At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, October 22,1999, at 12:00 P.M., in the Conference Room in the Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, the Board made the following decision on the application (091-99) of LANDAM CONSTRUCTION EXCHANGE COMPANY for itself and for EDWARD AND JOAN LAHEY of 564 Harbor Road, Southport, CT 06490, in connection with property known as 7 School Street, Nantucket, Massachusetts. 2. Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law, Section 139-33E(2)(A) as amended by Article 51 of the 1999 Annual Town Meeting, to allow the ground cover ratio on the Locus to be increased from the existing 35.4%± ground cover ratio to a ground cover ratio of 45%±. Applicants propose to demolish the non-conforming shed and construct a new garage with studio above that will conform to all setback requirements. A small addition is also proposed for the single-family dwelling. The Locus is nonconforming as to lot size with the Lot having 4,558± square feet of lot area in a district that requires a minimum of lot size of 5,000 square feet; as to frontage with the Lot having a frontage along School Street of 49± feet in a district that requires a minimum frontage of 50 feet; as to ground cover having a ground cover ratio of 35.4%± in a district that allows 30% for undersized lots without relief from this Board; and as to setbacks with the principal structure being sited at zero feet at its closest point from the westerly side yard lot line and with the shed being sited at 2± feet at its closest point from the westerly side yard lot line and at zero feet at its closest point from the rear yard lot line in a district that requires a minimum side and rear yard setback of five (5) feet. The Premises is located at 7 SCHOOL STREET, Assessor's Map 42.3.2, Parce1124. The property is zoned Residential-Old Historic. 3. Our decision is based upon the application and accompanying materials, photographs, architectural drawings and representations and testimony received at our public hearing. The Planning Board recommendation was that the application did not present any issues of planning concern. One letter of concern regarding the application was received prior to the hearing, and there was no opposition presented at the public hearing. 4. The Applicants propose to demolish the non-conforming shed and construct a new garage with studio above. The new building will conform to the setback requirements. The studio will have bathroom facilities, but will not have a kitchen. The Applicants have not requested second dwelling status for any part of the new building, and should they wish to convert the studio to a second dwelling, a modification of this Special Permit would be required. They also propose a small addition to the main house in conjunction with renovations to the main house that include a new foundation. No increase in the height of the house is planned in connection with the new foundation. Both the new structure and the renovations to the main house have been approved by the Historic Districts Commission (Certificates of Appropriateness Nos. 34814 and 34859), and copies of the approved elevations were provided to the Board. 5. The project will increase the ground cover ratio to approximately 45%. Generally in the Residential-Old Historic District a ground cover ratio of 50 % is permitted. When the lot is undersized, as in this case, increases in the ground cover ratio over 30% are only permitted by Special Permit from this Board. As proposed, the project will eliminate the validly pre-existing non- conformities with respect to the shed. The site plan shows that adequate parking will be available on the site. The Board finds that the proposed project will be consistent with the ground cover ratios of lots in the surrounding neighborhood and will not be substantially more detrimental to the neighborhood than the existing non-conformities. 6. Accordingly, the Board of Appeals voted UNANIMOUSLY to grant the requested SPECIAL PERMIT under Section 139-33E(2)(a) to permit the increase to a 45 %± ground cover ratio, provided the work is done in substantial conformity with the site plan attached hereto as Exhibit A and the Historic Districts Commission s Certificates of Appropriateness Nos. 34814 and 34859. Currently the ground cover ratio is 34.5% and, because the lot is undersized, only 30~ is permitted as of right. The Applicants propose to demolish the non-conforming shed and construct a new garage with studio above. The new building will conform with the setback requirements. They also propose a small addition to the main house. The project would increase the ground cover ratio to approximately 45%.
