Box 965, Nantucket, MA 02554, Board of Appeals File No. 116-99, the Board made the following Decision: 1. Applicant is seeking relief by VARIANCE under Nantucket Zoning Bylaw §139-16A (Intensity Regulations - ground cover ratio). Applicant is asking the Board to validate the ground cover ratio of 4.3%± in a district that allows a maximum ground cover of 4/. The excessive ground cover ratio occurred with the construction of a garage/studio structure that now exceeds the allowable ground cover by 125+ square feet. Applicant also proposes to convert the structure into a secondary dwelling. All other dimensional zoning requirements are and will continue to be met. The Premises is located at 21 FOLGER AVENUE, Assessor's Map 80, Parcel 42, Plan Book 17, Page 50, Lot 1. The property is zoned Limited-Use-General-2. 2. The Decision is based upon the Application and materials submitted with it and the testimony and evidence presented at the hearing. The Planning Board made no recommendation as the matter was not of planning concern. There were two (2) letters in support on file and no opposition was expressed at the hearing. 3. Applicant represented that the garage/studio structure was built according to plans that had been drawn up by her late husband and approved by the Historic District Commission in Certificate of Appropriateness No. 30,826 after his death. The error in ground cover calculations occurred when she misinterpreted a rear el on the structure to be en enclosed area to be used eventually as interior space, when in actuality it was to be an open area which would not have counted as ground cover. Applicant stated that she needs to convert the structure into a second dwelling as she had children moving home in need of a place to live. The rear el would be used as part of the kitchen area for the small dwelling unit. The structure would meet the 12-foot minimum distance required between the primary and secondary dwellings and the required parking would be provided. Applicant added that it would be a great personal hardship for her to reduce the ground cover to meet the maximum ground cover ratio allowed in the LUG-2 district of 4%. The Locus is situated in a heavily wooded area and accessed by a dirt road that had minimal traffic and would have no impact upon the neighborhood. 4. Therefore, the Board finds that owning to circumstances relating to the topography of the structures and especially affecting such structures but not affecting generally the zoning district in which it is located a literal enforcement of the provisions of this Zoning Bylaw would involve substantial hardship, financial or otherwise, to the Applicant. The Board further finds that the excessive ground cover ratio is de minimus and has little impact upon the neighborhood and requiring removal of a portion of the structure would provide no benefit to the area; and the desirable relief may be granted without nullifying or substantially derogating from the intent or purpose of the Bylaw. The Board notes that several lots in the immediate area have two (2) dwelling units sited on them. 5. Accordingly, by a vote of four (4) in favor (Waine, Parent, Sanford and Murphy), and one (1) opposed (Toole), the Board GRANTS the requested relief by VARIANCE under Nantucket Zoning Bylaw §139-16A to validate the existing structures with a maximum ground cover ratio of 4.3/+ or (1864+ square feet) as shown upon the site plan done by Richard K. Earle of Nantucket Surveyors, Inc., dated September 25, 1997 and revised October 20, 1999, marked as Exhibit A and attached hereto, and allows conversion of said garage/studio structure to use as a secondary dwelling.
