Anderson and Jane S. Anderson, 8200 E. Thorn Drive, Wichita, Kansas 67226, Board of Appeals File No. 006-98, the Board made the following decision: 1. Applicants are seeking a SPECIAL PERMIT under Nantucket Zoning By-Law Chapter 139-33A (alternation/expansion of a pre-existing, non-conforming structure/use). Applicants propose to alter a said to be pre-existing, non-conforming storage shed by converting the use into a home-office, not for public access. Applicants further seek relief by VARIANCE pursuant to Nantucket Zoning By-Law Chapter 139-32A from the requirements of By-Law Chapter 139-16A (ground cover ratio) to construct a 65± square foot addition onto the easterly side of the structure, bringing the total ground cover of the shed to 365± square feet. The Lot contains a ground cover ratio of 38±~ (1853± square feet) and construction of the addition would increase the ground cover ratio to 40± (1918± square feet). A deck would also be added to the easterly side of the structure. In addition, and to the extent necessary, Applicants seek a SPECIAL PERMIT under Nantucket Zoning By-Law Chapter 139-18B(3) (parking requirements) to waive two (2) parking spaces should it be determined that the use is a Customary Home Occupation. Applicants currently provide two (2) off-street parking spaces. The Locus is non-conforming as to lot size with the Lot containing 4, 800± square feet in a district that requires a minimum lot size of 5,000 square feet; as to ground cover ratio with the lot containing 38±% ground cover ratio or 1853± square feet, in a district that allows a maximum of 30% ground cover ratio for undersized lots; and as to setbacks, with the principal structure, a single-family dwelling, being sited 1.5± feet at its closest point from the southerly side yard lot line and with the subject structure being sited 1± feet at its closest point from the westerly rear yard lot line and less than five (5) feet from the northerly side yard lot line at its closest point, in a district that requires a minimum of a five-foot side and rear yard setback. The premises is located at 41 ORANGE STREET, Assessor's Map 42.3.2, Parcel 224, Plan Book 60, Page 345. The property is zoned Residential-Old-Historic. 2. The decision is based upon the application and materials submitted therewith, and the testimony and evidence introduced at the hearing. There was no recommendation from the Planning Board as the Board determined that the matter was not a planning concern. There were no letters on file. 3. Applicants' attorney, Richard J. Glidden, and their architect, Nathan McMullen, presented the case for the Applicants. They explained that the Applicants wished to convert an existing storage shed in the back yard into an office for use by Mr. Anderson. Said shed violates the rear and side yard setback requirements of the By-Law, necessitating relief from the Board for this change of use. The office is not intended to be commercial in that no clients or customers will come to the office as the contemplated use is not a customary home occupation as that term is defined in the Nantucket Zoning By-Law. This office would be used by Mr. Anderson to house his computer, fax machine, phone, etc., so that he might stay in touch with his office in Kansas when he is on Nantucket on vacation. Mr. McMullen explained that the requested 65 square foot addition is necessary to make the space comfortable as an office and that the exterior renovations had been approved by the H.D.C. 4. The Board finds as follows: a. That the changes in use from storage shed to private office use as described. by Applicants' attorney is within the spirit and intent of the By-Law and will not be substantially more detrimental to the residential character of the neighborhood than the existing non- conformity; and b. Parking relief is not necessary as this proposed use is not a customary home occupation which requires said relief, and Applicants presently provide two (2) off- street parking spaces on-site; and c. There are no conditions especially affecting this lot which would justify the granting of the Variance by the Board. 5. After brief discussion, the Applicants asked to withdraw, without prejudice, their requests for: a. A special permit under Chapter 139-18B(3) to waive two (2) parking spaces; and b. A variance under Chapter 139-16A to allow the construction of a 65 square foot addition to the existing shed. Both of these withdrawal, without prejudice, requests were granted by unanimous vote of the Board. 6. Therefore, by unanimous vote, the Board GRANTS the SPECIAL PERMIT under Chapter 139-33A allowing the conversion of the existing shed into a home-office, upon the following conditions: a. There will be no public access to the office and no commercial use of said office. b. The structure shall remain one story in height. c. There shall be no plumbing in said structure. d. The existing two (2) story dwelling has ground cover of 1,853 square feet and the existing shed has ground cover of 300 square feet for a total of 2,153 square feet. The storage shed which was repaired and renovated in 1986 is located in the rear and sideline setback. Applicant wishes to convert the storage shed into his office which is an allowed use under the Zoning By-law, however, since the shed is non- conforming as to setbacks, it is necessary to obtain a special permit to allow this change of use. Applicant also wishes to renovate the shed to make it appropriate for office use. The proposed renovations would add 65 square feet of ground cover to the shed bringing the total ground cover of the shed to 365 square feet.
