In the alternative, the Applicants are seeking relief by VARIANCE under Nantucket Zoning Bylaw §139-16A (Intensity Regulations - ground cover) in order to allow the construction and use of a primary dwelling, secondary dwelling and garage on the Premises with an aggregate ground cover of 4,512+ square feet (4.58%+) in a district that will allow a maximum ground cover ratio of 3% as of January 1, 2000 when the existing allowable ground cover ratio of 790, which was frozen as of the 1995 Annual Town Meeting until the aforementioned date expires. Due to the Building Cap restrictions of Bylaw §139-24C(2)(c)[1], Applicants are unable to obtain building permits to complete the project as proposed prior to January 1, 2000. The Property has an area of 98,423± square feet, includes an existing house and garage, and is located in the LUG-3 Zoning District. The Property is, however, subject to LUG-1 Intensity Regulations until January 1, 2000 pursuant to Section 139-16 of the By-Law.' Lot 2 was created on November 7, 19990 when the Nantucket Planning Board endorsed the 39-J Plan "ANR" ; the Plan was recorded at the Nantucket Registry of Deeds on November 15, 1999. The Property has the benefit of LUG-1 intensity regulations until January 1, 2000. On or about February, 1999, the Applicants retained the services of Designer Gwynne Thorsen to prepare house plans and to obtain a building permit for a secondary dwelling on the Property. Because the Property includes wetland resource areas, the Applicants filed a Notice of Intent with the Nantucket Conservation Commission on July 9, 1999 for approval to construct a secondary dwelling. After a number of public hearings, the Conservation Commission issued an Order of Conditions approving the secondary dwelling on September 16, 1999. The Nantucket By-Law, Section 139-26C(3), •requires that the Order of Conditions be filed with the Building Permit Application. On July 29, 1999, the Applicants received approval for their proposed secondary dwelling from the Nantucket Planning Board pursuant to Section 139-7A2(g) of the By-Law. The Nantucket By-Law requires that a secondary dwelling approval be filed with the secondary dwelling building permit application. No appeal was taken from the Nantucket Conservation Commission Order of Conditions for the Property and relevant appeal periods expired on October 7, 1999. On October 20, 1999, the Applicants filed a Secondary Dwelling Building Permit Application with the Nantucket Building Department. This building permit application:~~as complete and complied with the provisions of Section 139-26(b) and (c) of the By-La~v, The Nantucket Building Commission denied the issuance of a secondary dwelling building permit on October 1999. The basis for this denial is that 144 new dwelling building permits had been issued in 1999 and this was the maximum number of new dwelling building permits available pursuant to the "Interim Growth Rate Limit" set forth in Section 139-24C(2)(c)[1] of the By-Law. lArticle 20 of the 1990 Special Town Ivfeeting changed the area where the Property is located to a LUG- 3 zoning classification with the following amendment: "Provided, however, that all lots in this District in existence as of November 1~, 1990 shall have the benefit .pf LUG-1 intensity regulations. Subsequently, the amended was rescinded effective January 1, 2000. The existing house and garage on the Kaytes Property have an aggregate g~rou ro osed cover of approximately 2,163 square feet (2.2%). The renovated rima dwellin , p p secondary dwelling, and proposed garage will have an aggregate ground cover of approximately 4,512± square feet (4.6%). Currently, the maximum ground cover allowed in this Zoning district is 7%. As of January 1, 2000, however, the maximum allowable ground cover for the Property will be 3 % (a ound coverr b f eapp o ~imatelpPl, 5601± sq>°ares feet. structures will excess the allowable b Y The Applicants submitted a complete secondary dwelling application to the Nantucket Building Department pursuant to Section 139-26 of the By-Law and but for the application of the Nantucket Interim Growth Rate for new dwelling building permits, as interpreted and applied by the Nantucket Building Inspector, the Applicants would have obtained their secondary dwelling building permit prior to January 1, 2000. The Building Inspector's denial of the secondary dwelling permit, in these circumstances and applied to the facts in this case, will effectively prohibit and prevent the Applicants from constructing and using the proposed secondary dwelling on their Property. The Building Inspector's denial of the Applicant's secondary dwelling building permit, in these circumstances, is, therefore, arbitrary, capricious and unreasonable, has caused the Applicants significant damages, and deprives the Applicants of the reasonable use and enjoyment of their Property. The Applicants ask this Board to overturn the decision of the Nantucket BuildinP Inspector which denieP lican drior dwelling perniit and to order that a