RONDEAU, TRUSTEE OF CHARTER TEN NOMINEE TRUST, of 38
Stratham, NH 03885, Board of Appeals File No. 117-99,
following Decision:
1. Applicant is seeking relief by SPECIAL PERMIT under Nantucket
Zoning Bylaw §139-33E(2)(a) as amended at the 1999 Annual Town Meeting,
to increase the existing nonconforming ground cover ratio from 27.5%+ to
31.3%± in a district that allows a maximum ground cover ratio of 30% for
undersized lots in this district. Applicant proposes to construct a 128+
square-foot addition onto the rear of a said to be pre-existing
single-family dwelling without encroaching into the required five-foot
rear yard setback area. The Locus is nonconforming as to lot size with
the Lot containing 3,378+ square feet of area in a district that
requires a minimum lot size of 5,000 square feet.
The Premises is located at 10 CHARTER STREET, Assessor's Map
42.3.2, Parcel 119, Plan Book 22, Page 62. The property is zoned
Residential-Old-Historic.
2. The Decision is based upon the Application and the materials
submitted with it and the testimony and evidence presented at the
hearing. The Planning Board made no recommendation as the matter was not
of planning concern. There were no letters on file and no opposition was
expressed at the hearing.
3. Applicant proposes to construct a new 26' high addition onto the
rear of an existing single-family dwelling that would encompass a
portion of an existing deck to expand the first and second floor living
space. The 128+ square-foot addition would be sited outside of the
required five-foot rear yard setback area. Applicant further represents
that the addition would have little impact upon the neighborhood as it
is on the rear of the house and of small size. The existing parking
space would be maintained.
4. Therefore, the Board finds that the proposed addition would
increase the nonconforming ground cover ratio beyond the maximum allowed
under the Bylaw of 30%. However, said increase would not be
substantially more detrimental to the neighborhood than the existing
nonconformity. Relief could be granted by Special Permit to increase the
ground cover ratio above 30% provided it not exceed the maximum allowed
under the Bylaw for this district of 50%.
5. Accordingly, by a unanimous vote, the Board GRANTS the requested
SPECIAL PERMIT under Nantucket Zoning Bylaw §139-33E(2)(a) to allow
construction of a 128+ square-foot addition onto the rear of the
single-family dwelling, increasing the ground cover ratio from 27.5%± to
31.3%± under the following conditions:
a. The 128+ square-foot addition shall be constructed in
substantial conformance with Certificate of Appropriateness No. 34,858
issued by the Historic District Commission, as may be amended; and
b. The addition shall be constructed in substantial conformance
with that shown on a site plan done by Charles W. Hart & Associates,
Inc., dated November 10, 1994, marked as Exhibit A and attached hereto.
