Souza and the estate of Rom' LaPorhe, raze of Vaughan, Dale and Hunter, PC, P.O. Box 654, Nantucket, 1Vlassachusetts 02554, in connection with property situated at 28 Sesachacha Road (BOA File No. 115-99), the Board made the following Decision: 2. Applicant (Perry) is seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw section 139-33A(5) (alteration/expansioze of apre-existing nonconforming use/structure) or in the alternative, to the extent necessary, relief by VARIANCE under Nantucket Zoning Bylaw section 139-16A to complete the project as requested. Applicant proposes to demolish and reconstruct asingle-family dwelling on a 5,011± square-foot lot which would also entail extending the nonconforming side yard setback distance along the westerly lot line without coming any closer to that lot line than the existing structure. The total ground cover would not exceed the 1,500 square feet allowed under the Bylaw #or undersized lots in this district and the structure would meet the front, reaz and easterly side yard requirements. The Locus is nonconforming as to lot size with the Lot containing 5,019± square feet of area in a district that requires a minimum lot size of 20,000 square feet; as to side and rear yard setbacks with the dwelling being sited 5.8± feet at its closest point from the westerly side lot line, with an existing gazage being sited at zero feet from the easterly side lot line; and as to frontage with the Lot containing 50.36± feet of frontage along Sesachacha Road in a district that requires a minimum frontage of 75 feet. = - The Premises is Located at 28 Sesachacha Road, Assessor s Map 21, Parcel 79, (title reference is deed recorded in Book 106, Page 192). The property is zoned Residential-2. 2. The $oard's findings are based upon the Application papers and the representations and testimony received at the hearing on December 10. The Planning Board made a favorable recommendation on the grant of variance relief provided Applicant rnet the criteria for variance relief. The property seller's attorney spoke in favor of the application and staffed the Applicant met the criteria for sand relief. The Applicant proposes to demolish the existing one-story single-family dwelling and shed on the Premises and build a new single-family dv+relling. Therefore, the Board finds that the proposed project requires Variance relief pursuant to Bylaw section 139-16A. 4. The Applicant submitted a site plan of the Premises dated November 8, 1999, revised December 8,1999, prepazed by Leo Asadooria~, PIS, of Blackwell and Associates, Inc. The site plan shows three (3) existing structures on the. Premises: a shed located zero feet from the rear property line, a garage located zero feet from the easterly side property line, and dwelling 1'ocated 5.8 feet from the westerly property line where a 10 foot setback is required. The total existing ground cover is 989± square feet where a maximum ground cover allowed is 1,500 square feet for this lot of record. 5. The Applicant proposes to demolish and remove the shed, eliminating one (1) zoning violation from the Premises. The Applicant proposes to demolish the existing structure and build a new dwelling that will be located 5.8± feet from the westerly property line thus coming no closer to that property line than the existing dwelling and 12± from the easterly property line, meeting the 10 foot side and rear setback requirement. The Applicant proposes to renovate the existing garage in place. The total proposed ground cover will be 1,277± square feet (1,035± square feet for the proposed dwelling and 242± square feet for the existing garage) representing an increase in ground cover of 288± squaze feet, but still less than the nnaximum 1,500 square feet allowed. 6. At the hearing, the Applicant presented evidence that there is a protected wetland located near the rear property line and seasonal high ground water is less than 5 feet below the existing grade of the Premises. These unique soil conditions subject the Premises to strict wetlands and health regulations. The Applicant presented the Board with the plan showing the new septic system (to replace a failed cesspool) and the wetland setback requirements that leave only a small portion of the.Premises available for construction. Order~of Conditions No. NAN-034 from the Nantucket Conservation Commission has already approved the proposed building envelope due to its proximity to the wetlands and the ground water level. 7. The Applicant presented evidence that the abutting property to the west is subject to a pernnanent conservation restriction and a restriction against further building, such that granting the requested Variance will not result in crowding a property line that may some day be built on by the abutter. 8. The Board finds that owing to the unique soil conditions and shape of the lot and unique topography of the remaining garage structure, not affecting generally the zoning district in which Locus is located, literal enforcement of the Bylaw will involve substantial hardship to the Applicant. Given the unique shape of the Premises, application of the sideline setback requirement would place the proposed new dwelling in front of the existing garage, blocking the only available space for a driveway and parking on the Premises, further limiting the available building envelope. Since no structure may be built on abutting property along the westerly property line of the Premises, the Board finds that granting the requested Variance may be done without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Bylaw. 9. Based on these findings, the Board of Appeals voted. UNANIMOUSLY to GRANT the requested VARIANCE under Zoning Bylaw section 139-1bA to permit the demolition of the existing single-family dwelling on the Premises, construction of a new single-family dwelling, and renovation of the existutg garage in place, provided that: 1. The new dwelling shall comply with the provisions of the Nantucket Zoning Bylaw except that it znay be sited within the side yard setback from the westerly ProFe~Y line so long as it is no closer than 5.8~ feet from that property line; Z. The existing shed shall be demolished and removed to eliminate a zoning violation prior to issuance of the Certificate of Occupancy; and 3. The total ground cover shall not exceed 1,277± square feet, which is 242± square feet for the existing garage and a maximum building envelope of 1,Q35± square feet for the proposed single family dwelling, as shown on the plan drawn by Blackwell and Associates, lnc., dated November 8, 1999, revised December 8,1999, and attached hereto, and marked as Exhibit A, outlining the building envelope with a dashed Line. The property is apre-existing lot of record, consisting of 5,019 square feet in the Residential-2 zoning district that has a minimum lot size of 20,000 square feet. The lot has 50.36 feet of frontage on Sesachacha Road, less than the minimum frontage of 75 feet in the R-2 zone. There is one single-family dwelling, a shed and a garage built on the property, all of which predate the adoption of the Nantucket Zoning By-law. The shed encroaches across the northerly property line in the setback and on abutting land, the garage is located 0.3 feet from the easterly property line, and the dwelling is located 5.8 feet from the westerly property line, all within the minimum ten feet side and rear setbacks in the R-2 district. The Applicant proposes to demolish and reconstruct the dwelling on the property, which is in poor condition and is uninhabitable. The Applicant seeks a Special Permit under Nantucket Zoning By-law section 139-33A(5) to extend the structure within the setback, provided that the nonconforming distance of 5.8 feet is not made more nonconforming along the westerly property line.
