Board of Appeals File No. 080-99, The Board made the following Decision:
1. Applicant is seeking a MODIFICATION of a DECISION in Board of Appeals File
No. 047-87 which allowed conversion of a portion of the existing single-family dwelling to
be converted into commercial use subject to several conditions. Application now proposes to
eliminate the commercial retail use with the required four (4) parking spaces and loading-
zone to, in turn, be eliminated. In addition, Applicant is asking the Board to waive the
condition that no more than three (3) room renters be allowed on-site. Applicant further
proposes to expand the ground cover by approximately eighteen (18') square feet outside of
the required five foot setback to add a bathroom. Two (2) dormers will also be constructed
outside of the required setback areas within the existing footprint of the structure. The Locus
is non-conforming as to lot size the Lot having a lot area of about 4,500 square feet in a
district that requires a minimum lot size of 5,000 square feet; and as to side yard set back
with the dwelling being sited about 3.8 feet at its closest point from the easterly side yard lot
line and at about 1.7 feet at its closest point from the westerly side yard lot line in a district
that requires a minimum side yard set back of five (5) feet. With the addition of the eighteen
square feet, the ground cover ratio would not exceed the allowed maximum of 30% for
undersized lots.
The Premises is located at 7 North Beach Street, Assessor's Map 42.4.1, Parcel 93,
Plan Book 6, Page 49, Lot 5. The lot is zoned Limited-Commercial.
2. The Decision is based upon the Application and materials presented with it and the
testimony and evidence presented at the hearing on September 10, 1999. The Planning Board
recommendation stated that the Planning Board was not concerned with the elimination of the
commercial use to create a strictly residential use. Therefore, the project would not be in
conflict with the character of the neighborhood. However, the Planning Board did
recommend that sufficient parking be provided for the project. There were no letters from
abutters either in favor of or against the project. An abutter attended the public hearing and
spoke in favor of the proposal. A second abutter spoke in opposition to any commercial use
as well as any increase in ground cover.
3. The Applicant and his counsel explained that the Special Permit decision in Board of
Appeals File No. 047-87 allowed the conversion of a portion of the existing single family
dwelling into a commercial use with certain conditions. Those conditions included the
requirement of four off-street parking spaces and a loading zone and limited the number of
rental rooms on the premises to no more than three (3) rooms total. Applicant explained that
a residential use, given the character of the neighborhood, would be more appropriate.
Applicant testified that other renovation construction is proposed for the Premises but will be
outside of the yard setbacks and conform with all dimensional requirements.
4. Therefore, the Board finds that the MODIFICATION as requested for the proposed
elimination of the permitted commercial use and the elimination of the restriction of the
number of room renters allowed on site is in keeping with the harmony and purpose of the
Zoning regulations and will not be substantially more detrimental to the neighborhood than
the use permitted in Board of Appeals File No. 047-87.
5. Accordingly, by an UNANIMOUS vote, the Board granted the relief as requested to
MODIFY the Decision found in Board of Appeals File No. 047-87 upon the following
conditions:
a) All existing parking on the Premises will be maintained at a minimum of five
spaces;
b) The proposed addition to the Premises shall be constructed in substantially
conformance with Certificates of Appropriateness Nos. 33,416 and 33,582, as may be
amended from time to time, issued by the Nantucket Historic District Commission;
and
c) All uses on the Premises shall be residential uses only.

