At a Public Hearing of the ZONING BOARD OF APPEALS held at
1:00 P.M., Friday, January 9, 1998, in the Town and County
Building, Broad Street, Nantucket, Massachusetts, on the
Application of Glenn J. DeSimone and Virginia G. DeSimone, 507
Opnoke Ridge Road, New Canaan, CT 06840, Board of Appeals File
No. 004-98, the Board made the following decision:
1. Applicants are seeking a SPECIAL PERMIT under Nantucket
Zoning By-Law Chapter 139-33A (alteration/extension of a pre-
existing non-conforming use/structure). Applicants propose to
alter a said to be pre-existing non-conforming 1,569+/- square
foot single family dwelling by rebuilding an existing porch on.
the rear of the structure on the same footprint, not coming any
closer to the northerly or southerly side yard lot lines than the
existing deck; by adding a new second floor dormer to enable the
second floor bedroom to access the new second floor deck, located
above the renovated porch; by constructing a new 12' x 22' deck
on the rear of the structure off of the re-built porch. None of
the work will change the ground cover or setbacks of the existing
porch/dwelling. In the alternative and/or to the extent
necessary, Applicants are seeking a determination from this
Board, under Nantucket Zoning By-Law 139-33A(3)(a), that this
proposed extension/alteration does not increase the non-
conforming as to frontage, with the Lot having a frontage of
25.22+/- feet along Lincoln Avenue in a district that requires a
minimum frontage of 50 feet; and as to side yard setbacks, with
the structure/deck being site 2.56+/- feet at its closest point
from the southerly side yard lot line in a district that requires
a minimum side yard setback of five (5) feet.
The premises is located a 1 LINCOLN AVENUE, Assessor's Map
30, Parcel 141, Plan Book 1, Page 54, Lot C. The property is
zoned Residential-1.
2. The decision is based upon the application and materials
submitted therewith, and the testimony and evidence introduced at
the hearing. There was no recommendation from the Planning Board
as the Board determined that'the matter was not a planning
concern. There were no letters on file.
3. Applicant's attorney presented the case for the Applicant.
He presented the Board with photographs showing the existing
house and then showed the Board the approved HDC plans detailing
the look of the house with the completed renovations. He
explained that the Applicants intended to re-build an existing
porch on the rear of the house in the same footprint as the old
porch. The porch roof would be flat allowing access from the
second floor bedroom to the new deck above the porch. Applicants
intend to add a dormer to this second floor bedroom to make room
for a door providing access to this second floor porch/deck.
None of this proposed work will change the ground cover or
setbacks of the existing structure.
4. Therefore the Board finds that the proposed alteration of
the existing residential structure, by rebuilding the porch with
a deck above, and adding a second floor dormer, will not be
substantially more detrimental to the neighborhood than the
existing, non-conforming structure and that the expansion falls
within the spirit and intent of the By-Law.
5. Accordingly, by a unanimous vote, the Board GRANTS the
requested Special Permit under Zoning By-Law 139-33Rupon the
condition that the work be done in substantial accordance with
Certificate of Appropriatenes No. 31,117 issued by the F?~ storic

GLENN J. and VIRGINIA DeSIMONE
Applicants' lot contains 10,846 square feet in an R-I
district, so it is conforming as to lot area. The lot has 25.22
feet of frontage in a district requiring 50 feet of frontage, so it
is a pre-existing, non-conforming lot. The ground coverage of the
existing structure is 1,569 square feet, and the allowable ground
cover is in excess of 3,000 square feet. Portions of the existing
building intrude into the side-line setbacks. Applicants wish to
alter this pre-existing, non-conforming structure on the pre-
existing, non-conforming lot in the following manner:
a. Rebuild the existing porch on the rear of the house
maintaining the existing footprint. Add a new second
floor dormer so that the bedroom upstairs can have a door
onto the new deck built on top of the renovated porch.
None of this work will change the ground cover or
setbacks of the existing structure.
b. Build a new deck 12 feet long and 22 feet wide off the
newly built rear porch. While decks are considered
structures for purposes of setback, they are not counted
as ground cover, therefore, there is no increase in
ground cover.
In the alternative, Applicant seeks a determination pursuant
to Chapter 139, Section 33A(3)(a) that this proposed extension/
alteration does not increase the non-conforming nature of the
existing dwelling.
