DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, January
9, 1998, at 1:00 P.M., in the Conference Room in the Nantucket Town Annex Building at
37 Washington Street, Nantucket, Massachusetts, the Board made the following decision
on the application of CURTIS BARNES and JOAN BARNES, of 12 Sunset Hill Lane,
P.O. Box 192, Nantucket, Massachusetts, 02554, in BOA File No. 005-98:
2. The Applicant is requesting a SPECIAL PERMIT under Nantucket Zoning By-law
§139-33A (alteration /expansion of apre-existing non-conforming use/structure) to allow
a vertical expansion to change the roof line of a said to be pre-existing non-conforming
780+ square foot single-family dwelling/garage, that is located partially within the required
five-foot westerly side yard setback area. The new addition will not come any closer to
that lot line than the existing structure. The Locus is non-conforming as to number of
dwelling units on a lot with there being three (3) separate dwelling units when a maximum
of the two (2) units are allowed on a lot; and as to side yard setback with the subject
structure being sited at zero feet at its closest point from the westerly side yard lot line in a
district that requires a minimum side yard setback of five (5) feet.
The premises is located at 12 Sunset Hill Lane, Assessor's Map 41, Parcel 450.
The property is zoned Residential-Old-Historic.
3. Our decision is based upon the application and accompanying materials, and
testimony and evidence presented at the public hearing. There was no opposition or
support for the requested relief expressed at the public hearing and the Planning Board
found that this application did not raise any issues of planning concern. The Applicants
also produced a letter from along-time neighbor stating that the garage/apartment was
constructed in 1940's and used as a dwelling.
4. The Applicants represented to the Board that they were seeking relief to renovate
and expand the existing single-story garage/apartment structure. As to pre-existence of the
subject structure and its dwelling use, the Applicants presented original drawings of
designers and architects, dated prior to the 1972 enactment of the Zoning By-law,
showing the existence of the three (3) structures on the lot and indicating each structure
was used as separate dwelling unit. The Applicants plan to renovate the garage/apartment
by constructing a conforming addition to the structure and by reconfiguring the living
space therein. The structure will remain asingle-story, but the roof line in that portion of
the existing structure lying within the required five (5) foot westerly side yard setback area
would be raised from 12+ feet to roughly 16+ feet to match the existing primary dwelling
on the property.
5. Therefore, a majority of the Board finds that the existing garage/apartment is a
preexisting non-conforming structure and use. The Board further finds that the raising of
the roof line of that portion of the nonconforming garage/apartment lying within the five
(5) foot westerly side yard setback area will intensify setback the non-conforming nature
of the structure. In addition, the Board finds that the proposed expanded
garage/apartment will not be more detrimental to the neighborhood than the existing non-
conforming garage/apartment.
6. Accordingly, by unanimous vote, the Board'GRANTS the requested relief under
Nantucket Zoning By-law §139-33A to enable the proposed expansion and renovation of
the subject garage/apartment structure under the following conditions:
All additions and renovations shall be constructed in substantial conformance
with Historic District Commission Certificate of Appropriateness. No. 30,495.
b. The structure shall remain asingle-story and shall not come any closer to the
westerly side yard lot line than existing structure. ,

Dear Mr. Barnes;
Your application for a permit to build an addition to a dwelling located at 12
Sunset Hill Lane. (41-450) has been reviewed pursuant to §139 of the Code of
Nantucket and for the following reasons denied.
The lot is non-conforming as to the number of dwellings (three) on it and the
structure as to side yard set back (less then five feet). Because of the non-
conformities an expansion of ground cover or a vertical expansion within the
setback is only permitted after action by the Zoning Board of Appeals. A
building permit can not be issued with out a finding granted by the Zoning Board
of Appeals, see §139-33A(4) of the Code of Nantucket below:
Pre-existing, nonconforming structures or uses may be extended or altered, ...
provided that: _
"No such extension or alteration shall be permitted unless there is a finding by
the permit granting authority or uy the special permit granting authority
designated by this zoning bylaw that such change, extension or alteration shall
not be substantially more detrimental than the existing nonconforming use to the
neighborhood."
Pleased be advised that you may appeal this decision of the Building
Commissioner to the Zoning Board of Appeals pursuant to §139-31 of the Code
