At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, November 12, 1999, at 1:00 P.M., in the Selectmen's Meeting Room, in the Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, the Board made the following decision on the application of JOHN M. ALLMAN, as Trustee of WAUWINET BEACH NOMINEE TRUST, c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts 02584, File No. 111-99: 2. The applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law §139-33.A (alteration or expansion of a pre-existing, nonconforming structure or use). The applicant proposes to extend a single-family dwelling, said to pre-exist the zoning requirements with which it is nonconforming, upward within its existing footprint. The applicant also proposes to convert two existing decks into porches and a stone patio into a deck, which work will be outside of the required setback areas. The subject property (the "Locus") is nonconforming as to frontage, having no frontage upon a street or way in a district where minimum required frontage is 50 feet; and as to side yard setback, with the dwelling being about 3.6 feet at its closest point from the northerly side yard lot line, in a district where minimum required side yard setback is five feet. The Locus is situated at 139 WAUWINET ROAD, Assessor's Map 11, Parcels 10 and 11.2, is shown on Land Court Plans 10990-I and J as Lots 7 and 10, respectively, and is zoned as RESIDENTIAL-l. 3. Our decision is based accompanying materials, and re received at our public hearing. recommendation on the basis that matter of planning concern. The applicant proposes to alter the existing dwelling upon the Locus, involving expansion of the second floor in the side yard setback area within the existing footprint. As shown upon the plot plan by Nantucket Surveyors, Inc., dated October 4, 1999, a reduced copy of which is attached hereto as Exhibit A, the dwelling is at its closest point about 3.6 feet from the northerly side yard property line. The applicant also proposes to make changes which do not affect any setback area, and accordingly will not intensify any nonconformity of the Locus nor create any new nonconformity. (In fact, the dwelling upon the Locus and the dwelling upon the property to the north, not owned by the applicant, are connected by a deck, to which no changes are proposed.) The Locus has no street frontage, being served by an access easement which runs through the Locus and also serves properties to the north of the Locus, running to the Haulover and thence to Coskata, Coatue and Great Point. The Locus consists of a single merged lot, running all the way across from Nantucket Harbor to the west to the Atlantic Ocean to the east. Based upon the applicant's presentation at the public hearing, this configuration has existed since a time prior to the July, 1972 effective date of the original Nantucket Zoning By-law. The applicant's proposed changes have been approved by the Nantucket Historic District Commission (the "HDC") under Certificate of Appropriateness No. 34211. 5. In that the proposed changes will involve an upward extension of the portion of the existing dwelling which lies within the northerly side yard setback area, the Board of Appeals UNANIMOUSLY made the finding that these changes will intensify the pre-existing nonconformity upon the Locus. The Board then UNANIMOUSLY found that the proposed extension will not be substantially more detrimental to the neighborhood than the pre- existing nonconformities and will not make the nonconforming setback distance more nonconforming, and therefore voted UNANIMOUSLY to GRANT the requested SPECIAL PERMIT for the expansion of the dwelling pursuant to Nantucket Zoning By-law X139-33.A(5), upon the condition that the expansion shall be constructed in substantial conformance with the plans approved by the HDC in Certificate of Appropriateness No. 34211.
