At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, October 22, 1999, at 12:00 noon, in the Conference Room, Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, the Board made the following decision on the application of ,EUGENE D. ATKINSON and CAROL ATKINSON, c/o Sarah F. Alger, Attorney, Two Union Street, Nantucket, Massachusetts 02554, File No. 094-99: 2. The Applicants are seeking a MODIFICATION of the Decision in Board of Appeals File No. 056-99, which granted a Special Permit under Nantucket Zoning By-law §139-33.A.(8), allowing alterations of common lot lines between two adjacent lots and allowing the combination of two adjacent nonconforming lots. No new nonconformities would have been created by the plan filed with the application in File No. 056-99. The Applicants now propose to substitute a new plan showing a different configuration of the lot lines. No new nonconformities will be created by this substitute plan. See also the decision in our File No. 045-96, dated September 27, 1996, recorded with Nantucket Deeds in Book 532, Page 337 (the."1996 Decision"). The Premises are located at 15 and 17 Quidnet Road; Assessor's Map 21, Parcels 117.3, 117.4, and 117.6; shown as Parcel B on Plan File 42-F and Parcels 2 and 2A on Plan File 42- G; and zoned Limited Use General - 3. 3. Our decision is based upon the application and accompanying materials and representations and testimony received at our public hearing. The Planning Board made no recommendation on this application, because the matter is not of planning concern. There was no support or opposition presented in person or by correspondence at the public hearing. 4. The Applicants propose to substitute for the plan attached to our decision in File No. 056-99 the plan drawn by Blackwell & Associates, Inc.~,~ dated .September ~ 24~, 1999, recorded with Nantucket Deeds in Plan File 55-5 (the "55-S Plan") The Applicants propose to convey Lot 3 on the 55-S Plan to the abutter and to retain Lot 4 on the 55-5 Plan. 5. The Board of Appeals finds that the 55-S Plan is in keeping with the spirit of its decision in File No. 056-99 and is an acceptable substitute for the plan attached to the decision in File No. 056-99. 6. Accordingly, by UNANIMOUS vote, the Board of Appeals hereby modifies the Special Permit granted in File No. 056-99 by modifying Paragraph 8 of the decision to read as follows: 8.
