Goodall and Herbert W. Goodall, 109 Teal Nest Court, Ponte Vedra, FL 32082, Board of Appeals File No. 019-98, the Board made the following decision: 1. Applicants are seeking relief pursuant to a VARIANCE under Nantucket Zoning By-Law Chapter 139-32A from the requirements of Nantucket Zoning By-Law 139-16A (Intensity Regulations - rear line setback) . Applicants propose to relocate a door and steps from the westerly side of the single-family dwelling to the southerly side of the building. This relocation would eliminate the westerly side line setback encroachment of the steps on the westerly abutting property but would create a southerly rear yard setback violation with the new steps being sited approximately one (1) foot from the rear yard lot line. Applicants also seek a SPECIAL PERMIT under Nantucket Zoning By-Law 139-33A (alteration/expansions of a pre- existing non-conforming structure/use). Applicants propose to expand an existing second-floor deck within the required five-foot rear yard setback area. In the alternative, Applicants are seeking a VARIANCE under Nantucket Zoning By-Law 139-16A to complete the work as proposed. See also BOA file No. 076-97. The premises is located at 18 STILL DOCK - UNIT 6 STILL DOCK CONDOMINIUM, Assessor's Map 42.3.1, Parcel 85, Plan File 28-A. The property is zoned Residential-Commercial. 2. The decision is based upon the application and materials submitted therewith, and the testimony and evidence introduced at the hearing. There was no recommendation from the Planning Board as the Board determined that the matter was not a planning concern. There were no letters on file. 3. Applicants' attorney presented the case for the Applicants. He explained that after Applicants had obtained relief from the Board of Appeals in December, 1997 (Case No. 076-97) allowing the existing house to be raised two feet to construct a foundation, they assumed they did not need further relief from the Board. However, when they submitted their plans, which moved the door and stairs from the westerly side of the building, where the existing stairs violated the side yard setback and in fact went over the property line, to the northerly side, facing Old North Wharf, to the Building Department, the Assistant Building Inspector, pointed out that their lot did not have legal frontage on Old North Wharf so that the northerly side was technically their rear yard, not their front yard as they had assumed, necessitating a five foot setback requirement. The new stairs would only be one (1) foot from the northerly property line. Applicants' attorney explained that this is a unique lot in a unique neighborhood and that everyone had considered the northerly side to be the front of the building since the building had been moved to its present location in 1955. Applicants also wished to expand the size of the second floor deck which also sits within the five (5) foot rear yard setback area. It is impossible to determine from public records the date of construction of the existing non-complying deck. The deck would enjoy status as a pre-existing, non-conformity if constructed prior to 1972, but even if constructed in the early 1980s, the deck would be protected from enforcement action by virtue of the curative provisions of Chapter 139-25 C (3) of the Nantucket Zoning By-Law. Applicants presented photos of five other houses in the North Wharf neighborhood that have similar second floor decks opening onto North Wharf. 4. The Board finds as follows: a. Due to the shape of this lot and its unique characteristics, namely the fact that it has no legal frontage on North Wharf nor Still Dock, the proposal to move the door and steps from the westerly side of the. building to the northerly side is in harmony with the residential character of the neighborhood, will not detract from the spirit or intent of the By-Law, and will cure a side yard setback intrusion onto an abutting lot. b. The existing siting of this house on this unique lot with practical but not legal access on North Wharf, and no legal frontage on Still Dock, support the award of a Variance. c. A literal enforcement of the provisions of this zoning by-law would involve substantial hardship to the Applicants and desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the By-Law. d. When Applicants purchased the property in February, 1997 there were no notices or violations of any kind posted with the Building Department or Zoning Enforcement Officer relative to the second floor deck. As far as Applicants knew, the second floor deck was a legitimate, non-conforming deck which had been constructed prior to the enactment of zoning. Applicants have since learned that the deck was built sometime in the early 1950's but they have been unable to ascertain the exact date, although there is evidence that the deck was in existence in 1955. Applicants' use of this deck might be curtailed without the requested expansion but they will not suffer any hardship which would justify the granting of variance relief. However, this second floor deck is protected from forced removal or other enforcement action by virtue of the ten(10) year curative provisions contained in Chapter 139-25 C (3). 5. (A) Accordingly, the Board unanimously voted as follows: I . to GRANT THE VARIANCE under C . 13 9 -16A to allow the steps to be placed within one (1) foot of the northerly boundary line as shown on plan drawn by Neil Parent attached hereto as Exhibit "A". II. To GRANT THE VARIANCE from the provisions of C. 139-16A to validate the size and location of the existing second floor deck. (B) It was then moved to grant relief by VARIANCE from the provisions of C.139-16A to allow the expansion of the second floor deck as proposed, with two (2) votes in favor (Williams and O'Mara) and three (3) votes in opposition (Sevrens, Toole and Waine), a grant of relief requiring four (4) votes in favor, t e requested relief is denied. A Variance to allow a door and steps on the westerly side of the building to be moved to the southerly side of the building. This change does away with a side line set-back violation but creates a rear line set-back violation. 2. House ~is to be raised above flood plain and would require a min. 3' landing extending into the abutting property, substantially more non- conforming than the existing granite step. Moving the entry to the north wall would locate the stop entirely on applicant's property but into the rear line setback. Applicant's entrance to the property is via Old North Wharf and a private parking space there and this is the de facto front of the property. An existing 6" wood fence runs along the northerly boundary effectively blocking entry onto the property except at a gate at the northwesterly corner of the residence. Relief is sought to locate the "front" step partially within the setback. BALCONY An existing balcony at the second floor north facade was apparently added without benefit of permitting at some time in the past, and although documentation is not available it appears that the balcony has been in place for some time, estimated by existing conditions to be well in excess of 10 years. Relief is sought to increase the size of the balcony which will be partially within the rear setback but supported entirely by knee braces with no structural elements to grade. P.O. BOX 298.
