DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Friday, December 10, 1999, at 1:00 P.M., in the
Conference Room, Town Annex Building, 37 Washington Street,
Nantucket, Massachusetts, the Board made the following decision
on the application of MYLES M. REIS, Owner, and LISA SHERBURNE
and ALAN SHERBURNE, Applicants, c/o Sarah F. Alger, P.C., Two
Union Street, Nantucket, Massachusetts 02554, File No. 102-99
(originally noticed for Friday, November 12, 1999, at 12:00 P.M.,
and continued to Friday, December 10, 1999, at 1:00 P.M.):
2. The applicants seek a Special Permit under Nantucket
Zoning By-law §139-7.D(4) (employer dormitory) and §139-18
(parking requirements). The applicants propose to construct a
duplex building that will be used as an employer dormitory for
occupancy by up to twelve employees. On this basis, the use
requires seven parking spaces. The applicants will provide up to
six parking spaces on the locus. Accordingly, the applicants are
seeking Special Permit relief under Nantucket Zoning By-law
§139.18.B(4) to waive one of the required parking spaces. The
duplex structure will meet all dimensional requirements. To the
extent necessary, the applicants are also requesting Special
Permit relief under Nantucket Zoning By-law §139-18.A(3) to
reduce the aisle width to about 20.5 feet, with 24 feet being the
minimum required.
The premises are located at 5 Cynthia Lane, Assessor's Map
66, Parcel 415, Plan 38B, Lot 17, and are zoned Residential-
Commercial-2.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. The Planning Board
recommendation was favorable, subject to the suggestion of
various conditions. Two abutters were in opposition, and one
submitted a letter. The opposition was based upon the perceived
intensity of potential development of the Cynthia Lane area in
general and related traffic concerns and was not specifically
related to the applicants' proposed employer dormitory use. The
Board received and made part of the record five letters in favor
of the application.
4. The locus is a vacant lot, situated in a Residential-
Commercial-2 ("RC-2") zoning district. Duplex dwellings
containing two dwelling units are permitted as a matter of right
in the RC-2 district. The applicants propose to construct a
duplex dwelling upon the locus, to be used as an employer
dormitory, with a total of up to twelve occupants, up to six in
each of the two dwelling units. The applicants have accordingly
applied in this matter for a Special Permit under Nantucket
Zoning By-law (the "By-law") §139-7.D(4) , for use of each of the
two dwelling units as an employer dormitory. As the number of
parking spaces required for a twelve-occupant employer dormitory
is seven, and the number of parking spaces that the applicants
propose to provide upon the Locus is six, the applicants have
also requested parking relief by Special Permit under By-law
§139.18.B(4) to waive one of the required parking spaces. Since
the proposed aisle width for the proposed parking area is about
20.5 feet, instead of the required minimum of 24 feet, the
applicants are also, to the extent necessary, requesting Special
Permit relief under By-law §139-18.A(3) to reduce the aisle width
to about 20.5 feet, with 24 feet being the minimum required.
5. An "Employer Dormitory" is defined in By-law §139-2 as
"[a] dwelling in which sleeping accommodations for two or more
persons are provided by one or more employers, with occupancy
limited solely to their employees. Employer dormitories are
allowed in all zoning districts by Special Permit from the
special permit granting authority; no standards for the issuance
of such special permits are set forth in the By-law, except for
the general provision of §139-30.A(1) that "the special permit
granting authority may issue special permits for structures and
uses which are in harmony with the general purpose and intent of
this Zoning Bylaw [sic], subject to the provisions of such bylaw
[sic]." Relief from parking requirements, waiving one of the
spaces required under By-law §139-18.A, may be granted by special
permit under By-law §139-18.B(2) and (4) where the special permit
granting authority finds that the granting of the Special Permit
is in harmony with the general purpose and intent of the By-law,
and that compliance with the parking requirements under §139-18
"would (i) be physically impossible for the applicant to provide
or (ii) if physically practical, have a significant and adverse
effect on the scenic or historic integrity of the neighborhood,
or (iii) be contrary to sound traffic and safety considerations."
The purpose of the Nantucket Zoning By-law, as set forth in §1,
is to promote the health, safety, convenience, morals, and
general welfare of the Town's inhabitants, to lessen the danger
from fire and congestion, and to improve the Town.
6. The need for increased and appropriate housing for
employees is a matter of common knowledge on Nantucket and was
spoken to in the letters the Board received and by the applicants
at the public hearing. The requirement for a special permit for
an employer dormitory enables the Board of Appeals, as the
special permit granting authority specified in the By-law, to
impose conditions to ensure compliance with the purpose and

