DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Friday, October 22, 1999, at 12:00 P.M., in the
Conference Room, in the Town Annex Building, Washington Street,
Nantucket, Massachusetts, the Board made the following decision
on the application of Harry T. Rein and Susan D. Rein, c/o Reade,
Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669,
Nantucket, Massachusetts 02584, File No. 089-99:
2. Applicants are seeking relief by SPECIAL PERMIT under
Nantucket Zoning By-Law §139-33A (alteration/expansion of a pre-
existing nonconforming use/structure). Applicants propose to
expand a pre-existing single-family dwelling by constructing a
70± square foot bathroom addition and a shower enclosure onto the
rear, or westerly, side of the structure. The addition will
conform to setback and ground cover requirements. The Locus is~
nonconforming as to number of dwelling units on a lot, having
seven (7) units when the Bylaw allows a maximum of two (2)
dwelling units on one (1) lot. See also File Nos. 016-71 and
080-97.
The Premises is located at lOC Crow's Nest Way, Assessor's
Map 12 Parcel 44.4, being a part of Assessor's Map 12, Parcel 4,
Lot 47 on Land Court Plan 15961-H (see also Plan Book 34, Page
73) The property is zoned Residential-1.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. The Planning Board
recommendation was that the matter was not of planning concern.
There was no opposition presented at the public hearing.
4. Applicant's proposal is to add a 70± square foot
bathroom addition and a shower enclosure to its condominium unit.
The bathroom addition is located so as to be accessed from each
of the two bedrooms in the unit. The other condominium unit
owners have been notified of the proposed addition and have
consented to it.
5. The Board finds that the proposed alterations would not
be substantially more detrimental to the neighborhood- than the
existing non-conforming uses, and that the addition would not
alter the number of non-conforming dwellings on the lot.
6. Accordingly, by UNANIMOUS vote, the Board GRANTS the
requested SPECIAL PERMIT under Nantucket Zoning By-law ~ 139-
33.A.(4)(a) and (b) to allow for the construction of the project
as proposed, being an addition of 70± square feet and outdoor
shower enclosure.
