Box 133, Sherborn, MA 01770, Board of Appeals File No. 087-99, the Board made the following Decision: 1. Applicants are seeking a MODIFICATION of a SPECIAL PERMIT issued in a Decision in Board of Appeals File No. 053-99, in which an addition of about 300+ square feet was permitted, under Nantucket Zoning Bylaw §139-33E(2)(a), to be constructed onto the rear of the existing single-family dwelling increasing the ground cover ratio from 25.7%± to 33.7%+. Applicants now propose to construct an addition of about 330± square feet increasing the ground cover ratio to about 34.50%± while continuing to meet all setback requirements. The Premises is located at 9 BEAVER STREET, Assessor's Map 55.1.4, parcel 52, Plan Book 446, Page 88. The property is zoned Residential-Old-Historic as voted on at the 1999 Annual Town Meeting and changed from Residential-1. 2. The Decision is based upon the Application and materials submitted with it and the testimony and evidence presented at the hearing. The Planning Board made no recommendation as the matter was not of planning concern. There was one (1) letter on file in support and one (1) abutter spoke in favor of the proposal at the hearing. 3. Applicants represented that during the design process the plans for the renovation and addition were altered, with the ground cover of the addition increasing from 300+ square feet, for a total ground cover ratio of 33.7%±, to 330± square feet, for a total ground cover ratio of 34.50%+, to provide more living space in the currently 956+ square-foot single-family dwelling. The addition would continue to meet the required five-foot side and rear yard setbacks, being sited to the rear of the structure in substantially the same location as the previously permitted addition, and the existing parking space would be maintained. 4. Therefore, the Board finds that the total ground cover ratio of 34.50%+ would still be below the maximum of 50% allowed in this district, with a maximum of 30% being allowed for undersized lots such as the Locus without Special Permit relief from this Board. The Board further finds that there is an increase in the nonconforming ground cover ratio but said increase would not be substantially more detrimental to the neighborhood than the existing nonconformity and that the increase in ground cover ratio would be consistent with the character of the neighborhood which has a higher density of ground coverage in general. The 30+ square feet of additional ground cover requested would be de minimum and the Modification can be granted without public detriment with little impact on the area. 5. Accordingly, by a unanimous vote, the Board GRANTS the requested MODIFICATION of the SPECIAL PERMIT granted under Nantucket Zoning Bylaw §139-33E(2)(a) in the Decision in Board of Appeals File No. 053-99, to allow an increase in the ground cover ratio upon the following conditions, which shall supersede the conditions found in the Decision in BOA File No.053-99: a. The project shall be constructed in substantial conformance with the plan done by Charles W. Hart & Associates, Inc., dated May 26, 1999, revised June 2, 1999 and October 4, 1999, marked as Exhibit A and attached hereto; and b. The maximum ground cover ratio allowed under this Special Permit shall not exceed 34.50%+. Main Street, P.O. Box 133, Sherborn, MA 01770, Board of Appeals File No. 053-99, the Board made the following Decision: 1. Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw §139-33E(2)(a) (alteration/expansion of a pre-existing nonconforming structure/use) as amended at the 1999 Annual Town Meeting. Applicants propose to construct an approximately 300 square-foot addition onto the rear of the existing single-family dwelling, increasing the ground cover ratio from 25.7+~ to 33.7+g~. The addition will meet all setback requirements. The Locus is nonconforming as to lot size with the Lot containing 3,756+ square feet of area in a district that requires a minimum lot size of 5,000 square feet; as to frontage with the Lot having 45.92+ feet of frontage along Beaver Street in a district that requires a minimum frontage of 50 feet; and as to side yard setback with the structure being sited 1.1+ feet at its closest point from the westerly side yard lot line in a district that requires a minimum side yard setback of five (5) feet. The Premises is located at 9 BEAVER STREET, Assessor's Map 55.1.4, Parcel 52, Plan Book 446, Page 88. The property is zoned Residential-Old-Historic as voted on at the 1999 Annual Town Meeting and changed from Residential-1. 2. There were two (2) letters on file, one (1) in favor of the project and one (1) opposed to any changes to the structure. 3. The Applicants represented that they needed more living space as the existing structure was very small at 965+ square feet. The new 300± square foot addition would be constructed outside of the required five-foot side yard setback area and would be sited off the westerly rear portion of the existing single-family dwelling. The ground cover ratio would increase from 25.7+/ (965.29+ square feet) to 33.7+~/ (1265.77± square feet). 4. Therefore, the Board finds that total ground cover would still be below the maximum 50% allowed in this district, as changed from Residential-1 to Residential-Old-Historic at the 1999 Annual Town Meeting. Though, since it has a subminimum lot size, there is a limitation of 30~ ground coverage. However, the 1999 Annual Town Meeting approved Article 51 that provides the authority for the Zoning Board of Appeals to grant a Special Permit above the 30% limitation up to the permitted ground cover ratio for the ROH district of 50%. The Board finds that there is an increase in the nonconforming ground cover ratio but said increase would not be substantially more detrimental to the neighborhood than the existing nonconformity and that the increase in ground cover ratio would be consistent with the character of neighborhood which has a higher density of ground coverage in general. 5.
