A Public Hearing of the NANTUCKET ZONING .BOARD OF APPEALS will
be held at 1:00 P.M., FRIDAY, AIIGIIST 13, 1999, in the Conference Room,
Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, on
the Application of the following:

CONTRACT PURCHASER OF CORPORATE SHARES

Applicant (Lecain) is seeking relief by SPECIAL PERMIT under
Nantucket Zoning Bylaw §139-33A (alteration/expansion of a pre-existing
nonconforming structure/use). Applicant proposes to convert the
commercial use of the first floor of a said to be pre-existing structure
from one (1) retail store into three (3) separate retail units without
expanding the footprint o€ the building. The inventory storage use in
the basement and the second~hird floor dwelling unit and third floor
attic space will not be alte~ed under this Application. In addition,
Applicant is seeking relief by SPECIAL PERMIT-under Nantucket Zoning
Bylaw §139-18 to waive any additional parking spaces required by the
conversion and to the extent neFessary under §139-20 to waive any
additional loading zone requirements. The Locus is nonconforming as to
setbacks, ground cover, lot size, frontage, parking and loading zone
requirements.
The Premises is located at 46 CENTRE STREET, Assessor's Map
42.3.1, Parcel 2, Plan Book 117, Page 522. The property is zoned
Residential-Commercial.

ADDENDUM TO APPLICATION
Seven Seas Gifts, Inc.
The Applicant is the contract purchaser of all of the shares of Seven Seas
Gifts, Inc. The present shareholder of the corporation has owned the property
located at 46 Centre Street since 1958. The property is located in the Residential
Commercial zoning district and the Core District on the Nantucket Parking
District Map. The building on the lot is pre-existing, nonconforming as to
setbacks and ground cover. There has never been any off-street parking or
loading facilities provided.
Since its ownership, the corporation has used the structure for retail on the
first floor and inventory storage in the basement and third floor attic. The
second and third floors are used as one residential apartment. To the extent
necessary, the Applicant seeks a Special Permit under Nantucket Zoning By-law
Section 139-33A to permit the retail use on the first floor to be converted from
one retail unit to three separate retail units. There will be no change to the uses
in the basement and upper floors.
The Applicant also requests a special permit to waive additional parking
spaces pursuant to Section 139-18(B) and off-street loading facilities pursuant to
Section 139-20(C), if triggered by the change of use of the first floor of the
property from one retail unit to three retail units.

Dear Linda:
Enclosed is an application for zoning relief for my client Linda Lecain, the
contract purchaser of all of the corporate shares of the Seven Seas Gifts, Inc.
corporation, owner of 46 Centre Street, four copies of the application, a set of
existing floor plans, a set of proposed floor plans, and a check payable in the
Town in the amount of $200.

PARKING ANALYSIS
The Seven Seas Gifts, Inc.
Pursuant to Nantucket Zoning Bylaw Section 139-18(D), retail uses require
one parking space for each 200 square feet of gross floor area, plus one parking space
for each three employees or workers on peak shift. According to the print prepared
by Nantucket Surveyors, Inc., the approximate gross floor of the first floor used for
retail display is 2,760 square feet, requiring fourteen parking spaces. Based on the
Applicant's best information, the gift shop has employed six workers at peak shift,
requiring two additional parking spaces. The residential apartment requires one
parking space, and the storage areas of approximately 2,080 square feet require two
parking spaces, one parking space for each nine hundred square feet of storage. All
of these uses have existed in the building since before 1972. Based on all of the
existing uses, the property is validly grandfathered for nineteen parking spaces.
The Applicant proposes to convert the first floor from a single retail unit to
three retail units. The residential apartment and storage areas will not change. If
calculated based on the overall floor area, the retail area on the first floor will be
approximately 2,702 (58 square feet of retail floor spaces would be converted to a
bathroom and common hallway), requiring fourteen parking spaces. Each unit will
employ 1 to 3 employees at peak shift, requiring three parking spaces. Including the
three parking spaces required for the residential apartment and storage areas, the
converted use requires a total of twenty parking spaces. Using this formula, the
Applicant requests a waiver of the one additional parking space required.
If calculated on a unit basis, the first unit will have an approximate gross floor
area of 819 square feet, requiring four parking spaces, plus one parking space for its
employees. The second unit will have an approximate gross floor area of 1,235
square feet, requiring six parking spaces, plus one parking space for its employees.
The third unit will have an approximate gross floor area of 647 feet, requiring three
parking spaces, plus one parking space for its employees. On a unit basis, the three
retail unit with a residential apartment and storage areas requires nineteen off-street
parking spaces, and no waiver of off-street parking is required.
The structure and surrounding sidewalks cover nearly all of the property
along the street boundaries, and based on the location of the structure, providing any
off-street parking spaces or loading facilities would be physically impossible.
Because the structure can be readily serviced by the public loading spaces already
established for the many retail businesses in the Center Street area, granting the
requested loading facility relief is not contrary to sound traffic, parking or safety
considerations.
