At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, November 12, 1999, at 1:00 P.M., in the Selectmen's Meeting Room, in the Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, the Board made the following decision on the application of FREDERICK P. McCLURE and MARGARET K. McCLURE, c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts 02584, File No. 109-99: 2. The applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law §139-33.A (alteration or expansion of a pre-existing, nonconforming structure or use). The applicants propose to extend a single-family dwelling, said to pre-exist the provisions of the Nantucket Zoning By-law with which it dose not conform, in an upward direction within the existing footprint, including a portion of the dwelling that is situated within about one foot of the westerly side yard lot line. The subject property (the "Locus") is nonconforming as to lot area, containing about 4,675 square feet in a zoning district in which the minimum lot area is 5,000 square feet; as to ground cover ratio, having a ratio of about 34% with 30% being the maximum ground cover for a lot containing less than 5,000 square feet; and as to side yard setback, with the dwelling being sited about one foot at its closest point from the northwesterly side yard lot line and less than four feet at its closest point from the southeasterly side yard lot line, in a zoning district in which minimum side yard setback is five feet. A parking space is situated upon the Locus, with access to the parking space being by easement across land of an abutter. The Locus is situated at 36 UNION STREET, Assessor's Map 42.3.2, Parcel 144, and is situated in a Residential-Old Historic zoning district. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. There was no Planning Board recommendation, on the basis that no matters of zoning concern were presented. There were two letters in support, and none in opposition, presented at the public hearing. 4. The applicants propose to alter the existing dwelling upon the Locus, involving expansion of the second floor in the side yard setback area within the existing footprint. As shown upon the plot plan by Blackwell & Associates, Inc., dated August 17, 1998, a reduced copy of which is attached hereto as Exhibit A, a portion of the dwelling in which upward expansion is proposed is set back by about one foot from the northwesterly side yard lot line; a setback of five feet is required under the Zoning By-law. Based upon the applicant's presentation, this condition has existed, in its present configuration, since a time prior to the 1972 effective date of the original Nantucket Zoning By-law. The other nonconformities of the structure will not be affected by the proposed work, and all other work will be done in portions of the structure which do not lie within any setback area; accordingly no zoning relief is required except for the work to be done in the setback area. The Nantucket Historic District Commission (the "HDC") has approved the relevant changes, and has issued Certificates of Appropriateness Nos. 32131 and 33322. 5. In that the proposed changes will involve an upward extension of the portion of the existing dwelling which lies within the northwesterly side yard setback area, the Board of Appeals UNANIMOUSLY made the finding that these changes will intensify the pre-existing nonconformity upon the Locus. The Board then UNANIMOUSLY found that the proposed extension will not be substantially more detrimental to the neighborhood than the pre-existing nonconformities and will not make the nonconforming setback distance. more nonconforming, and therefore voted UNANIMOUSLY to GRANT the requested SPECIAL PERMIT for the expansion of the dwelling pursuant to Nantucket Zoning By-law §139-33.A(5), upon the condition that the expansion (insofar as it affects the portions of the dwelling situated within the setback area) shall be constructed in substantial conformance with the plans approved by the HDC in Certificates of Appropriateness No. 32131 and 33322.
