DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Friday, November 12, 1999, at 1:00 P.M., in the
Conference Room, in the Town Annex Building, 37 Washington
Street, Nantucket, Massachusetts, the Board made the following
decision on the application of RICHARD B. CORKISH, JR., and
ELAINE C. PURCELL, as Devisees under Will of RICHARD B. CORKISH,
RICHARD B. CORKISH, JR., EXECUTOR, c/o Reade, Gullicksen, Hanley
& Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts
02584, File No. 110-99:
2. The Applicants are seeking relief by VARIANCE from the
provisions of Nantucket Zoning By-law §139-16.A (Intensity
Regulations - minimum lot size and front yard setback). The
Applicants are asking that the Board of Appeals validate a lot
that is arguably nonconforming as to lot area, with the subject
property (the "Locus") containing about 19,754 square feet in a
district that requires a minimum lot area of 20,000 square feet,
and as to front yard setback, with the single-family dwelling
upon the Locus being sited about 22.2 feet at its closest point
from the front yard lot line, with minimum setback of 30 feet
being required in this zoning district. The applicants state
that the Locus may have become nonconforming due to a plan
endorsed as approval-not-required by the Nantucket Planning Board
on January 14, 1985 in File No. 2774, after the dwelling had been
constructed. The Locus is situated at 6 MAYHEW LANE, Assessor's
Map 41, Parcel 443, is shown upon plan recorded with Nantucket
Deeds in Plan File 16-D as Lot 2, and is zoned RESIDENTIAL-2.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. The Planning Board
recommendation was favorable to the granting of variance relief
as requested. There was no support nor opposition presented in
person, by correspondence, or by representatives at the public
hearing.
4. As set forth in the application for relief and as
presented by the applicants' representative at the public
hearing, the Locus consists of a lot which was created by a plan
dated January 6, 1984, endorsed by the Nantucket Planning Board
on January 14, 1985, in File No. 2774, as not requiring approval
under the Subdivision Control Law, and recorded with Nantucket
Deeds in Plan File 16-E (the "1984 Plan") The area of the
Locus, as shown upon the 1984 Plan, is 20,228 square feet, which
conforms to the minimum lot area in the Residential-2 zoning
district of 20,000 square feet. However, the Locus contains a
strip of land, five feet wide, along its frontage with Mayhew
Lane, which is shown on the 1984 Plan as an "Easement", and which
was included within the way now known as Mayhew Lane upon a plan
dated October 10, 1973, previously endorsed by the Planning Board
in File No. 1230A, and recorded with Nantucket Deeds in Plan Book
18, Page 129 (the "1973 Plan"), which plan has never been
modified by any decision by the Planning Board. The Locus is
improved with a dwelling, constructed subsequent to the
endorsement and recording of the 1973 Plan, and before the
endorsement and recording of the 1984 Plan. If the area of the
Locus which is situated within the "Easement" strip is excluded
from the lot area of the Locus on the basis that it is land
within a Way, as shown upon the original approval-not-required
plan endorsed by the Planning Board, the lot area of the Locus
would be about 19,754 square feet, and the Locus would not
conform to the minimum lot area requirement of 20,000 square
feet. Furthermore, if front yard setback is measured from the
southerly edge of the "Easement" (the original line of the way),
front yard setback of the existing single-family dwelling is
about 22.2. feet; a minimum of 30 feet is required in the
Residential-2 zoning district.
5. The Applicants represent that they do not own any
adjacent land which could be added to the Locus, all such land
having been sold by the testator, Richard B. Corkish, during his
lifetime. They further state that it is necessary to sell the
Locus in order to settle the estate of Richard B. Corkish, who
died on March 7, 1999. Accordingly, they request Variance relief
from the minimum lot area and front yard setback requirements
under Nantucket Zoning By-law X139-16.A, in order to cure the
existing condition of the Locus and the dwelling thereon.
6. A reduced copy of an as-built plan of the Locus, showing
the present conditions upon the Locus and the placement of
buildings thereon, and showing the Locus as bounded by the line
of the original Way as shown upon the 1973 Plan, by Nantucket
Surveyors, Inc., dated October 5, 1999, is attached hereto as
Exhibit A.
7. After hearing, the Board of Appeals found UNANIMOUSLY
that owing to circumstances relating to the shape and topography
of the Locus and the structures thereon, consisting of the fact
that the Locus was improved with a dwelling prior to the time
when conveyance of adjoining land arguably created a zoning
violation, and especially affecting the Locus but not affecting
generally the zoning district in which the Locus is situated, a
literal enforcement of the provisions of the Nantucket Zoning By-
law as to lot area and front yard setback as to the Locus would
involve substantial hardship to the applicants, and that
desirable relief may be granted without substantial detriment to
the public good and without nullifying or substantially

derogating from the intent or purpose of the Zoning By-law, and
accordingly GRANTED, by UNANIMOUS vote, the VARIANCE relief
requested by the Applicants, validating the Locus as a separate
lot containing about 19,754 square feet in a district in which
minimum lot area is 20,000 square feet, and curing the existing
front yard setback nonconformity in accordance with Exhibit A..

The subject property (the "Locus") consists of a lot which was
