I, NANTUCKET ZONING BOARD OF APPEALS 37 Washington Street Nantucket, Massachusetts 02554 16 Irving Street Land Court Plan 42062-A; Plan File 45-W, Lot 1 Certificate of Title No, 17054; Deed Book 462, Page 221 Limited Use General-2 Assessor's Map 79, Parcels 159 and 161 DECISION: 1, At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, January 9, 1998, at 1:00 P.M., in the Conference Room, Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, the Board made the following decision on the application of PORTER C. JARRELL and EDWINA M. JARRELL, c/o Reade & Alger Professional Corporation, Post Office Box 2669, Nantucket, Massachusetts 02584, File No. 003-98: 2. The applicants are seeking a SPECIAL PERMIT under Nantucket Zoning By-law ~139-33.A(8), in order to change the boundaries of a 10,OOOI square-foot vacant lot, said to pre-exist the adoption of the Nantucket Zoning By-law as a nonconforming lot in separate ownership from all adjacent land, by merging it with an adjacent 20,OOOI square-foot lot purchased by the applicants in 1994. As merged, the combined lots (the "Locus") contain 30,000I square feet of lot area but are still nonconforming, having less than the minimum lot area of 80,000 square feet required in this district. The Locus is situated at 16 IRVING STREET, SURFSIDE, Assessor's Map 79, Parcels 159 and 161, and consists of the registered land shown upon Land Court Plan 42062-A and the unregistered land shown upon plan recorded with Nantucket Deeds in Plan File 45-W as Lot 1. The Locus is situated in a Limited Use General-2 zoning district. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. There was no Planning Board recommendation. There was no support nor opposition presented in person or by communication at the public hearing. 4. Based upon the materials and representations made by the applicants' representative at the public hearing, the applicants owned a vacant lot containing 10,000 square feet which pre- existed the 1972 adoption of the Nantucket Zoning By-law, in separate ownership from all surrounding land. In 1992, the applicants and their neighbors joined to acquire an adj acent building lot which had come upon the market, in order to annex portions thereof to their own lots and to prevent this lot from being built upon as a separate lot. Title to this lot was taken by the applicants and the neighbors, as tenants in common. Thereafter, the applicants and the neighbors had a plan prepared by a surveyor and endorsed by the Nantucket Planning Board, ~ showing the separation of this lot into three parcels, one to be conveyed to each of the neighboring lots. In 1994, the applicants secured the conveyance to them of the portion of that lot which was shown as Lot 1 on that plan, which was recorded with Nantucket Deeds in Plan File 45-W. The plan contained the legend: "Lot 1 shown hereon is unbuildable due to insufficient area and is to be conveyed to and combined with property of Porter C. and Edwina M. Jarrell, Tax Map 79, Parcel 159." The applicants now wish to establish the buildability status of the merged parcels comprising the Locus, as a single lot, and accordingly have brought the present application for a special permit under By-law ~139-33.A(8), to approve the change in dimensions of their original lot (being the land shown upon Land Court Plan 42062-A) by adding thereto the land shown as Lot 1 on plan recorded in Plan File 45-W. 5. The Board of Appeals found that the change in boundaries of the applicants' land as described above will not be substantially more detrimental to the neighborhood than the previously existing nonconformity; indeed, the applicants and their neighbors, by acquiring , dividing and merging with their existing lots the previously-existing undersized separate building lot which has been divided as shown upon Plan File 45-W, have achieved a benefit for the neighborhood. The change in boundaries of the applicants' original lot does not create any new nonconformity nor increase any existing nonconformity. Accordingly, by UNANIMOUS vote, the Board of Appeals granted the requested SPECIAL PERMIT, approving the merger of the two parcels which comprise the Locus as a sin uilding lot. ~ar(iw _ . Linda F.
