At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, August 13,1999, at 1:00 P.M., in the Conference Room in the Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, the Board made the following decision on the application (072-99) of 49A PLEASANT STREET LLC, in connection with the property known as 49A Pleasant Street, Nantucket, Massachusetts. 2. Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law, Section 139-33(A) (alteration/expansion of a pre- existing nonconforming structure/use). Applicant proposes to construct a full basement for storage purposes under the pre-existing commercial structure without any expansion of the footprint. There may be an increase in the massing of the structure within the required ten-foot front yard setback area and within the northerly required five-foot side yard setback area due to the raising of the structure with the addition of the new basement foundation. The basement area would be used solely for ancillary storage of goods and materials with no change in the existing commercial space requested under this Application. In addition, and only to the extent necessary, it is requested that the Board's prior Decisions be modified so as to allow the basement storage area to be constructed and used in a manner that is ancillary to the existing uses. Relief is also requested by SPECIAL PERMIT under Zoning By-law Section 139-18 to waive the additional three (3) parking spaces required for the basement space. In the alternative, Applicant is seeking relief by VARIANCE under Nantucket Zoning By-law Section 139-16A to complete the project as proposed. See also BOA File Nos.108- 88, 040-85, 033-91, 070-85 and 116-85. The Premises is located at 49A PLEASANT STREET, Assessor's Map 55, Parcel 191. The property is zoned Residential-1. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. The Planning Board recommendation was that in consideration of the waiver of parking spaces, the Applicants be required to provide up to three employees with NRTA season passes, and to include in their promotional material the advocacy of the use of alternative means of transportation, particularly the NRTA shuttle. Two letters of support for the application and one letter of opposition were received prior to the hearing, and there was no opposition presented at the public hearing. 4. The Applicants propose to construct a full basement for storage purposes under the existing validly pre-existing nonconforming structure. This new foundation may result in the building being raised slightly. The Applicants agreed that all foundation work would be conducted during the time period between November 30~ and March 15~ so as to minimize the disruption of traffic on the public street during construction. Alterations to the steps that provide access to the retail space and are located within the front yard setback may be required so as to comply with the Building Code. 5. In 1985 the Board granted relief by Variance to regularize the existing lot's non-conformity (see BOA File No. 040-85) by exempting it from the intensity regulations of the Zoning By-law with respect to the lot's size, and the structure's ground cover and setbacks. The structure and its non-conforming use as a retail store validly pre-date zoning. Further relief by Variance is not required, but alterations that will change the use of the structure do require relief by Special Permit under Section 139-33A. Alterations to the use of the store have been the subject of several BOA hearings. In the appeal of the Board's decision in BOA File No. 015-86, the Court's Order and Agreement for Judgment granted a Special Permit to allow the addition of kitchen facilities subject to certain conditions. These conditions to the Special Permit have been modified (see BOA File No. 108-88) and clarified (see Clarification dated March 19,199 over time. The prior decisions establish among other things that the display area of the premises is limited to 660 square feet and no request has been made to alter that or any other restriction or condition. 5. The prior decisions also establish that the premises are serviced by two on-site non-conforming parking spaces, and that the premises are grandfathered for twelve parking spaces. This parking requirement has been calculated as follows: Existing Footprint is 2040 sq. ft. with: Take out food establishment 660 sq. ft. as retail floor area, less than 200 square feet as office use ancillary to the store, and the rest (1180 sq. ft.)1St floor storage and food prep areas. Employees on a peak shift = 7. Total: Current parking requirements: 5 3 1 1 _ 2 12 2 The requirement in Section 139-18 is that parking be provided at a rate of one space for every 900 square feet of gross floor area of storage space. However, the definition of gross floor area in the Zoning By-law excludes "basement and cellar areas devoted exclusively to uses accessory to the operation of the structure'. Accordingly the Board finds that no additional parking requirements are triggered provided the new basement is used solely for storage ancillary to the previously permitted uses the parking requirements for which the premises are validly grandfathered. 6. The Board finds that the increased on-site storage capacity as a result of the new basement will decrease the number of deliveries each week, alleviating traffic concerns with respect to both parking and loading. The limitation on the retail display space from the prior Decisions protects the neighborhood against an incremental expansion of the commercial use of the premises. 7. Accordingly, the Board of Appeals voted UNANIMOUSLY to grant the requested SPECIAL PERMIT under Section 139-33A to permit the construction of the new basement space, and the alterations to the structure required thereby, on the following conditions: (a) The height of the building may be increased no more than eight (8) inches above its pre-construction elevation, (b) All foundation construction activity shall be limited to between November 30~ and March 15~ of any given year, (c) There shall be no expansion of the retail space that is open to the public beyond the 660 square feet allowed under prior decisions of the Board, and (d) The use of the basement shall be restricted to storage uses that are ancillary to the existing uses of the building. 8,1999 ~ Dated: ember - 'chael O'Mara o., ~`~ Edward J. The existing structure is validly pre-existing and non-conforming as to ground cover and setback as shown on the attached plot plan prepared by Charles W. Hart & Associates. No additional ground cover is proposed and the structure will not be expanded within the setbacks except to the extent that the new foundation may raise the height of the building slightly. The use of the property is also validly pre-existing and conforming, as discussed in the prior zoning decisions for this property. No change is the use of the existing commercial space is requested. The basement storage area will be used solely for ancillary storage of goods and materials, and triggers a requirement under the By-law of an additional three parking spaces. No additional parking can be provided on the property and therefore relief from the off-street parking requirements is requested.
