At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, November 12, 1999, at 1:00 P.M., in the Selectmen's Meeting Room, in the Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, the Board made the following decision on the application of KENNETH P. CROSS and JOAN K. BARR, c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts 02584, File No. 085-99: 2. The applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law X139-24.A(3) (Rate of Development). The applicants are asking that they be relieved from a residency covenant dated April 27, 1998, due to a change in personal circumstances. The subject property (the "Locus") is situated at 20 NEW LANE, Assessor's Map 41, Parcel 396.1, shown on plan recorded with Nantucket Deeds in Book 50-K as Lot 1, and is zoned as Residential-1. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. The Planning Board made no recommendation on the basis that the application presented no planning concern. There were letters in support from two physicians and three other private citizens, and two letters in opposition presented at the public hearing, which commenced on October 22, 1999, and was continued to November 12, 1999. At the continued hearing, three persons spoke in favor of the application, including Timothy J. Lepore, M.D. 4. The applicants executed a covenant pursuant to Nantucket Zoning By-law X139-24.A(3)(a) dated April 27, 1998, recorded with Nantucket Deeds in Book 572, Page 284, in order to obtain the exception from the Phased Development provisions of X139-24.A(1) which is provided for dwellings constructed by Nantucket domiciliaries under §139-24.A(3) That paragraph provides that such a covenant runs for a period of five years from the date of issuance of an occupancy permit for a dwelling constructed pursuant thereto, and that the covenant shall provide that the dwelling shall be used only as the year-round residence of a Nantucket resident and .not offered for seasonal rental so long as the covenant is in effect. §139-24.A(3)(c) provides that special permit relief from such a covenant may be granted by the Board of Appeals upon a finding that strict conformance with the covenant would impose an unreasonable personal or financial hardship upon the owner of the dwelling by reason of divorce, loss of employment, bankruptcy, loss of life, severe sickness or such other personal or financial hardship as the Board shall determine to be severe enough to warrant such relief. Persons granted such relief are disqualified from executing another such covenant for the unexpired period of the covenant from which relief is granted. 5. The applicant, Kenneth P. Cross, presented medical reports from C. Christian Briggs III, M.D. and Michael K. Ackland, M.D., and the testimony of Dr. Lepore, that as a result of osteomyelitis of the right sacral iliac joint, Mr. Cross has a permanent and ongoing medical condition, as a result of which he should not go up and down stairs and should live in a one-story dwelling. The dwelling which the applicants have constructed upon the Locus pursuant to the covenant is a two-story structure, with the bedrooms upstairs. This dwelling is now completed, but as of the date of the Board of Appeals meeting a Certificate of Occupancy had not been issued for it by the Nantucket Building Department. 6. Based upon the medical evidence presented at the public hearing, the Board of Appeals UNANIMOUSLY made the finding that strict conformance by the applicants with the covenant in this case would impose an unreasonable personal and financial hardship upon the applicants, by reason of Mr. Cross's medical condition, and GRANTED, by UNANIMOUS vote, the requested SPECIAL PERMIT under §139-24.A(3) (c) , relieving them from the provisions of the covenant, and noted that the By-law prohibits the applicants from executing another covenant under X139-24.A(3) for a period of five years following the issuance of the Certificate of Occupancy for the dwelling upon the Locus. Cross DOB: 3/12/53 September 10, 1999 To Whom It May Concern: This patient of mine, Ken Cross, was med-evacuated from Nantucket Cottage Hospital to Mass. General Hospital September 24, 1998 due to a staph infection in his blood. (See enclosed paperwork,.) His right hip has since developed both bone and muscle decay, limited mobility, and painful arthritis. In my medical opinion, it is not advisable for Mr. Cross to perform any activities that would aggravate this condition. Heavy lifting, climbing (whether it.be stairs or ladders), and prolonged standing should be avoided . Nantucket's damp climate will also accelerate his condition. CCB/gjb ~~, ' MA83ACHUSETT3 C3ENERAL.HOSPITAL v DZSCHARtiE 8T~RY Nom; CROSS, KENNETH UNIT NUMBER: 365-57-42 AD1QiSZON DATE: 09/24/1998 DISCHARGE DATE: 10/01/1998 PRINCIPAL DIAGNOSIS: Osteomyelitis of the right sacral iliac joint. { ~~ ,~~~.