secondary dwelling ermit be used to the A p P to January 1, 2000. In the alternative, the Applicants request a Variance from the provisions of Section 139-16 of the By-Law to permit the renovation and use of an existing primary dwelling, and the construction and use of a proposed secondary dwelling; and proposed garage, all of which structures have an aggregate ground cover of 4,512 square feet. Although currentl}~ an aggregate ground cover of 6,889± square feet (7%) is permitted for the Property, this figure will be reduced by operation of law o nJNleetinalandOSe lion%139 16 of theq NantuckepZoning to Article 51 of the 199 Annual To By-Law. The particular soil conditions and topography of the Property are unique and do not affect generally other land in the LUG-3 Zoning District. A literal enforcement of the::l/UG-3 intensity regulations limiting the ground cover ratio of the Property to 3% will cause the Applicants significant financial hardship and will deprive them of the reasonable use endthe enjoyment of their Property. Moreover, granting this Variance to the Applicants, g distinctive facts in this matter, will not undermine the public good nor nullify the intent and purpose of the Zoning By-Law. Specifically, there are significant wetlands on the Property which require careful siting of the septic system, well, and structures. The Property is subject to the jurisdiction of Nantucket Conservation Commission under the M~Sere resuired toloba`rinaoNan~ ckett and the Nantucket `Vetlands By-Law. The Applicants q Conservation Commission Order of Conditions for the Project prior to applying for the secondary dwelling building permit, which took a significant amount of time and was contested by neighbors. This delay prevented the Applicants from filing for a secondary dwelling building permit earlier in 1999, as they intended. The Applicants have filed a complete application for a secondary dwelling building permit with the Nantucket Building Department and are unable to obtain this permit in 1999 solely because the allotted number of new dwelling building permits for 1999 have already been issued. This delay will cause the Applicants to suffer a significant financial hardship and deprive them of the reasonable use and enjoyment of their Property. Moreover, the facts in this case are unique and a grant of Variance Relief by this Board will not set an adverse precedent nor undermine the intent and purpose of the Zoning By-Law. Due to the cap for 1999 building permits have all been assigned and issued, total 144 units. The 2000-year cap issue is 120 and will start on January 1, 2000. So far 34 units are in line for this issue. You may appeal this denial to the Zoning Board of Appeals for an extension of the zoning change on ground cover taking place on January 1, 2000. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory measures, shall be deemed cause to revoke or modify this Order. 2. This Order does not grant any property rights or any exclusive privileges; it does not authorize any injury to private property or invasion of private rights. 3. This Order does not relieve the permittee or any person of the necessity of complying with all other applicable federal, state or local statutes, ordinances, by-laws or regulations. 4. The work authorized hereunder shall be completed within three years from the date of this Order unless either of the following apply: (a) the work is a mainenance dredging project as provided for in the Act; or (b) the time for completion has been extended to a specific date more than three years, but less than five years, from the date of issuance and both that date and the special circumstances warranting the extended time period are set forth in this Order. 5. This Order may be extended by the issuing authority for no more than two periods of one year each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. 6. The aggregate ground cover ratio of the existing and proposed buildings on Mr. and Mrs. Kaytes' property exceeds the maximum LUG-3 ground cover ratio of three (3%) percent. My clients' ground cover ratio is, however, less than the maximum LUG-1 ground cover ratio of seven (7%) percent and but for the new dwelling building permit cap, Mr. and Mrs. Kaytes would be issued a new secondary dwelling building permit this year. In these circumstances, my clients ask the Board of Appeals to overturn the denial of the secondary dwelling building permit by the Building Department and issue them a building permit in 1999 or, alternatively, grant them Variance relief to exceed the three (3%) percent maximum ground cover ratio ~~~hich applies to the property after January 1, 2000 so that they may obtain a building permit for their secondary dwelling next year. The Property has an area of 98,423 ± square feet, includes an existing house and garage, and is located in the LUG-3 Zoning District. The Property is, however, subject to LUG-1 Intensity Regulations until January 1, 2000 pursuant to Section 139-16 of the By-Law.l Lot 2 was created on November 7, 