ARNOLD TEASDALE, LTD., FOR ITSELF AS OWNER AND FDR BROOKS C. HALL AND SALLY BATES HALL, CONTRACT PURCHASERS, of P.O. Box 607, Siasconset, MA 02564 and 52 Hummock Pond Road, Nantucket, MA 02554, respectively, Board of Appeals File No. 009-98, the Board made the following Decision: 1. Applicants (Halls) are seeking a SPECIAL PERMIT under Nantucket Zoning By-Law §139-9B(2)(a) (Light manufacturing), §139-9B(2)(b) (Storage and warehousing) and §139-9B(2)(c) (Fabrication and assembly of component parts for off-site construction or use). Applicants propose to construct a 3173+ square-foot building on an approximately 13,666 square-foot lot that would be used for 850+ square feet of retail space, 290+ square feet of office space and 2210+ square feet of shop space with one (1) dwelling unit on the second floor. All dimensional and parking requirements will be met. The Premises is located at 16 TEASDALE CIRCLE, Assessor's Map 69, Parcel 79, Land Court Plan 14,342, Lot 63. The property is zoned Residential-Commercial-2. 2. The Decision is based upon the Application and materials submitted with it and the testimony and evidence submitted at the Hearing. The Planning Board made a favorable recommendation suggesting specific revisions to the "Site Plan" as originally submitted. There was no opposition in person or in writing, presented at the Public Hearing. 3. Applicants seek the relief described above in connection with the proposed construction of a commercial building to be used as an electrical retail shop with related office and storage space and for construction purposes and related uses. There would be one (1) second floor apartment unit. These uses fall within the categories of "light manufacturing" and "fabrication and assembly of component parts for off-site construction or use", which are allowed by Special Permit in the Residential-Commercial-2 district. In addition, the storage of materials in connection therewith falls within the category of "storage and warehousing, including properly secured open storage of goods and materials", which is also allowed by Special Permit in this district; in fact, Applicants represented during the Hearing that no outside storage is proposed. The Locus, is situated in an area where similar uses are present, mostly pursuant to Special Permits issued by the Board of Appeals. The Applicants presented a detailed site plan to the Board of Appeals, as required by Zoning By-Law §139-23, showing the proposed layout of the building and site improvements, which included a 372+ square-foot shed located in the southwesterly corner of the Lot. Applicants also represented that the plans had been approved by the Nantucket Historic District Commission under Certificate of Appropriateness No.3/~ ~Co~ Applicants will meet all of the green space, parking and loading zone requirements. 4. Based upon the foregoing information received by the Board of Appeals, the Board finds that the grant of relief as requested would be in harmony with the purpose and intent of the Zoning By-Law. The Locus is situated in an area that is extensively developed for commercial purposes and Applicants will meet all of the Zoning By-Law requirements pertaining to the uses as proposed. The grant of relief would be consistent with other uses permitted by this Board in the past and now existing in the neighborhood. 5• Therefore, by a unanimous vote, the Board GRANTS the requested SPECIAL PERMIT relief under Nantucket Zoning By-Law §139-9B(2)(a), §139-9B(2)(b) and §139-9B(2)(c) upon the following conditions: a. All work shall be performed in substantial conformity with the plans approved by the Historic District Commission in Certificate of Appropriateness No. and the site plan, as amended, presented to and endorsed by the Board of Appeals under Zoning By-Law §139-23 in connection with this Application; b. The curb cut and drive aisle width shall be reduced to 24+ feet; - c. A paved apron for the driveway entrance shall be provided up to the right-of-way line on Teasdale Circle; d. Paved aprons leading to the overhead doors from the parking aisle shall be provided; e. Applicant shall provide ten (10) parking spaces on site in conformance with the site plan, as amended, eliminating the two (2) parking spaces on the west side of Teasdale circle and shown on the original site plan submission; f. A vegetative buffer to the north and east side of the loading bay, not less than three (3) feet and not greater than eight (8) feet in height, shall be plant44494d maintained; g• The parking areas and drive aisles shall be surfaced with shell, crushed or screened stone; and h. There shall be no outside storage of goods or materials upon the Locus. 6. Pursuant to Zoning By-Law §139-23, the Board of Appeals also voted unanimously, to approve the site plan presented for approval as the Hearing, subject to the making of certain alterations to show the above conditions, all to be added prior to endorsement of the final plan, such endorsement to signify the Board's final ap~,'.LL~al thereof.
