At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, January 9, 1998, at 1:00 P.M., in the Conference Room, Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, the Board made the following decision on the application of WAYNE H. DUPONT and PATRICIA C. DUPONT (originally filed in the names of Robert J. O'Brien, Trustee of Chester Trust, as owner, and Wayne H. Dupont and Patricia C. Dupont, contract purchasers, as applicants), c/o Reade & Alger Professional Corporation, Post Office Box 2669, Nantucket, Massachusetts 02584, File No. 002-98: 2. The applicants (Duponts) are seeking a MODIFICATION of a SPECIAL PERMIT granted by the Board of Appeals as set forth in the decision in File No. 015-78, as amended in the decision in File No. 039-84. The applicants request that this Board remove the restriction in the decision in Case No. 015-78 which mandates the use of Lot B for parking and prohibits the placement of improvements upon Lot B without further relief by the Board of Appeals. The subject property (the "Locus") consists of two merged parcels of land, improved with a pre-existing nonconforming five-unit apartment building. The applicants propose to demolish the existing apartment building and construct a primary and a secondary dwelling upon the Locus, with the secondary dwelling to be sited upon Lot B. All required parking will be provided on-site and the new structures will conform with all dimensional requirements. The Locus is nonconforming as to frontage. The Locus is situated at 6 KITE HILL LANE (also known as 23R West Chester Street), Assessor's Map 42.4.4, Parcels 30 and 66, and consists of the registered land shown on Land Court Plan 15206-B as Lot B and the unregistered land shown on plan recorded with Nantucket Deeds in Plan Book 18, Page 56, as Lot 4A. The Locus is zones Residential-Old Historic. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. The Planning Board recommendation was favorable. There were concerns and questions, but no opposition presented at the public hearing; one abutter spoke in favor. 4. The Locus, improved with a pre-existing nonconforming five-unit apartment house as modified pursuant to the decisions of the Board of Appeals in Cases Nos. 015-78 and 039-84, has been dependent for its continued nonconforming use upon the conditions set forth in those decisions. Specifically, the decisions require that the portion of the Locus shown as Lot B on Land Court Plan 15206-B be used for parking only and not used for the construction of improvements without permission of the Board of Appeals. The proposed changes to be made by the applicants will replace the pre-existing nonconforming use with a conforming use. with two dwellings, complying with dimensional and parking requirements of the zoning by-law. The only remaining nonconformity will be the lot's lack of frontage, a pre-existing condition which the applicants cannot cure since they own no adjoining land. Accordingly, the reason for the conditions set forth in the above-cited prior decision of the Board of Appeals no longer exists. 5. Therefore, subject to the conditions set forth below, the Board of Appeals voted UNANIMOUSLY to modify the decisions in Cases Nos. 015-78 and 039-84, by relieving the Locus from the conditions that Lot B be used for parking only and not used for the construction of improvements without permission of the Board of Appeals. 6. The modification herein set forth is upon the following conditions: (a) Lot B shall not be conveyed separately from Lot 4A, and these two parcels shall be considered and used together as a single building lot under the Nantucket Zoning By-law. (b) As agreed by the applicants at the public hearing, no exterior construction work shall take place upon the Locus except during the hours of 7:00 A.M. to 7:00 P.M., Monday through Saturday, and no exterior construction work shall take place at any time between June 30 and September 15 of any year. Present were members Holmes, Hyde, and Bartsch. In the matter of the petition of Lauren Place (015-78): The chairman reported on his inspection of the premises, and kir. Hyde also reported on his viewing. After a review of the record and information presented at the time of the hearing, the Board found: The proposed improvement is an expansion of an existing apartment within a structure used as and for apartments with four apartments now in the structure. The expansion of the apartment on the top floor can be ac- complished with design and structural changes that have been ap- proved by the Historic District Commission. The use of the apartment on the top floor as owner-occupied quarters will afford the owner additional on-site control of the premises and tenants uses of the premises. The adjacent property, Lot B, will be restricted for use as and for parking for the tenants of the structure and will be re- stricted against further improvement of any kind without the specific approval of the Board of Appeals. No harm or diminution of value to neighboring areas will re- sult from the expansion. The area is largely made up of rooming houses and is in a location that is essentially isolated from other improvements. On motion of I14r. Hyde, seconded by Mrs. Bartsch, it was un- animously voted to grant the petition of Lauren Place subject to the following restrictions and conditions: That Lot B as shown on Plan No. 15206-B filed with the Nan- tucket Registry District of the Land Court with Certificate of Ti- tle No. 2419 be restricted against any structural improvement and be reserved for the use of tenants of the premises as and for their parking and that the top floor be used exclusively for the owner's occupancy and not as rental income property. MASSACHUSETTS 02554 DECISIOIQ: At a Public Hearing of the BOARD OF APPEALS held on Friday, Hay 4, 1984, at 1:30 p.m. in the Town and County Building, Federal and Broad Streets, Nantucket, in the matter of the Application of LAUREN R. YOUNG (formerly Lauren R. Place) (039-84), the BOARD finds: 1. This is an Application for MODIFICATION of a SPECIAL PERMIT under SECTION 7(F) of the Zoning By-Law issued in File No. 015-78, by vote dated July 8, 1978, recorded with Nantucket Deeds in Book 165, Page 46, and as Land Court Document No. 19682. If granted, the existing SPECIAL PERMIT would be modified by eliminating the condition that the top floor of the building be used exclusively for the owner's occupancy and not as rental income property. The premises are located at 23R West Chester Street/6 Kite Hill Lane, and are zoned RESZDENTIAL- OLD HISTORIC. 2. The Applicant at present operates the premises as an apartment house con- taining five units, four on the main floor and one on the top floor. Under the existing SPEC2AI. The Applicant has married since the granting of the existing SPECIAL PERMIT and as a result she no longer resides in the top floor apartment.
