At a Public Hearing of the ZONING BOARD OF APPEALS held at
1 : 0 0 P . M . , Friday, March 13 , 1998 , in the conference room at the
Town Building Annex, 37 Washington Street, Nantucket,
Massachusetts, on the Application of Richard and Kathryn Glidden,
18 MacLean Lane, Nantucket, MA 02554, Board of Appeals File No.
017-98, the Board made the following decision:
1. Applicants are seeking a SPECIAL PERMIT under Nantucket Zoning
By-Law Chapter 139-16C(1). Applicants are asking the Board to
validate the siting of an existing 8' x 10' storage shed by
reducing the required 10-foot side yard setback to 9.72+/- feet
from the northwesterly side yard lot line. The Locus conforms to
all other dimensional zoning requirements.
The premises is located at 18 MACLEAN LANE, Assessor's Map 55,
Parcel 448, Plan File 9-B, Lot 9. The property is zoned
Residential-10.
2. The decision is based upon the application and materials
submitted therewith, and the testimony and evidence introduced~at
the hearing. There was no recommendation from the Planning.Board
as the Board determined that the matter was not a planning concern.
There were no letters on file.
3. Applicant, Richard J. Glidden, represented himself giving
credence to the adage that "when a lawyer represents himself,he has
a fool for a client". Mr. Glidden explained that he constructed an
8' x 10' garden shed in the rear portion of his property. He
obtained H.D.C. approval and the necessary building permit and
measured 14 feet from the rear and side property line to insure
that this structure would be well beyond the 10 foot side yard set-
back requirement. Unfortunately, Mr. Glidden neglected to consider
the angle of the northerly sideline with the result that while one
corner was 14+ feet from the sideline, the other corner was only
9.72 feet from the sideline. Under cross-examination from the
Board, Mr. Glidden admitted that while he had always dreamed of
being a surveyor, his actual experience in this field was quite
limited.
4. The Board finds as follows: .

a. This minimal sideline setbacks was unin ntional and
applicant did attempt to delineate the sidelines prior to
construction.
b. Granting of relief would be in keeping with the purpose
and intent of the By-Law.
5. Therefore, by unanimous vote, the BOARD GRANTS THE SPECIAL
PERMIT under Chapter 139, Section 16(c)(1) reducing the side yard
setback to 9.72 feet to validate the siting of the shed in its
present location as shown on plot plan prepared by John J. Shugrue,
Inc., dated May 28, 1996, a copy of which is attached to this
Decision as Exhibit "A", conditioned upon the following:
(a) No further construction will be allowed wtihin said
set back area.

Applicant constructed an 8 x 10 storage shed on their property pursuant
to Building Permit No.~~'~.s~-~s. The side-line setback is ten (10) feet