19990 when the Nantucket Planning Board endorsed the 39-J Plan "ANR" ; the Plan was recorded at the Nantucket Registry of Deeds on November 15, 1999. The Property has the benefit of LUG-1 intensity .regulations until January 1, 2000. On or about February, 1999, the Applicants retained the services of Designer Gwynne Thorsen to prepare house plans and to obtain a building permit for a secondary dwelling on the Property. Because the Property includes wetland resource areas, the Applicants filed a Notice of Intent with the Nantucket Conservation Commission on July 9, 1999 for approval to construct a secondary dwelling. After a number of public hearings, the Conservation Commission issued an Order of Conditions approving the secondary dwelling on September 16, 1999. The Nantucket By-Law, Section 139-26C(3), requires that the Order of Conditions be filed with the Building Permit Application. On July 29, 1999, the Applicants received approval for their proposed secondary dwelling from the Nantucket Planning Board pursuant to Section 139-7A2(g) of the By-La~v. The Nantucket By-Law requires that a secondary dwelling approval be filed with the secondary dwelling building permit application. No appeal was taken from the Nantucket Conservation Commission Order of Conditions for the Property and relevant appeal periods expired on October 7, 1999. On October 20, 1999, the Applicants filed a Secondary Dwelling Building Permit Application with the Nantucket Building Department. This building permit application?,vas complete and complied with the provisions of Section 139-26(b) and (c) of the By-Law. The Nantucket Building Commission denied the issuance of a secondary dwelling building permit on October 1999. The basis for this denial is that 144 new dwelling building permits had been issued in 1999 and this was the maximum number of new dwelling building permits available pursuant to the "Interim Growth Rate Limit" set forth in Section 139-24C(2)(c)[lJ of the By-Law. 'Article 20 of the 1990 Special Town Meeting changed the area where the Property is located to a LUG- 3 zoning classification with the following amendment: "Provided, however, that all lots in this District in existence as of November 15, 1990 shall have the benefit of LUG-1 intensity regulations. Subsequently, the amended was rescinded effective January 1, 2000. The existing house and garage on the Kaytes Property have an aggregate ground cover of approximately 2,163 square feet (2.2%). The renovated primary dwelling, proposed secondary dwelling, and proposed garage will have an aggregate ground cover of approximately 4,512± square feet (4.6%). Currently, the maximum ground cover allowed in this Zoning district is 7%. As of January 1, 2000, however, the maximum allowable ground cover for the Property will be 3% (2,952± square feet) and the Applicant's proposed structures will excess the allowable ground cover by approximately 1,560± square feet. The Applicants submitted a complete secondary dwelling application to the Nantucket Building Department pursuant to Section 139-26 of the By-Law and but for the application of the Nantucket Interim Growth Rate for new dwelling building permits, as interpreted and applied by the Nantucket Building Inspector, the Applicants would have obtained their secondary dwelling building permit prior to January 1, 2000. The Building Inspector's denial of the secondary dwelling permit, in these circumstances and applied to the facts in this case, will effectively prohibit and prevent the Applicants from constructing and using the proposed secondary dwelling on their Property. The Building Inspector's denial of the Applicant's secondary dwelling building permit, in these circumstances, is, therefore, arbitrary, capricious and unreasonable, has caused the Applicants significant damages, and deprives the Applicants of the reasonable use and enjoyment of their Property. The Applicants ask this Board to overturn the decision of the Nantucket Building Inspector which denied a secondary dwelling perniit and to order that a secondary dwelling permit be used to the Applicants prior to January 1, 2000. In the alternative, the Applicants request a Variance from the provisions of Section 139-16 of the By-Law to permit the renovation and use of an existing primary dwelling, and the construction and use of a proposed secondary dwelling; and proposed garage, all of which structures have an aggregate ground cover of 4,512 square feet. Although currently an aggregate ground cover of 6,889± square feet (7%) is permitted for the Property, this figure will be reduced by operation of law on January 1, 2000 to 3% (2,952± square feet) pursuant to Article 51 of the 1995 Annual Town Meeting and Section 139-16 of the Nantucket Zoning By-Law. The particular soil conditions and topography of the Property are unique and do not affect generally other land in the LUG-3 Zoning District. A literal enforcement of the-:I.UG-3 intensity regulations limiting the ground cover ratio of the Property to 3 % will cause the Applicants