At a Public Hearing of the Nantucket Zoning Board of Appeals
held at 12:00 P.M., Friday, October 22, 1999, in the Conference Room,
Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, on
the Application of RONALD W. AND ELLEN H. WINTERS, of 9 Meadow View
Drive, Nantucket, MA 02554, Board of Appeals File No. 084-99, the Board
made the following Decision:
1. Applicants are seeking relief by SPECIAL PERMIT under Nantucket
Zoning Bylaw §139-9B(2)(a), (b) and (c) in order to use a proposed new
1536+ square-foot building primarily for storage and warehousing
purposes in conjunction with Applicants' construction business located
on a separate lot. The Locus will also contain two (2) free standing
single-family dwellings.
The Premises is located at 6 ESSEX ROAD, Assessor's Map 67,
Parcel 598, deed Re~,r~neQ p~IGf~3c~-~ (~sq~~Oa-. The property is zoned
Residential-Commercial-2. 1`I
2. The Decision is based upon the Application and the materials
submitted with it and the testimony and evidence presented at the
hearing. The Planning Board made a favorable recommendation provided
that the driveway cut be reduced to about 16 feet. There was a letter
on file from the General Manager of the Wannacomet Water Company
stating that the proposed project would not have an adverse impact on
the groundwater quality. Two (2) neighbors were present to ask
questions but expressed no great concern.
3. Applicants propose to construct a 1536+ square-foot building at
the rear of the Lot that would be used primarily for storage and
warehousing in conjunction with Applicants' construction business that
is located on a nearby lot. Applicants stated that there would be
minimal actual construction activities taking place on the site. There
would be two (2) single-family dwellings also constructed forward of
the Lot. All dimensional, parking and loading zone requirements will be
met. Applicants further represented that the Locus was si-tuated in a
commercial zone with many mixed uses in the immediate area.
4. Therefore, the Board finds that the grant of relief under Bylaw
,....
§139-9B(2)(b) only, storage and warehousing, would be in harmony with
the general purpose and intent of the Zoning Bylaw. Due to the
residential character of a portion of the neighborhood the Board took
no action on the requested Special Permit relief under Zoning Bylaw
§139-9B(2)(a) and (c) allowing the Applicant to reapply for said relief
at a later date with adequate notice to the public.
5. Accordingly, by a UNANIMOUS vote, the Board GRANTS the SPECIAL
PERMIT relief under Zoning Bylaw §139-9B(2)(b) for storage and
warehousing upon the following conditions:
a. The relief granted under this Decision shall be particular
to Ronald and Ellen Winters without further relief from this Board;
b. The structure shall be constructed in substantial
conformance with the Certificate of Appropriateness No.3~f~~f8' issued
by the Nantucket Historic District Commission;
6. The Site Plan done by Charles W. Hart & Associates, Inc., dated
October 18, 1999, was approved under Nantucket Zoning Bylaw §139-23 by
a unanimous vote.

Virginia Perry at 20 Bartlett Road, Lot 5, Plan File 5~/-K, now with
frontage along Essex Road. The new Assessor's Map number is 67 with a

Dear Dirk,
I have reviewed a site plan of lots 7 & 8, Essex Road, prepared by Charles W.
Hart and Associates, Inc., dated September 7, 1999, for Ronald Winters and offer the
following.
1. The property is located within the Wellhead Rechazge District.
2. The existing stormwater drainage, treatment and rechazge system designed
and constructed to serve the entire Essex Road project was previously
approved by the Wannacomet Water Company.
3. The proposed buildings and use on lots 7 & 8 will not have a negative impact
on the existing Essex Road stormwater drainage, treatment and rechazge
system.
Therefore, I find that this project will not have an adverse impact on the
groundwater quality and is hereby approved by the Wannacomet Water Company
under § 139-12B(3)(a) of the Nantucket Zoning By-law.
