Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw §139-33A {alterationlexpansion of apre-existing nonconforming structure/use). Applicants propose to expand a said to be pre-existing single-family dwelling in an upwardly direction within the easterly side yard setback area without coming any closer to that lot fine than the existing structure. There is no increase in ground cover proposed. The property is non-conforming as to lot area with the Lot Containing 2,100 +/- square feet of area in a district that requires a minimum lot size of 5,000 square feet; as to frontage with the Lot having a frontage of less than the required 50 feet; as to setback with the structure being sited at zero feet at its closest point from the easterly side yard lot line in a district that requires a minimum side yard setback of five {5) feet; as to front yard setback with the front stoop extending over the front yard lot line into the Town of Nantucket Sidewalk layout; as to parking with no space apparently .provided on site; and as to ground cover ratio with the Lot containing in excess of 50% in a district that allows a maximum ground cover ratio of 30°k for undersized loin. The premises is located at 12 Darling Street, Assessor's Map 42.3.2, Parcel 115, with no plan on file. The property is zoned Residential-Old-Historic. 2. The Planning Board made no recommendation, as the matter was not of planning concern. 3. The decision is based upon the Application and the material submitted with it and the testimony and evidence presented at the hearing. There were numerous people speaking in favor of the application as well as one, (1}person who spoke against it. There were several letters on file. Two, {2} fetters were in favor of the application and one, (1) was opposed. One, (1) abutter was in opposition and was represented by counsel at the hearing. This opposing abutter represented to the Board, through counsel, concerns that the project as proposed would change the nature of the neighbofiood, would interfere with her air and light and would destabilize or otherwise interfere with her use and enjoyment of her lot. 10f 13!1999 17: 25 50o2297b52 PETER U K.YBUR~a E'~i=! F'AiaE 02 4. Applicants, through counsel, presented photos of the inside and outside of the premises that showed the condition and age of the house. The house was originally built around 1850, and has not been renovated since at least 1940. Plans were displayed showing the areas of the house to be replaced, and those to be renovated, as well as the proposed finished plans of the house, both interior and exterior. It was noted that the project as proposed is a renovation, not a demolition and reconstruction. Both the Historic District Commission Certificate Numbers 33880 and, 34645 and the Building Department application confirmed this. The proposed renovation would preserve the integrity of the house as well as its historic character. The proposed alterations to the outside of the house are minor and take into account the appropriateness of the house to the neighborhood. A GIS map of the neighborhood, coupled with the Town of Nantucket Assessor's information showed that the house is one (1) of, if not, the smallest in the immediate neighborhood, both in footprint, having 1.260 plus or minus square feet, and in lot area having a sub minimum lot area of 3,113 plus or minus square feet. The Applicant represented that the actual increase in height proposed within the easterly side yard setback area was de minims being only 3.5 plus or minus feet, and that it would have very little or no effect on the immediate abutters or the neighborhood as a whole. The Applicant also represented that there would be very little work pertormed on the easterly side of the structure where the opposing abutter resides with the exception of the increase in height. The easterly wall will be left as it exists as will the existing foundation on the easterly side, with work being done only inside the house, with the exception of approximately six feet of new foundation being installed on the southerly side of the easterly wall. The purpose of the project is simply to provide the Applicants' more headroom . in the second floor bedroom. 5. Therefore, the Board finds that the proposed project would increase the existing nonconformity of the structure by expanding the structure in the setback in an upward direction, but would not be substantially more detrimental to the neighborhood than the existing nonconformity and would have little impact upon the surrounding area because the proposed structure will not come any closer to the easterly lot line than the existing structure, and the use proposed is the same as the existing use. 6. Accordingly, the Board, by a unanimous vote, GRANTS the requested relief by SPECIAL PERMIT under Nantucket Zoning Bylaw §139-33A to alter and expand the existing structure by constructing a second floor as proposed, and to otherwise renovate the structure under the following condition: the addition shall be constructed in substantial conformance with Certificate of Appropriateness Numbers 33880 and, 34645, issued by the Historic District Commission. 1 k3/ 13/ 1999 17:25 5©81G~ 7 ~ 52 PETER L? Today I was informed that Mr. Hourihan has a conflict of interest that he identified last night, leaving us with an incomplete Board, hence this request.
