The Platuting Board made no recommendation as the matter was not of planning concern. There were no letters wt file nor opposition expres`ed ;tt the hearing. 3. Applicants, through counsel, represented that the purpose of the Special Permit relief was tc~ increase the ground cower ratio of the locus from 38.8+ ~7o to 42.9+% by enclosing approxirriatcly 182± square feet of ari existing rear deck antler and directly below an existing second flour balcony. Applicant further acknowledges that the Proposed enlargement of the dwelling requires provision of an off-street parking space for the existing building when enlarged as if it were newly constructed, pursuant to Section 139-1ttA(1) of the by-Law. Applicant states that spec-existing, non-conforrning off-street parking space nn the Premises is presently used and will continue to he maintained. 4. Therefore, the Board finds that enclosing the deck as proposed increases the non-c~nforniing ground cover. However, the Berard iitrther finds [hat, as the described work is proposed within the existing massing of the dwelling, said increase in ground cover is not substantially more detrimental to the neighborhood than the existing, nvn-confc~rnling gri,un~i c:c~ver. Levine and Lauren B. Leichtman, Trustees of the Capital Partners Realty Trust, seek a SPECIAL PERMIT pursuant to Section 139-33E(2)(a) of the Nantucket Zoning By-law (the "By-law") and Massachusetts General Laws Chapter 40A, Section 6. The Applicants are requesting the SPECIAL PERMIT to enclose a portion of the rear first floor deck located on the westerly side of the Premises. The dwelling is located at 5 Pleasant Street (the "Premises"). The Premises is located in the Residential Old Historic District. The Premises consists of a lot of land approximately 4,404 square feet in size as improved by a three-story single-family dwelling. The lot of land is non- conforming as to lot size being situated in a Zoning District with a minimum lot size of 5,000 square feet. The Premises is non-conforming as to side yard setback being 0.07 feet, at its closest point, from the southernmost property line in a Zoning District with a minimum side yard setback requirement of five (5) feet. The Premises is non-conforming as to ground cover ratio having a ground cover of approximately 39% in a Zoning District that allows 30% ground cover for lots containing less than 5,000 square feet. The Premises is non-contormmg as to frontage having a frontage of 49.06 feet on Pleasant Street in a Zoning District with a minimum frontage requirement of fifty (50) feet. The Premises is non-conforming as to front yard setback with a stoop encroaching, at its greatest point, 0.16 feet on to Pleasant Street in a Zoning District with a front yard setback requirement of zero (0) feet. The Premises is non-conforming as to height, being higher than thirty (30) feet in excess of the height limitations of By- law Section 139-17. The Applicants propose to enclose a portion of the rear first floor deck located on the westerly side of the Premises. Presently, the open deck is not factored into the calculation for ground cover ratio as it is an "....unenclosed porch not over or under an enclosed space....". Applicants now wish to increase the calculated ground cover from 1,709 square feet presently existing to 1,891 square feet by enclosing the first floor deck as a new screened porch with a dimension of 13+/- feet by 14+/- feet (182+/- square feet). This will result in aground cover ratio of approximately 42.9% in a Zoning District that allows SO% ground cover ratio for lots with square footage of less than 5,000 square feet by SPECIAL PERMIT from the Nantucket Board of Appeals. The proposed enclosing of an existing open deck and the consequent increase in ground cover ratio from 38.8% to 42.9% is consistent with other Premises in the neighborhood, and as a result, is not substantially more detrimental to the neighborhood. Please note that the existing 4,404 square foot lot is only 600 square feet undersized, i.e., smaller than the minimum lot size of 5,000 square feet required by the Zoning District. By granting the SPECIAL PERMIT, the Board would be acting in a manner consistent with the spirit and intent of Section 139-33E of the By-law.