~ '~., a „. ~~•,: i r-~ HISTORY OF PRESENT ILLNESS: A 45-year-old man who was transferred from an outside hospital to Massachusetts General Hospital for back and thigh pain. He has a long history of low back pain that has been treated with nonsteroidal anti-inflan:natory medications by his Chiropractor. However, on a few days .. prior to admission he got up from his armchair and had the acute onset of low back pain mostly on the right aide radiating to his. right buttock and his lateral thigh. The pain improved slightly and he was able to walk a few blocks at a time. However d~iring the night he awoke from sleep with similar type of pain. He tried to relive the pain with Percocet unsuccessfully, and then went to Northwest Hospital because he was unable to walk secondary to the pain. The patient denied lower extremity weakness, incontinence, or difficulty urinating as well as history of trauma to that area. On arrival to the outside hospital his temperature was 103. Blood cultures were taken and antibiotics were started. Computerized tomography scan of his lumbar spine reported as negative, and he was transferred to Massachusetts General Hospital to rule out an epidural abscess. PAST MEDICAL HISTORY: He has had orthoscopic knee surgery. MEDICATIONS ON TRANSFER: Zinacef and analgesics. ALLERGIES: Morphine. FAMILY HISTORY: Noncontributory. SOCIAL HISTORY: He is married with three children. He is a painting contractor. He does not smoke but he does drink approximately four vodkas a day. REYIEiI OF 5YSTEM3: Noncontributory. PHYSICAL EXAMINATION: His blood pressure was 140/60, pulse 70, respiratory rate 14, temperature 99.8. He was in obvious discomfort and drowsy from analgesics. Head, eyes, ears, nose and throat exam was clear conjunctiva, 2+ carotid bruits, flat jugular venous pressure and dry mucous membranes. Cardiovascular exam: distant heart sounds, normal S1 and S2 with no murmurs, gallops or tuba. Lung exam was clear. The abdomen was soft, non-tender, nondistended without masses. Bowel sounds were present and normal active. Rectal exam was no anal tone without masses, quaiac negative. Neurological sxamination was alert and oriented x3 but drowsy. Cranial nerves were grossly intact. Upper and lower extremities strength was 5 out of 5 although he does have pain with right hig extension. Reflexes are 2+ throughout. His toes were downgoinq on the left and on the right were equivocal. Sensation was normal bilaterally in his lower extremities to light touch and pin prick. His back exam: he had no point tenderness although had received Demerol. LABORATORY DATA: From the outside hospital erythrocyte sedimentation rate was 51, ~rhite count 11.9 with 89 percent polys. Extended chemistries were unremarkable. Urinalysis revealed 5-10 white blood cells. White count on admission here was 7.4 with a hematocrit of 41.9 and platelet count 107. Blood Cultures were drawn. PT and FTT were normal. Electrocardiogzam was normal sinus tachycardia. Spine magnetic resonance imaging was negative. HOSPITAL COURSE AND TREATMENT: He had six blood culture bottles drawn on the day of admission and was placed on Vancomycin. The following day he had 4 out ~~ of 6 bottles growing a Oxacillin sensitive Staphylococcus Aureus. He subsequently had a tagged white blood cells scan which revealed a right sacral iliac osteomyelitis. Infectious Disease Service was consulted and Nafcillin was added to the Vancomycin on 9/25/98. They recommended a trans-thoracic echo to rule out vegetations which was done and there were no vegetations seen. An magnetic resonance imaging scan was done on September 30 to better evaluate the area surrounding the sacral iliac joint for additional ~. destruction and it revealed a septic arthritis of the SI joint with surrounding osteomyelitis. It was also seen a large iliopsoas muscle abscess as i+ell as a likely smaller abscess anterior and inferior to the SI joint. On that same day he went for an ultrasound guided aspiration o: the iliopsoas ~`~~'~ abscess and leas than 1 cc. was able to be withdrawn and this was sent for ~~' cultures. It was thought that magnetic resonance imaging is not very sensitive in distinguishing edema from fluid collections and probably the area seen on the iliopsoas area had some myositis with edema rather than a frank abscess. They recommend a computerized tomography scan in several days to furthez clarify if this is a more sensitive way to distinguish abscess from edema. Hia pain was controlled initially with patient controlled analgesia Dilaudid. He was switched over to a Durageaic patch and prn. Oxycontin and Oxycodone. On the day of discharge he said his pain was. adequately controlled ' ~ xith the Durageaic patch and he was needing very little additional pain medication. At the time of thin dictation, Orthopedic Service was being consulted as to the question of whether there needed to be any open debridement of-the area surrounding the sacral iliac joint. He has had.two negative blood cultures drawn on September 26 and 28. It is recommended that he complete a six week course of intravenous Nafcillin which will be arranged as an outpatient. CONDITION ON DISCHARGE: The patient's pain is well controlled. He is ' •:~-, afebrile and is much improved.
