Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw §139-16C(2) to validate a said to be unintentional setback intrusion of about six (6) inches into the 20-foot required easterly side yard setback area. The subject deck/porch was constructed in 1981. The Premises is located at 343 POLPIS ROAD, Assessor's Map 002, Parcel 19, Land Court Plan No. 7300-2, Lot 28. The property is zoned Limited-Use-General. 2. The Decision is based upon the Application and materials submitted with it and the testimony and evidence presented at the hearing. The Planning Board made no recommendation as the matter was not of planning concern. There was one (1) letter on file in support. 3. Applicants represented that the deck intrusion into the required 20-foot easterly side yard setback area of six (6) inches was unintentional and resulted from a squaring off of the deck during construction. The original plan indicated that the subject corner of the deck would be angulated which would eliminate the intrusion. There is a screened in porch in that location currently and could cause hardship should the Applicants be required to remove the offending section of deck/porch. This portion of the single-family dwelling is protected from enforcement by the curative statute as it has existed for a period exceeding ten (10) years. As the structure is located to the interior of the large 143,773+ square-foot lot and bordered by conservation land to the east, Applicants further represented that the intrusion would have little impact on any abutting property. 4. Therefore, the Board finds that the intrusion is de minimus, and a grant of Special Permit relief would be in harmony with the general purpose and intent of the Zoning Bylaw and the burden of correcting the intrusion would substantially outweigh any benefit to an abutter and would not be a detriment to the public good. The Board also finds that a grant of Special Permit relief can be made j~n.this case ~o validate the unintentional..,setback intrusion as said intrusion was not greater than five (5) feet into a the required 20-foot yard, being about six (6) inches, and not closer than four (4) feet, being sited about 19.5 feet from the easterly lot line, and was so sited prior to 1990. 5. Accordingly, by a unanimous vote, the Board GRANTS the requested SPECIAL PERMIT under Nantucket Zoning Bylaw §139-16C(2) to validate the existing siting of the structure/decks/porches upon the following condition: - There shall be no further construction within the 20-foot easterly side yard lot area.
