The meeting was held in the Conference Room, Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, on the Application of SCOTT T. O'CONNOR, of 2 Greglen Avenue, Suite 6, Nantucket, MA 02554, with the Board making the following Decision: 1. Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw §139-9B(2)(a), (b) and (c) (light manufacturing; storage and warehousing, including screened open storage of goods and materials; and fabrication and assembly of component parts for off-site construction or use, respectively); and a SPECIAL PERMIT under Nantucket Zoning Bylaw §139-20 to waive the loading zone requirement. In BOA File No. 108-99B, Applicant asked for additional relief by SPECIAL PERMIT under Zoning Bylaw §139-18, to the extent necessary, to allow a truncated aisle width (less than the required 24-foot width) in the parking areas and any other relief under said section the Board would deem necessary, including waiver of a parking space to complete the project as proposed. Applicant proposes to construct a building that would contain an office, storage and shop space on the first floor to be used in conjunction with his construction business and two (2) apartments on the second floor. Applicant would provide the required four (4) parking spaces on site. The Premises is located at 17 CYNTHIA LANE, Assessor's Map 67, Parcel 462, Plan File 38-B, Lot 11. The property is zoned Residential-Commercial-2. 2. '1'lie Decision is based upon L-lie ApplciaLions grid materials submitted with them and the testimony and evidence presented at the hearing. The Planning Board made a favorable recommendation provided Applicant place screening in accordance with the Bylaw and a common driveway be constructed to the north. As the property is in the Wellhead Protection District, a letter from the General Manager of the Wannacomet Water Company ("WWC") was submitted and stated that the project would not result in a degradation of ground water and approved the project as proposed as required by §139-12 (3)(a). 3. Applicant proposes to construct a building that would be used initially for storage and warehousing space that would be used in conjunction with Applicant's construction business. Applicant is providing the required four (4) parking spaces based on a total of 3,376+ square feet of storage and warehousing space as shown on a "Plot Plan", done by Richard K. Earle, Nantucket Surveyors, Inc., dated November 22, 1999, marked as Exhibit A and attached hereto. When building permits become available, Applicant intends to convert the second floor space over the rear portion of the structure into a dwelling unit and convert the front portion of the structure into a single-family dwelling, leaving 720+ square feet devoted to the storage and warehousing use. Said dwelling units are permitted as a matter of right in this zoning district. The latter uses would require only three (3) parking spaces, but Applicant intends to maintain the four spaces shown on Exhibit A. The structure will meet all dimensional requirements. Due to the irregular shape of the Locus, the Applicant is seeking relief to reduce the required 24-foot aisle width to 18+ feet for the front and rear parking areas as shown on Exhibit A. The parking spaces will meet dimensional requirements however. Applicant is also seeking relief from the loading zone requirement as deliveries will be minimal and there is sufficient space for the occasional delivery vehicle to access the property though insufficient space to accommodate a 14' x 35' loading zone on site. The open space requirement will be met with 37/+ being provided. 4. Therefore, the Boards finds that the grant of Special Permit relief for the storage and warehousing use under Nantucket Zoning Bylaw §139-9B(2)(b) with no outside storage of goods and materials, would be in harmony with the general purpose and intent of the Zoning Bylaw. The Locus is situated within a mixed commercial/residential neighborhood and would not be inconsistent with the character of said neighborhood. The Board further finds that allowing the reduction of the 24-foot required aisle width to 18+ feet, waiving of the loading zone requirement, would also be in harmony with the general purpose and intent of the Zoning Bylaw and not be contrary to sound traffic or safety considerations. It would be difficult for the Applicant to physically provide the proper aisle width and loading zone due to the irregular shape of the property and building location as required by the Historic District Commission in Certificate of Appropriateness No. 35,0100• 5. Accordingly, by a UNANIMOUS vote, the Board GRANTS the requested SPECIAL PERMIT under Nantucket Zoning Bylaw §139-9B(2)(b) for the storage and warehousing uses with no outside storage, as proposed, and further GRANTS the requested SPECIAL PERMITS under Nantucket Zoning Bylaw §139-18 and §139-20 reducing the 24-foot required aisle width to 18+ feet and waiving the loading zone requirement, respectively, upon the following conditions: a• The project shall be constructed in substantial conformance with the "Plot Plan" done by Richard K. Earle, Nantucket Surveyors, Inc., dated November 22, 1999, marked as Exhibit A, and attached hereto; and b. The structure shall be built in substantial conformance with Certificate of Appropriateness No.,3S OloO issued by the Historic District Commission. 6. O'Connor, is seeking relief by SPECIAL PERMIT, under Nantucket Zoning By-Law § 139 - 9(B)(2)(a), (b) & (c) (light manufacturing, storage and warehousing, and fabrication and assembly of component parts for off site construction or use, respectively). The Applicant intends to construct a building, with two (2) apartments upstairs and an office and storage downstairs to be used in connection with his construction business. All parking requirements will be met. Each of the apartments will require one space, the office will require one space and the storage, approximately 1,100 square feet, will require one space for a total of four (4) spaces. Four parking spaces are shown on the plan attached as Exhibit A. The property is also located in the Wellhead Recharge District. The proposed building at the property will be less than 2,500 square feet and all parking and driveways will be made of gravel, therefore, this project is not subject to 139-12(B)(2)(s)(a). Applicant is also seeking a waiver of the off-street loading requirements set forth in § 139 - 20 of the By-Law. The properties constructed in the subdivision do not have loading facilities. Providing one in this instance would be inconsistent with the neighborhood. Furthermore, the granting of this relief would not be contrary to sound, traffic, police or safety considerations.