ADDENDUM "A"
The Applicant, John Arno, Inc. (hereinafter "ARNO"), owns atwo-story dwelling
located at 7 North Beach Street in Nantucket. The Lot is non-conforming with respect to
minimum lot size and side line set back requirements. The Zoning By-Law requires that lots
in the Limited Commercial Zoning District be at least 5,000 square feet in size with five (5')
foot side line set backs. The ARNO lot has 4,500 square feet and the dwelling on the ARNO
lot is 1.7 feet from the westerly side line and 3.9 feet from the easterly side line. The
dwelling has a ground cover of 1,305 square feet (29%). The maximum allowable ground
cover is 1,350 square feet (30%).
In 1987, this Board granted ARNO a Special Permit (No. 047-87) to convert a
portion of the dwelling to commercial use (retail sales) upon certain conditions, including the
provision of four (4) off-street parking spaces, a loading zone, and no more than three (3)
rental rooms. ARNO seeks a Modification of Special Permit No. 047-87 to eliminate the
commercial use on the property, to eliminate the requirement for four (4) off-street parking
spaces and a loading zone, to eliminate the prohibition on no more than three (3) room
renters, to allow a ground cover expansion of eighteen (18) square feet to accommodate a
new bathroom, and to allow for roof work and the construction of dormers within the
existing footprint of the house. The Nantucket Historic District Commission has approved
plans for the project (Cert. No. 33582; February 9, 1999).
The requested Special Permit modification will be in harmony with intent and
purpose of the Zoning By-Law because the commercial use of the Premises will be
eliminated. The proposed bathroom and roof work is modest in nature and not substantially
more detrimental to the North Beach Street neighborhood than the mixed use of the property.
ARNO asks that this Board modify Special Permit No. 047-87 set forth herein.

DECISION:
The BOARD OF APPEALS, at a Public Hearing held on MONDAY, JUNE 1,
1987 at 1:30 p.m. in the Town and County Building, Nantucket, made the
following decision upon the Application of JOHN ARNO, INC. (047-87) address
30 Woodlane Road, Lawrenceville, NJ 08648.
1. Applicant seeks a SPECIAL PERMIT under Zoning By-Law SECTION
139-11B(3) to use an existing 450 SF single-story structure ("cottage")
attached to a two-story single-family residence as retail sales space for
gourmet items prepared and packaged off-premises to be sold for off-site
coxi.sumption. Applicant proposes to provide a sidewalk along North Beach
Street and the required parking spaces off Cornish Street. The premises are
located at 7 NORTH BEACH STREET, Assessor's Parcel 42.4.1-093, Plan Book 6,
Page 49, Lot 5, and zoned LIMITED COMMERCIAL.
2. The notice of hearing identified further relief which Applicant
might wish, not specified in the Application, namely, a Special Permit under
Section 139-33A (pre-existing,non-conforming uses, structures) and a Variance
from the Section 139-19 requirement of an off-street loading facility (14
by 35 feet) for the retail business function.
3. Our findings are based upon the Application papers, correspondence,
documents submitted by Applicant at our hearings of April 10, May 1 and June
1, 1987, including plot plan dated 10/2/86 marked our "Exhibit A", together
with viewings, photos, testimony and representations. Reference is made to
Applicant's earlier 005-84 request for a two-story, 216 SF footprint addif-
tion extending in front of the cottage for take-out ice cream establishment
and for variance from 5000 SF minimum lot size, in which relief was denied.
See also copending Nyren Applications 037-87 and 056-87 concerning a proposed
retail use at 3 North Beach Street to the southeast one lot from the premises.
4. Applicant represents that the lot pre-dates mid-1972 zoning, also
the present dwelling and 85 SF shed spaced to the northeast. Accordingly,
the allowable ground cover ratio for the 4500 SF lot is 30% (not 50% as shown
(047-87) -2-
on Exhibit A). New Section 139-16F requires 20% open area. Lack of proper
S-foot side-yard setbacks and required off-street parking space makes the
present structure and use non-conforming. That use consists of occupancy of
the dwelling by Colleen Hofer, the mother-in-law of Applicant's principal
John Arno and the proposed proprietor of the store, the John Arno family
and rental of two rooms with their combined occupancy not exceeding 3 persons
(hence, not more than 4 unrelated people, total). The cottage contains a
bedroom3sitfing room and bath. Applicant represents that the cottage is not
currently in use and that no employer dormitory use has been created. (We
note that the dwelling was modified per building application 2690-83,
barring occupancy of a third-floor. The ground cover stated there was
767 SF for the dwelling.)
5. Exhibit A shows the one-story cottage space attached to the north-
west of the house and set back from its front building line. Across the _ ~"
width of the property along the front lot line is a S-foot wide brick
sidewalk. Extending into the lot from Cornish Street are 4 proposed off-
street parking spaces per Section 139-18C, two on either side of an off-
street loading area - see Section 139-19. The existing hedge along Cornish
Street is to be removed, also the shed.
6. We are told that a commercial employer-dormitory use exists across
Cornish Street and guest house use across North Beach Street. On the ad-
jacent lot to the southwest, 5 North Beach Street, is a residential use by
a party opposing Applicant here, then at No. 3 the guest house use of Nyren,
see 037-87 and 056-87. To the northwest is the Comer lot No.9 of Flemming
with residential and real estate agency use, then Swain Street and, across
it, a proposed mixed commercial and residential use, see Silva 073-87.
_, 7. The primary and indispensable factors in our favorable considera-
tion of relief are traffic and pedestrian safety along North Beach Street,
the artery to Jetties Beach, and emergency vehicle access along Cornish
Street. Testimony of police officex Day and Fire Chief Watts plus the
S/17/87 letter from the Traffic Safety Committee, make imperative that relief
be conditioned on prior existence of a sidewalk from Easton Street to
Swain Street along the northwast side of the street line of North Beach

