be in accord with the general lack of off-street parking in that portion of Nantucket Town. Applicant seeks a SPECIAL PERMIT pursuant to Nantucket Zoning By-Law 139- 20C, waiving the requirement of anoff-street loading facility. The Applicant states that the provision of off-street loading facility as required by the By-Law is physically impossible to provide. This relief may be granted and is in harmony with the general purpose and intent of this By-Law. There are already a number of loading-zone reserved areas on Federal Street and South Water Street which would be available for use by the modest retail space proposed for the first floor of the Premises.
