At a Public Hearing of the Nantucket Zoning Board of Appeals held at
12:00 P.M., Friday, October 22, 1999, in the Conference Room, Town Annex
Building, 37 Washington Street, Nantucket, MA, on the Application of Myles M.
Reis, P.O. 113, Nantucket, MA 02554, for himself as owner and for Edmund J.
Ramos, Jr., and Kimberley A. Ramos, P.O. 183, Nantucket, MA 02554, as
contract purchasers, Board of Appeals File No. 099-99, the Board made the
following Decision:
1. Applicants are seeking relief by SPECIAL PERMIT under Nantucket
Zoning Bylaw Section 139-9B(2)(b) to allow use of a proposed new building for
storage and warehousing which would comprise 750± square feet of space, with
office space of 450± square feet, and contain one (1) dwelling unit on the second
floor on this 5,000± square-foot lot. Applicants are also seeking relief by
SPECIAL PERMIT under Nantucket Zoning Bylaw Section 139-20 to waive the
off-street loading facilities requirement. All parking, open space and other
dimensional requirements will be met.
The Premises are located at 7 CYNTHIA LANE, Assessor's Map 67,
Parcel 467, Plan File 38-B, Lot 16. The property is zoned Residential-
Commercial-2.
2. The Decision is based upon the Application and the materials submitted
with it and the evidence and testimony presented at the hearing. There were no
letters or parties present in favor except Kimberley A. Ramos, the Applicant and
no letters or parties in opposition to the Application. The Planning Board
recommendation was favorable.
3. The Ramos' propose to construct a building for their plumbing business.
The storage and warehousing use for their business is nominal since most of the
parts and materials are kept in the vans or picked up off-site from plumbing
supply stores for off-site use. The vans can be parked in the garage bays.
There will be an office ancillary to the plumbing business or} the site. An
apartment on the second floor of the building is also planned.
Because most deliveries to the site will be for general office supplies and
there will be a nominal amount of deliveries for the plumbing business the
Applicants have requested a waiver of the loading zone requirement and to be
allowed to use the driveway area as shown on the plan for a dual use as the
loading zone.
4. The Board finds that a grant of relief by Special Permit pursuant to Section
139-9B(2)(b) for storage and warehousing is in harmony with the general
purpose and intent of the By-law. Further, the Board finds that a grant of relief by
Special Permit pursuant to Section 139-20 to waive the off-street loading facilities
is in harmony with the general purpose and intent of this bylaw; that the provision
of off-street loading facilities would be physically impossible for the Applicants to
provide on this small lot and still provide sufficient space for their purposes, and
that the grant of relief would not be contrary to sound traffic, parking or safety
considerations as there is adequate space within the parking layout to
accommodate a delivery truck without a designated area..
5. Accordingly, by unanimous vote, the Board GRANTS the Special Permit
relief requested for warehousing and storage in accordance with the Application
and pursuant to Section 139-9B(2)(b) in addition, by unanimous vote the Board
also grants the relief requested to waive the off street loading facilities as
requested in the Application and pursuant to Section 139-20, upon the following
condition: the structure and parking are to be located in substantial conformity
with a plan entitled "Proposed Site & Building Location Plan of Land in
Nantucket, Mass." dated September 30, 1999 by Blackwell & Associates, Inc., a
copy of which is attached hereto as Exhibit A.

ADDENDUM
Applicants are seeking relief by Special Permit pursuant to Section 139-
96. 2(b) for storage and warehousing consisting of approximately 750 square
feet including two garage bays for the inside parking of the commercial vehicles.
Office space consisting of approximately 450 square feet will also be on the site.
An apartment unit is planned for the second floor.
Applicants are also seeking Special Permit relief pursuant to Section 139-
20 to waive the Off-street loading facilities requirement or in the alternative to
allow the proposed driveway to also serve as the Off-street loading facility. The
Applicants' proposed uses require nominal deliveries as the actual storage and
warehousing of materials is minimal. Most supplies and materials are picked up
the Applicants' own vehicles and used off site.

ADDENDUM
Applicants are seeking relief by Special Permit pursuant to Section 139-
96. 2(b) for storage and warehousing consisting of approximately 750 square
feet including two garage bays for the inside parking of the commercial vehicles.
Office space consisting of approximately 450 square feet will also be on the site.
An apartment unit is planned for the second floor.
Applicants are also seeking Special Permit relief pursuant to Section 139-
20 to waive the Off-street loading facilities requirement or in the alternative to
allow the proposed driveway to also serve as the Off-street loading facility. The
Applicants' proposed uses require nominal deliveries as the actual storage and
warehousing of materials is minimal. Most supplies and materials are picked up
the Applicants' own vehicles and used off site.
