DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals held at 12:00
noon, Friday, November 12, 1999, in the Town Annex Building Conference Room at 37
Washington Street, Nantucket, Massachusetts, on the application of THE ESTATE OF
JOHN G.W. RUSTED, JR., ELIZABETH RUSTED, EXECUTOR, 2 Wannacomet
Road, Nantucket, Massachusetts 02554, Board of Appeals File No. 105-99, the Board
made the following decision:
2. The Applicant seeks a SPECIAL PERMIT under Nantucket Zoning Bylaw
§ 129-24(A)(3) relieving the Estate from the requirements of the Residency Covenant
entered into by John and Elizabeth Rusted and signed on October 23, 1995, due to a
change in personal circumstances.
3. This decision is based on the application and materials submitted with it and
the testimony and evidence presented at the public hearing. One letter was received
supporting the grant of relief.
4. Through counsel, Mrs. Rusted advised the Board that she and her husband
entered into a residency covenant with the Town on October 23, 1995. Mr. Rusted
recently died and Mrs. Rusted no longer can afford to maintain such a large house. The
covenant, which Mr. & Mrs. Rusted entered into in good faith will hinder Mrs. Husted's
ability to sell what is now her house and impede her move into a smaller dwelling. There
was no opposition voiced to the application.
5. Under §129-24(A)(3)(c), this Board may relieve an applicant from a residency
covenant entered into under the phased development section of the Bylaw if it finds that
strict conformance with the covenant would impose an unreasonable personal or financial
hardship on the owner of the dwelling by reason of, among other things, "loss of life,"
and "such other personal or financial hardship as the Board may from time to time
determine to be severe enough to warrant such relief."
6. The Board finds that this applicant meet the criteria set out in the above
referenced section of the Bylaw and would suffer unreasonable personal and financial
hardship absent relief from the covenant. Accordingly, by a unanimous vote (Hourihan,
O'Mara, Waine, Parent, Toole), the Board GRANTS the requested SPECIAL PERMIT
relieving the Estate of Mr. John G.W. Husted and Mrs. Elizabeth Husted from said
covenant.

The Premises is located at 2 WANNACOMET ROAD, Assessor's Map y 1,
Parcel 573, Land Court Plan 8852-V, Lot 51. The property is zoned
Limited-Use-General-2.

APPLICATION OF ESTATE OF JOHN G. W. RUSTED, JR.

Applicant is Elizabeth Rusted as Executor of the will of John G.
W. Rusted, Jr., who died unexpectedly on May 9, 1999. Ms. Rusted
is Mr. Husted's widow and is selling the property to meet the
obligations of the estate and because the house is too big for
her needs and too expensive to maintain.
Applicant's lot is subject to a year-round covenant that was
executed pursuant to Section 139-24A(3) of the zoning bylaw. Mr.
and Mrs. Rusted occupied the premises as their year-round
residence from the time the house was built through the day of
Mr. Husted's death.
Applicant seeks relief from the covenant to allow her to sell the
premises to a buyer who will not occupy the house on a year-round
basis. The premises are under agreement with a closing date of
November 22, 1999. A smaller house for Ms. Rusted is under
agreement to close on December 1, 1999.
Without relief from the covenant, Applicant would be unable to
sell the property to the contract purchaser and thus unable to
purchase the replacement property. Such inability would impose a
severe personal and financial hardship on the estate and/or Ms.
Rusted.
Relief sought:
Applicant seeks a finding and Special Permit under Section 139-
24A(3)(c) that strict conformance with the covenant would impose
an unreasonable personal or financial hardship on the estate
and/or on Ms. Rusted by reason of Mr. Husted's untimely death.

WHEREAS, JOHN G. W. RUSTED, JR. and ELIZABETH RUSTED, ~usba3rd and wife,
of 5 Pleasant Street, Nantucket, Massachusetts, are natural persons and ercjthte Owner¢ of the
real property situated at 91 Madakct Road, Nantucket, Massachusetts (the property") more
particularly described in Certificate of Title No. 11534 at the Nantucket Registry District for
the Land Court and shown as Lot No. S! on Land Court Plan 8852-V filed with Certificate
of Title No. 11534.
WIIERGAS, the undersigned have applied for a building permit with respect to the property
and desire to execute, acknowledge and deliver a Covenant to the Town of Nantucket
pursuant to the provisions of the Zoning By-Law of tltc Town of Nantucket set forth under
Section 139-24(3).
NOW, TIIEREfORE, in consideration of the issuance of Building Permit to the undersigned
and in compliance with the provisions of Section 139-24(3) of the "Coning By-Law of the
Town of Nantucket, the undersigned hereby covenant and agree as follows:
t) Tltat they arc domiciled or about to become domiciled in
Nantucket, Massachusetts
2) The dwelling to be located on the property will be occupied by
the undersigned.
3) Said dwelling will be used by the undersigned as a year-round
residence.
4) Said dwelling will not be offered for seasonal rental.
5) This Covenant shall remain in full force and effect for a period
of five (5) yc:trs from the daft of issuance of an occupancy
permit for said dwelling.
6) This Covenant shall run with the land and shall be binding upon
future owners of the property for the term hereof.
