SILLIMAN, of 107 Argyle Avenue, W. Hartford, Ct 06107, Board of Appeals File No. 081-99, the Board made the following Decision: 1. Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw §139-33A (alteration/expansion of a pre-existing nonconforming structure/use). Applicant proposes to expand a said to be pre-existing single-family dwelling by constructing a second floor addition over the single-story rear portion of the structure without coming any closer to the side or rear yard lot line. The addition would be constructed entirely within the existing footprint of the dwelling. The Locus is nonconforming as to lot size with the Lot having about 1,750 square feet of lot area in a district that requires a minimum lot size of 5,000 square feet; as to frontage with the Lot having about 33.09 feet of frontage along Lyon Street in a district that requires a minimum of 50 feet; as to side and rear yard setbacks with the structure being sited at about 1.2 feet at its closest point from the easterly side yard lot line and about 1.1 feet at its closest point from the rear yard lot line in a district that requires a minimum side and rear yard setback of five (5) feet; and as to ground cover ratio with the Lot containing about 49% in a district that requires a maximum ground cover ratio of 30% for undersized lots without a Special Permit from this Board having been issued. The existing parking space shall be maintained. The Premises is located at 5 LYONS STREET, Assessor's Map 54.4.1, Parcel 10, with no plan on file. The property is zoned Residential-Old-Historic. 2. The Decision is based upon the Application and materials submitted with it and the testimony and evidence presented at the hearing. The Planning Board made no recommendation as the matter was not of planning concern. There was one (1) letter on file in favor and one (1) letter in opposition to the Application. No opposition was made at the hearing and one (1) immediate abutter spoke in favor of the proposed plan stating it would be an enhancement to the structure and neighborhood. 3. Applicant represented that the house and the existing nonconformities pre-dated the 1972 enactment of the Zoning Bylaw and were thus va;iidly grandfathered. Applicant proposed to construct a second-floor addition over a rear portion of the dwelling without coming any closer to .the rear or side yard lot line and without increasing the existing footprint, with all work to take place over existing portions of the structure. Certificate of Appropriateness No. 31,820 has been issued by the Nantucket Historic District Commission for the proposed work. 4. Therefore, the Board finds that there would be an increase in the nonconforming nature of the Locus with the upward expansion of the structure within the required five-foot side and rear yard setback areas, but also finds that said increase would not be substantially more detrimental to the neighborhood than the exiting nonconformities as the addition would not come any closer to those lot lines and there would be no increase in the ground cover ratio. 5. Accordingly, by a Unanimous vote, the Board GRANTS the requested SPECIAL PERMIT under Nantucket Zoning Bylaw §139-33A to alter and expand the structure as proposed upon the following condition: - The work shall be done Certificate of Appropriateness No. the Historic District Commission.
