At a Public Hearing of the Nantucket Zoning Board of Appeals held
at 12:00 P.M., Friday, October 22, 1999 and continued to 12:00 P.M.,
Friday, November 12, 1999, in the Conference Room, Town Annex Building, 37
Washington Street, Nantucket, Massachusetts, on the Application of MICHAEL
D. MILONE AND JULIA M. MILONE, of 620 Balbriggan Court, Cincinnati, OH
45255, Board of Appeals File No. 098-99, the Board made the following
Decision:
1. Applicants are seeking relief by SPECIAL PERMIT under Nantucket
Zoning Bylaw §139-33A (alteration/expansion of a pre-existing
nonconforming structure/use). Applicants propose to~alter and renovate
a said to be pre-existing garage structure by enlarging and extending the
front of the garage structure in a northerly direction by an additional
four (4) feet; constructing an 85+ square-foot addition; add a second
floor by raising the roof ridge height from about 13 1/2 feet to about 21
feet, increasing the height within the required five-foot side yard
setback areas without coming any closer to the westerly or southerly lot
lines than the existing structure; and by changing the use of the new
second floor area of the garage by creating a studio. The alterations will
increase the ground cover ratio from about 41% to about 42% and not exceed
the 50°6 maximum ground cover ratio allowed for the about 6,414 square-foot
lot situated in a zoning district that requires a minimum lot size of
5,000 square feet. The Locus is nonconforming as to side and rear yard
setbacks with the garage structure being being sited about .83 feet at its
closest point from the westerly side yard lot line and about 4.40 feet at
its closest point from the rear yard lot line in a district that requires
a minimum side and rear yard setback of five (5) feet.
The Premises is located at 14 HUSSEY STREET, Assessor's Map 42.3.4,
Parcel 132, Plan File 27-M, Lot 17. The property is zoned
Residential-Old-Historic.
2. The Decision is based upon the Application and materials submitted
with it and the testimony and evidence presented at the hearings. There
was no Planning Board recommendation. There were two (2) letters on file,
one (1), not an immediate abutter, stated that the garage was in essence a
secondary dwelling despite what was noticed and stating that the height
was excessive; and one (1), an abutter, expressing concerns about the
massing of the structure with the addition of a second floor, impacting
his light, air and space, as well as raising a question of fire code needs.
There was no opposition expressed by the public at the hearings -and
to the contrary, one (1) neighbor spoke in favor of the Application and
felt that it would be an improvement to the area.
3. Applicants, through counsel, represented that they were doing
renovations to both the about 520 square-foot garage and single-family
dwelling as they were in a dilapidated and neglected state. Applicants
stated that the structure pre-dated the 1972 adoption of the Nantucket
Zoning Bylaw and was thus a validly "grandfathered" structure and Special
Permit relief could then be granted for the proposed alterations and
expansion. It was pointed out that the construction of a second floor for
use as a studio, without human habitation, as defined under Zoning Bylaw
§139-2 (Definitions), would be allowed as a matter of right without relief
from this Board if the garage had been sited outside of the five-foot
required side and rear yard setback areas. There are no other dimensional
violations on the Locus. In addition, Applicants represented that the Board
of Appeals has issued many such Special Permits for expansions and
alterations for similar. garage structures with grandfathered dimensional
violations. They argued that this proposal would not create any new
violations, with the additions not coming any closer to the westerly or
southerly side/rear lot lines than the existing structure. Applicants also
represented that they had been in contact with other immediate abutters and
they had expressed support for the proposed project and felt that the work
would be a benefit to the neighborhood.
Applicants submitted photographic evidence to show the existing
condition of the garage as well as its relationship to the abutting
properties. A locus map from the Nantucket Assessor's map book was
submitted showing the Locus in relation to the letter writers' properties.
Applicants further submitted an "Affidavit" from a predecessor-in-title
stating that the subject garage had existed in its present location since a
time "prior to 1948". It was further represented that said individual had
maintained more than two (2) dwelling units in the principal structure in
violation of the Zoning Bylaw which allows a maximum of two (2) dwelling
units on a lot. As part of the renovation, Applicants voluntarily removed
said violation by installing only one (1) dwelling unit in the principal
structure, which work did not require approval from this Board. There would
be no dwelling unit or human habitation in the new studio as the owner was
an artist and wished to use the space in conjunction with that pursuit. The
Historic District Commission, the arbiter of design and massing aspects,
issued Certificate of Appropriateness No. 34,915. Two (2) parking spaces
would continue to be provided on site where only one (1) is required under
the Zoning Bylaw for this property.
4. Therefore, three (3) members find that the proposed expansion and
alteration of the garage would not be substantially more detrimental to the
neighborhood than the existing nonconformities, stating that the proposed
project would improve the garage, have little impact on the neighborhood as
the structures around it were of equal or taller height than the about 21
feet proposed for the garage/studio under this Application, with 30 feet
being the maximum height allowed under the Zoning Bylaw; and that there is
precedent for a grant of relief. Two (2) members found that the expansion
and alteration would be substantially more detrimental to the neighborhood,
one (1) citing the two (2) neighbors' concerns.
5. Accordingly, at the meeting on October 22, 1999, by a vote of three
(3) in favor (Hourihan, Parent and Sanford) and two (2) opposed (Sevrens
and Murphy), relief was denied, with a grant of Special Permit relief
needing a minimum of four (4) in favor to pass. Upon a motion made and
seconded, and voted on unanimously, to reconsider the vote, it was then
unanimously voted to continue the public hearing until November 12, 1999 to
give the Applicants an opportunity to bring in more information.
At the November 12, 1999 meeting more testimony was given and material
submitted. Whereupon, a motion to grant relief subject to the following
conditions: substantial conformance with the Histo c District
Commission's Certificate of Appropriateness No. 3~~/.Sand a prohibition
on human habitation in the studio, by a vote of three (3) in favor
(Hourihan, Parent and Sanford) and two (2) opposed (Sevrens and Murphy )
relief by SPECIAL PERMIT was then DENIED.
