DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals held at 12:00
noon, Friday, November 12, 1999, in the Town Annex Building Conference Room at 37
Washington Street, Nantucket, Massachusetts, on the application of MARK S. AND
LAURIE J. CONWAY, 11 Bailey Road, Nantucket, Massachusetts 02554, Board of
Appeals File No. 100-99, the Board made the following decision:
2. The Applicants seek a SPECIAL PERMIT under Nantucket Zoning Bylaw
§ 129-24(A)(3) relieving them from the requirements of the Residency Covenant they
entered into and signed on July 17, 1997, due to a change in personal circumstances.
3. This decision is based on the application and materials submitted with it and
the testimony and evidence presented at the public hearing.
4. The applicants entered into a residency covenant on July 17, 1997, which is
recorded at Book 542, Pages 146-148 at the Nantucket Registry of Deeds. The applicants
explained to the Board that they can no longer afford to live on Nantucket and are
moving to the Cape. The covenant, which they entered into in good faith will hinder their
ability to sell their house and impede their move to the mainland. There was no
opposition voiced to the application.
5. Under § 129-24(A)(3)(c), this Board may relieve an applicant from a residency
covenant entered into under the phased development section of the Bylaw if it finds that
strict conformance with the covenant would impose an unreasonable personal or financial
hardship on the owner of the dwelling by reason of ,among other things, "such other
personal or financial hardship as the Board may from time to time determine to be severe
enough to warrant such relief."
6. The Board finds that these applicants meet the criteria set out in the above
referenced section of the Bylaw and would suffer unreasonable personal and financial
hardship absent relief from the covenant. Accordingly, by a unanimous vote (Hourihan,
O'Mara, Waine, Parent, Toole), the Board GRANTS the requested SPECIAL PEMIT
relieving the Conways from said covenant.
