At a Public Hearing of the Nantucket Zoning Board of Appeals held
at 12:00 P.M., Friday, November 12, 1999, in the Conference Room, Town
Annex Building, 37 Washington Street, Nantucket, Massachusetts, on the
Application of HOLLY R. FITZGERALD, of 1179 Main Street, Glastonbury, CT
06033, Board of Appeals File No. 101-99, the Board made the following
Decision:
1. Applicant is seeking relief by VARIANCE pursuant to Nantucket
Zoning Bylaw §139-16A (Intensity Regulations - front yard setback). Due to
a siting error during renovations in 1995 to the existing single-family
dwelling, a front stoop was added onto the front of the structure that now
encroaches upon the required 10-foot front yard setback area by about
1'8". Applicant asks the Board to validate the siting of the structure.
The Locus meets all other dimensional requirements.
The Premises is located at 29 EAST LINCOLN AVENUE, Assessor's Map
42.4.4, Parcel 14, Plan Book 19, Page 27, Lot 4. The property is zoned
Residential-1.
2. The Decision is based upon the Application and materials submitted
with it and the testimony and evidence presented at the hearing. The
Planning Board made no recommendation as the matter was not of planning
concern. There were no letters on file and no concerns expressed at the
hearing.
3. Applicant represented that the encroachment was unintentional.
Three steps were added in 1995 to provide access to the single-family
dwelling when it was elevated three (3) feet to comply with state and
federal flood control laws as part of an overall renovation. Applicant
further stated that there was no encroachment prior to said work having
been performed.
4. Therefore, the Board finds that a grant of relief by Variance
would be in harmony with the Zoning Bylaw as owing to circumstances
relating to the topography of the Locus, i.e., with the existing structure
lying within a designated flood plain and sited as shown on Exhibit A,
especially affecting such land and structure but not affecting generally
the zoning district in which it is located, a literal enforcement of the
provisions of the Zoning Bylaw would involve substantial hardship,
financial or otherwise, as removal of the front steps would deprive the
Map 42.4.4
Applicant of access to the front door of the dwelling, and the desirable
relief may be granted without substantial detriment to the public good
and without nullifying or substantially derogating from the intent or
purpose of the Bylaw.
5. Accordingly, by a unanimous vote, the Board GRANTS the requested
relief by VARIANCE under Nantucket Zoning Bylaw §139-16A to validate the
existing siting of the structure as shown on a plan done by Blackwell &
Associates, Inc., dated July 7, 1995, marked as Exhibit A and attached
hereto, upon the following condition:
- There shall be no further building within the front yard
setback area.
