Weinman, Attorney P.O.Box 1365 Nantucket, MA 02554 Re: Abrams Point Dear Rhoda: I have reviewed your leter along with the accompanying documents and also reviewed the sections of the Bylaw a$ outlined in the letter from Tobey Leske, Chairman of SHAB. r I agree with your position that Section 139-22B does not apply to this project at all but to new construction where a new dock or pier is being proposed. Since this is reconstruction, this is not what the intent of this section is and it does not apply. Further, I reviewed Section 139-33C, and I do not feel that this section is applicable either since this section applies only to pre-existing, non-conforming structures and I do not believe this is the situation here since this dock was not non-conforming since it had all the appropriate permits and licenses in place. I asked you at that time if Section 139-33 of the Bylaw was applicable to this project. You advised me at that time that this Bylaw applied only to new construction and, since there had been an existing dock for many years, this Bylaw was not applicable. My clients closed on this property shortly after our meeting and proceeded with their building plans. As you may recall, there were building permits in place for a main dwelling and cottage and an Order of Conditions dated August 1, 1996 which clearly spelled out the conditions specific to the Pier and Float, a copy of which I attach herewith. There is also a License in plof which Italso attach heretohwhi hahad beentin for the bulkhead, pier and dock, a copy existence since 1953. Under Chapter 91, we are required to file an application with the DEP for the reconstruction of a previously licensed pile supported pier, ramp, float and piles. This application was submitted to the DEP on March 8, 1999 and a notice in the Inquirer Mirror ran in the March 18, 1999 edition. The DEP gave written notice of this application to the Town Boards, Committees and Commission. As a result of this v which was from SHAB, a copy of which is enclosed ~ notice, there was one response, ~ herewith. As you can see from the letter, two issues are raised relative to th ohib'ting Bylaw. It has long been the the Harbor and Shellfish Advisory Board's position that docks and piers are detrimental to the eel grass beds and benthic communities, and that they cause the degradation and eventual destruction of these habitats through shading. In addition, the fairways created by boat travel to and from these piers also has a severe negative impact on the eel grass beds creating channels through the beds in which the eel grass cannot grow. Nantucket is currently experiencing an alarming loss of shellfish habitat and further unnecessary or controllable loss cannot be tolerated. To address this issue of habitat loss, in 1992, a moratorium on the construction of docks and piers outside of the waters directly adjacent to the downtown area was passed at Town Meeting. This moratorium was continued by a Town Meeting vote in 1995, and in 1998, was made permanent(Ch. 139-22, subsection B). In addition, the Zoning Bylaws specifically state that any non-conforming structures which have been abandoned or not used for 3 years may not be rebuilt(Ch 139-33, Section B, Subsection C). It is quite obvious from the condition of the structure that is has not been used for well over three years. This application is in obvious and direct conflict with the Zoning Bylaws and the will of the people of Nantucket and should not approved under any circumstances.