significant financial hardship and will deprive them of the reasonable use and enjoyment of their Property. Moreover, granting this Variance to the Applicants, given the distinctive facts in this matter, will not undermine the public good nor nullify the intent and purpose of the Zoning By-Law. Specifically, there are significant wetlands on the Property which require careful siting of the septic system, well, and structures. The Property is subject to the jurisdiction of Nantucket Conservation Commission under the Massachusetts Wetlands Protection Act and the Nantucket Wetlands By-Law. The Applicants were required to obtain a Nantucket Conservation Commission Order of Conditions for the Project prior to applying for the secondary dwelling building permit, which took a significant amount of time and was contested by neighbors. This delay prevented the Applicants from filing for a secondary dwelling building permit earlier in 1999, as they intended. The Applicants have filed a complete application for a secondary dwelling building permit with the Nantucket Building Department and are unable to obtain this permit in 1999 solely because the allotted number of new dwelling building permits for 1999 have already been issued. This delay will cause the Applicants to suffer a significant financial hardship and deprive them of the reasonable use and enjoyment of their Property. Moreover, the facts in this case are unique and a grant of Variance Relief by this Board will not set an adverse precedent nor undermine the intent and purpose of the Zoning By-Law. Therefore, the Nantucket Conservation Commision hereby finds tPS'at he o lowing condi ions are necessary, in accordance with the Performance Standards set forth in the regulations, to protect those interests checked above. The Commission orders that all work shall be performed in accordance with said conditions and with the Notice of Intent referenced above. To the extent that the following conditions modify or differ from the plans, specifications or other proposals submitted with the Notice of Intent, the conditions shall control. General Conditions 1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory measures, shall be deemed cause to revoke or modify this Order. 2. This Order does not grant any property rights or any exclusive privileges; it does not authorize any injury to private property or invasion of private rights. 3. This Order does not relieve the permittee or any person of the necessity of complying with all other applicable federal, state or local statutes, ordinances, by-laws or regulations. The work authorized hereunder shall be completed within three years from the date of this Order unless either of the following apply: (a) the work is a mainenance dredging project as provided for in the Act; or (b) the time for completion has been extended to a specific date more than three years, but less than five years, from the date of issuance and both that date and the special circumstances warranting the extended time period are set forth in this Order. 5. This Order may be extended by the issuing authority for no more than two periods of one year each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. Any fill used in connection with this project shall be clean fill, containing no trash, refuse, rubbish or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles or parts of any of the foregoing. 7. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or, if such an appeal has been filed, until all proceedings before the Department have been completed. No work shall be undertaken until the Final Order has been recorded in the Registry of deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. In the case of registered land, the Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which the proposed work is to be done. The recording information shall be submitted to the Commission of the form at the end of this Order prior to commencement of the work. 9. Similarly, all water drained from the pool «-ill be transported offsite for proper disposal at an appro~•ed upland site. The pool shall not be chlorinated «-ithin t~~o «-eeks of emptying. 20. All proposed strictures partiall~• or ~~-holh~ u-ithin the buffer zone ~~-ill be constricted «•ith gutters and do«-nspouts directed to dn~~'ells in order to maximize groundwater recharge and minimize potential erosion impacts. 21. Screening for the pool shall include fencing abo~•e finished decking to a minimum height of 6 feet. All lighting ~~~ill be directed to surfaces inside of the fencing and limited to pathway access~~~ays outside of the pool decking/fencing areas. During periods of extended nonuse, the pool surface shall be co~•ered. These measures are required to minimize disturbance to wildlife and «ildlife habitat. 22. The drinking eater supple «ell is located outside of the 100 foot buffer. 23. All roof nmoff from residential strictures, garage, and other impen•ious strictures shall be directed to dr<~~ells in order to maximize ground~~•ater recharge. 2~4.