Street, including Applicant's frontage. Any off-street parking required
should, for such safety reasons, be along Cornish Street, in effect replacing
on-street parking now allowed only on the southwest side of Cornish Street
and there contributing to frequent blocking of emergency vehicles during the
summer season. Assuming that the loading area is not deemed a fifth off-
street parking space, Applicant would not be subject to the Section 139-18F
(1)(a) bar against backing into a street.
8. Unless both the full North Beach Street sidewalk and the required
parking off Cornish Street are available before any retail use of the 450
SF cottage space, at least two members of this Board would emote to deny all
of the relief requested as more detrimental to the neighborhood and contrary
to the general purpose and intent of the zoning chapter. At present, the
immediate neighborhood is in residential-type use, commercial and private,
and a significant number of neighbors want it to remain so.
9. We find that the proposed use of the 450 SF cottage space for
low-intensity retail sales of gourmet food items would be in harmony with
the general purpose and intent of the zoning chapter upon the following
conditions:
(1) The present 5-foot wide brick sidewalk extending around the
corner of Easton Street and North Beach Street, shall continue along the
northeast side of the North Beach Street line from Easton Street to Swain
Street, whether provided by Applicant alone or with others; ('tdhere ,5~et widi~

conformity with the Exhibit "A" plot plan, removing the existing shed;
(3) There shall be no structural e~.largement on the locus;
(4) The commercial area of 450 SF will be operated by Colleen
Hofer, alone, and relief is particular to her as well as the use stated
above;

(5) The single-family use shall remain with no more than 3
-room renters(~o employer dormitory with out further relief from this Board
(6) There shall be no food establishment use of the premises;
(7) All deliveries shall be from Cornish Street, not North
Beach Street.
10. The further relief asked added by our notice beyond that original-
ly applied for, is considered not properly before us and, in any event,
substantially met by our grant of Special Permit relief under Section
139-11B(3). The Planning Board recommended our favorable action.
11. Accordingly, by UNANIMOUS vote, this Board GRANTS to Applicant
the requested SPECIAL PERMIT under SECTION 139-11B(3), subject to the listed
conditions as ncate~l above.

DECISION:
At a meeting of the BOARD OF APPEALS held on Friday, January 27,
1984 in the Town and County Building in the matter of the
Application of JOHN B. & COLEEN J. ARNO (005-84) the
BOARD finds:
1. This is an Application for relief by SPECIAL PERMIT for
a take-out ice cream establishment in a district zoned
LIMITED COMMERCIAL. In such districts, Section 4E(2)(c) and
(e) allow uses by Special Permit for retail businesses and
restaurants, respectively. Relief is also sought from the
intensity regulations of Section 5 of the Zoning By-Law.
2. Based upon a review of the Application, supporting documents