intent of the By-law under §139-30.A(2) The applicants
presented the Board with various proposed conditions, in the form
of a dormitory management plan. A copy of this dormitory
management plan is attached hereto and incorporated herein as
Exhibit A (the "Management Plan") The Management Plan was based
upon a draft dormitory management plan being formulated by the
Planning Board and made part of its recommendation. As part of
the Management Plan, the applicants represented to the Board that
an individual resident manager would be hired to protect the
dormitory, its inhabitants, the abutters and neighbors, and the
Town generally from anticipated problems. The locus is near a
Nantucket Regional Transportation Authority ("NRTA") seasonal bus
route, and the applicants offered to take actions to limit and
discourage the use and parking of automobiles by the inhabitants
of the dormitories. The Management Plan, and the terms,
agreements, and conditions therein, as part of this Decision,
will run will the locus and will be binding upon and enforceable
against any and all future owners and lessors of the locus for so
long as the locus is used as an employer dormitory as proposed in
this decision. The motion for approval of the proposed dormitory
upon the locus incorporated the conditions set forth in the
Management Plan for the granting of the Special Permits for the
employer dormitory and requested parking and aisle width relief
in this application.
7. Upon these facts, the Board of Appeals found that the
granting of the requested relief by Special Permit under §139-
7.D(4) for employer dormitory use upon the locus as proposed,
with the safeguards provided by the imposition of the conditions
set forth in the Management Plan and this decision, and
considering the relative distance of the Locus from the
properties of the objecting neighbors, would be in harmony with
the general purpose and intent of the Zoning By-law, and that the
requested relief by Special Permit under §139-18 from one of the
required seven parking spaces for the proposed twelve person
employer dormitory upon the locus, and from the minimum required
aisle width of 24 feet to about 20.5 feet, would be in harmony
with the general purpose and intent of the By-law, and that
compliance with the parking requirements under §139-18 would be
unnecessary for sound traffic planning and would have a
significant and adverse effect on the scenic or historic
integrity of the neighborhood.
8. Accordingly, by UNANIMOUS vote, the Board of Appeals
GRANTED the requested relief by SPECIAL PERMIT under By-law
§§139-7.D(4) and 139-18 to allow for the use of a duplex
structure upon the locus as a twelve person employer dormitory,
providing six of the required seven parking spaces and aisle
width of only about 20.5 feet; expressly subject, however, to the
conditions set forth in the Management Plan, and to the condition
that the Special Permit granted hereby for the dormitory use
shall be reviewed by the Board following both the first and the
second full summers of operation of the dormitory after the

issuance of a certificate of

Dormitory Management Plan
1. The property owner shall be responsible for planting and
permanently maintaining a compact hedge at least four feet
high along each side of any parking area that adjoins or
fronts on any street and/or abutting property (except along
any common driveway) to prevent damage to the landscaping
and general appearance of the premises from vehicular
activities and to provide screening from neighboring
parcels.
2. The property owner shall be responsible for planting and
permanently maintaining on the premises at least two shade
trees of at least four inches in caliper.
3. All exterior lighting shall be directed generally downward
and placed so as to not be directed at any neighboring
parcels.
4. The premises shall be serviced by a commercial trash
removal service, with trash to be removed at regular,
frequent intervals year-round, as needed.
5. No exterior storage of furniture (except lawn furniture),
refuse, mechanical components, debris, unregistered or
inoperable vehicles, or other materials constituting a
nuisance, shall be permitted on the premises.
6. The dormitory building upon the premises shall not be used
for the housing of any persons except for employees of an
owner of the premises, or employees of a tenant of an owner
of the premises. No portion of any building upon the
premises shall be rented to any person for occupancy by
such person; all tenants shall be employers, and all
occupants shall be employees of an owner or tenant, who are
licensed by their respective employers to occupy a space in
the dormitory by virtue of their employment and for only so
long as their employment shall continue. No subtenancies
of the buildings upon the premises or any portion thereof
shall be permitted.
7. Each lease to an employer shall set forth that the employer
shall be responsible for compliance with all provisions of
these conditions by the employees of such employer and
within the area leased to such employer.
8. The property owner shall employ an individual resident
manager, who shall reside in the dormitory building. The
resident manager shall keep an open log of neighbors'
complaints and of any action taken to abate each problem.
9. The names and telephone numbers of the property owner, the
resident manager, and of each employer housing employees in
the dormitory, by virtue of ownership or lease, shall be
delivered to each direct abutter of the premises. This
information shall be updated at the time of any change. It
shall further be filed with the Nantucket Police
Department, the Nantucket Building Department, and the
Nantucket Health Department. The resident manager shall be
provided with a paging device, and the telephone number of
such paging device shall be provided to the Nantucket
Police Department.
10. Overnight guests in~the dormitory shall be prohibited, and
no nonresidents shall be permitted upon the premises
between the hours of 11:00 PM and 6:00 AM on any day.
11. No alcohol shall be consumed by any person upon any
exterior portion of the lot or anywhere upon the premises
except within a building.
12. The premises and grounds of the premises shall be kept neat
and clean at all times. The premises shall be maintained
and occupied in compliance with the provisions of the
Nantucket Noise By-law, Chapter 101 of the Code of the Town
of Nantucket. The property owner shall make all efforts to
keep the premises quiet and free from any and all loud or
offensive noise.
13. The total number of motor vehicles to be permitted to be
kept upon the premises by the owners or tenants of the lot
or their employees shall not exceed the number of on-site
parking spaces provided upon the lot, less one. No employee
shall keep a motor vehicle upon any lot without the consent
of his or her employer.
14. The owner of the premises, or the tenant of an owner of the
premises, shall make available to their employees free
Nantucket Regional Transit Authority shuttle passes for the
entire period that such employees shall reside in the
dormitory.
15. The property owner shall be required to install and
maintain bike racks on the premises, in a location
convenient for use by the employee residents of the
dormitory.
16. The property owner shall periodically conduct orientation
sessions, which each new employee and a representative of
each new employer housing employees shall be required to
attend, in order to ensure that each employer and each
employee fully understand all conditions, rules, and
regulations applicable to the dormitory.
