AND MARY A. SCHMIDT, of P.O. Box 3139, Nantucket, MA 02584, Board of Appeals File No. 086-99, the Board made the following Decision: 1. Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw §139-33A (alteration/expansion of a pre-existing nonconforming use/structure). Applicants propose to expand a single-family dwelling by raising the roof height from 16'+ to 18'± within the easterly side/front yard setback area without coming any closer to that lot line than-the existing structure. An 8' x 6' addition will also be constructed, outside of the required setback areas, onto the westerly side of the structure and does not require relief from this Board. The addition will increase the ground cover ratio from 25.6± (667+ square feet) to 27.4%+ (715+ square feet) in a district that permits a maximum ground cover ratio of 30% for undersized lots. The Locus is nonconforming as to lot size with the Lot containing 2,613+ square feet of area in a district that requires a minimum lot size of 5,000 square feet; and as to front/side yard setback with the structure being sited at about zero feet from Codfish Park Road at its closest point in a district that requires a minimum front yard setback of ten (10) feet and a side yard setback of five (5) feet. The Premises is located at 7 BEACH STREET, SIASCONSET, Assessor's Map 73.1.3, Parcel 23, Land Court Plan 42880-A. The property is zoned Residential-l. 2. The Decision is based upon the Application and materials submitted with it and the testimony and evidence presented at the hearing. The Planning Board made no recommendation. There were no letters on file and no opposition expressed at the hearing. 3. Applicants represented that as part of a substantial renovation of an existing dilapidated single-family dwelling, the roof ridge height would be raised from about 16' to about 18' within the required five-foot side yard (or ten-foot front yard) setback area along Codfish Park Road, with`the dwelling being sited at 0.4+ feet from the easterly lot line. There would be no further intrusion into the setback as the work would be~done over the existing structure within the footprint area. As part of said renovation, an 8'± x 6'+ addition would be constructed outside of the setback areas and would meet all dimensional requirements. The maximum ground cover ratio would remain under the allowable 30% maximum at 27.4%±• Applicants have received a Certificate of Appropriateness No. 33,509 issued by the Historic District Commission for the work proposed. 4. Therefore, the Board finds that there would be an increase in the nonconforming nature of the structure as there would be an increase in height within the required setback area from the easterly lot line, but said increase would not be substantially more detrimental to the neighborhood than the existing nonconformity as the increase would be no closer and done within the existing footprint. 5. Accordingly,.by a unanimous vote, the Board GRANTS the requested relief by SPECIAL PERMIT under Nantucket Zoning Bylaw §139-33A to alter and extend a single-family dwelling by increasing the height of the structure as proposed without coming any closer to the easterly lot line, and notes that there would be another addition constructed that would be outside the purview of this-Board, upon the following condition: - The~work performed in relation to this Special Permit shall be done in substantial conformance with.-the Certificate of Appropriateness No. 33,509, as may be amended, issued by the Nantucket Historic District Commission.
