RANNEY, TRUSTEE, of 4 Thirty Acres Lane, Nantucket, MA 02554, Board of Appeals File No. 112-99, the Board made the following Decision: 1. Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw §139-9B(2)(b) (storage and warehousing). Applicant proposes to construct a building that would contain one (1) second floor apartment, about 1,450+ square feet of office/retail space on the first floor, and about 1,200+ square feet of storage space in the basement area. Applicant is also seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw §139-18 to waive up to five (5) of the required ten (10) parking spaces for retail use, with office use requiring nine (9) spaces. Relief under Zoning Bylaw §139-18 is also sought, to the extent necessary, to waive the 24-foot aisle width as well as permit the backing out of vehicles onto the traveled way, and under §139-20 waiving the loading zone requirement. The Premise is located at 4 THIRTY ACRES LANE, Assessor's Map 67, Parcel 115.3, Plan File 48-G, Lot 7. The property is zoned Residential-Commercial-2. 2. The Decision is based upon the Application and materials submitted with it and the testimony and evidence presented at the hearing. The Planning Board made a favorable recommendation provided Applicant remove the existing paved driveway apron and common driveway on the southerly side of the property and provide screening at that point on the property. There were no letters on file and no opposition expressed at the hearing. 3. Applicant represented that he was in the process of constructing a building that he proposed would contain mixed uses, i.e., one (1) second floor apartment, retail/office space on the first floor and commercial storage in the basement. Applicant asked the Board to allow the use of the first floor to be either retail or office use for lease as well as allow the basement space to be rented as commercial storage space separately from the other uses in the structure. Due to the irregular shape of the property and the footprint of the structure, Applicant stated that it was proving difficult to provide all ten (10) of the required parking spaces for the proposed uses as well as the loading zone on site. Two (2) of the required spaces could be provided to the rear of the Lot with access by easement across the adjacent property to the north but would not meet the dimensional requirements of the Zoning Bylaw as a portion of said spaces would be situated within the layout of the adjacent property. It was further represented that the parking area located in front of the structure containing five (5) conforming spaces, would meet all dimensional requirements and not need relief under Zoning Bylaw §139-18 as to aisle width or backing out onto a traveled way. Screening and open space requirements would also be met amd the building would have a ground cover of about 25%± in a district that allows a maximum ground cover ratio of 50% on this 7,000+ square-foot lot. Applicant pointed out that similar relief had been granted by this Board, waiving certain portions of of the parking requirement as well as waiving the loading zone requirement in its entirety, within the Thirty Acres Lane Subdivision in which the Locus is situated. In response to concerns expressed by some Board members about the intensity of use of the structure without adequate parking spaces or loading zone being provided, Applicant agreed to. limit the use of the first floor to a less intense use, one (1) office with no retail, reserving his right to seek an amendment of this Decision under a separate Application, to ask for retail use at a later date. In addition, Applicant agreed to limit the use of the basement storage area to be ancillary to a tenant/owner of the building. 4. Therefore, the Board finds that, with the limitation of the uses in the building to one (1) second floor apartment, one (1) 1,450+ square-foot office on the first floor, and ancillary storage in the basement used by a tenant/owner of the building,•the required parking spaces are calculated to be eight (8). The Board further finds that with five (5) conforming spaces being provided on site, and two (2) truncated spaces being sited in the rear of the Locus and accessed by a recorded easement across the immediately adjacent property to the north, waiver of one (1) space in its entirety and validation of said truncated spaces would be in harmony with the general purpose and intent of the Zoning Bylaw and not contrary to sound traffic and safety concerns. In addition, the Board finds that the uses of the structure as now proposed are permitted as a matter of right without relief, in this instance, from this Board being required, and that no relief is hereby necessary under Zoning Bylaw §139-18 as it relates to waiving of the required 24-foot aisle width, the backing out of vehicles into a traveled way, or under Zoning. Bylaw §139'-20 as no loading zone is required for office use. 5. Accordingly, by a unanimous vote, the Board GRANTS the requested relief by SPECIAL PERMIT solely under Nantucket Zoning Bylaw §139-18, to waive one (1) parking space in its entirety, allow the use of two (2) truncated spaces to the rear of the Locus and allow access to said spaces by a recorded easement across the immediately adjacent property to the north, with five (5) conforming spaces being provided on site, upon the following conditions: a. The use of 1,450+ square feet of the first floor shall be limited to office use, with no retail use, without further relief from this Board; b. A recorded easement shall beyfiled, prior to the issuance of the Certificate of Occupancy by the Building Department, at the Nantucket Registry of Deeds indicating an easement across the immediately adjacent property to the north to provide access to the two (2) truncated rear parking spaces as shown on a plan labeled "Parking Concept Plan", done by Nantucket Surveyor, Inc., dated October 28, 1999 and revised November 4, 1999, marked as Exhibit A and attached hereto; c. The basement storage shall be limited to ancillary use by a tenant/owner of the structure and not leased for separate commercial storage purposes without further relief from this Board; d. The screening of the parking areas shall be done in substantial conformance with the above cited"Parking Concept Plan"; and e. The project shall be done in substantial conformance with the Certificates of Appropriateness Nos. 34,342 and 35,266, as may be amended, granted by the Historic District Commission. 6. The Board determines that the property is situated within/a subdivision that is exempt from the "Mino n Review" as Specified in Nantucket Zoning Bylaw §139-23.
