At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, January 9, 1998, at 1:00 P.M., in the Conference Room in the Nantucket Town Annex Building at 37 Washington Street, Nantucket, Massachusetts, the Board made the following decision on the application of TIMOTHY D. HALL, of 5 Cornwall Street, P.O. Box 482, Siasconset, Massachusetts, 02564, in BOA File No. 001-98: 2. The Applicant is seeking relief by VARIANCE pursuant to Nantucket Zoning By- law §139-32A from the requirements of Nantucket Zoning By-law §139-16A (Intensity Regulations -ground cover ratio). Applicant proposes to construct a 768+ square foot garage/apartment. The existing single-family dwelling on the Locus has a ground cover of 990± square feet and the construction of the proposed garage/apartment structure would bring the total ground cover on the Locus to 1758± square feet or 258± square feet more than the allowable maximum ground cover of 1500 square feet for this undersized lot of record, which contains 22,000+ square feet in a district requiring a minimum lot size of 120,000 square feet. The premises is located at 5 CORWALL STREET, Assessor's Map 71.3.1, Parcels 40-46 inclusive and Parce160, Land Court Plan 5004-G Block 31, Lots 8-11 inclusive and 81-87 inclusive, in Block 31. The property is zoned Limited Use General 3. 3. Our decision is based upon the application and accompanying materials, and testimony and evidence presented at the public hearing. The Planning Board recommended that the requested variance relief be denied on the basis that applicant has no legitimate claim of hardship and that such relief would set a dangerous precedent for other undersized lots. Beyond the testimony of the applicant and his representative, no further oral or written testimony was presented at the public hearing. 4. The Applicant represented to the Board that he is seeking relief to construct a garage/apartment structure with a 23± foot ridge height that would have less of an impact on the surrounding landscape than a struture standing the allowable 30 feet at the ridge. The Applicant previously obtained Special Permit Relief under ~ 139-33A(8) of the By-law in BOA File No. 045-97 to add a 14,000+ square foot parcel to his then existing 8,000± square foot parcel of record to create the current 22,000+ square foot Locus. ~. 5. The Board finds that the Applicant failed to demonstrate that compliance with the maximum 1500 square foot ground cover limitation would cause him substantial hardship. The Applicant can construct agarage/apartment with a ground cover of up to 510±. The Board further finds no unique circumstances relating to soil condition, shape or topography of the Locus that could justify variance relief from the ground cover limitations. Therefore, upon a motion made and seconded to grant the relief as requested, there were no members voting in favor and five (5) members (Waine, Hourihan, O'Mara, Williams, and Toole) voting in the negative. The existing dwelling is on a Lot acquired by the Applicant in 1990 with 8,000 square feet which did not conform to zoning. The Applicant acquired a parcel of adjoining vacant land in 1997 with 14,000 square feet. The combined property now owned by the Applicant is more conforming than the single Lot previously owned by the Applicant, but it still does not conform to current zoning requirement of minimum lot size of 120,000 square feet. Applicants propose to construct a garage apartment with 768 square feet of ground cover. The Applicant acquired a parcel of adjoining vacant land in 1997 with 14,000 square feet.
