At a Public Hearing of the Nantucket Board of Appeals held at I.00 P.M., Friday,
August 13, 1999, in the Conference Room of the Town of Nantucket Annex Building, 37
Washington Street, Nantucket, Massachusetts 02554, on the Application of KEVIN P.
HUYSl3R, of 15 Bartlett Road, Nantucket, Massachusetts 02554, for himself as owner,
(Board of Appeals File No.070-99) the Board made the following decision:
1. The Applicant is seeking Special Permit relief under Zoning $y-law §139-33A
(alterationlexpansion of apre-existing nonconforming strueture/use}_ Applicant proposes
to renovate and alter a said to be pre-existing structure containing three (3) dwelling units
by renovating the structure and relocating one (1) dwelling unit to a proposed new single-
family dwelling to be constructed towards the front of the 23,658± square foot Lot,
leaving two (2) units in the existing stnicture. The proposed single-family dwelling will
meet all dimensional requuemems and three (3}conforming pazking spaces will continue
to be provided on site. The Locus is nonconforming as to use with the Lot cornaining
three (3) dwelling units when a maximum of two (2) are allowed on a lot; and as to side
and rear yard setbacks with the existing structure being sited 2.9± feet at its closest point
from the northwesterly side yard lot line, 6.8+ feet at its closest point from the easterly
side yard lot line, and at zero feet at its closest point from the rear yard lot line in a
district that requires a minimum side and rear yard set back often (10) feet.
The premises is located at 15 Bartlett Road, Assessor's Map 67, Parcel 10, Plan Book
l6, Page 17, Lot 2. The property is zoned Residential - 10.
2. The decision is based upon the Application, a site plan and other material submitted
with it and the testimony an,d evidence presented at the heazing. The Planning Board
made a favorable recommendation. The direct abutter to the west spoke in favor of the
application provided that his fence near western lot line was not disturbed and that natural
screening between the proposed single family dwelling and his property was maintained.
3. The Applicant, through his attorney, presented plans for the new single-family
dwelling on the Lot and offered to maintain the natural screening between the new
stn2cture and his western neighbor. The new structure and plans complied in all respects
with the dimensional and puking requirements of the Zoning By-law.
4. The location and size of the aew dwelling is in keeping with the neighborhood and
the renovation of the existing structure reduces the intensity of use within side and rear
setback areas of the Lot. The size of the Lot is more than double 10,000 square foot
minimum required in this district. The Board finds that proposed alteration of the
nonconforming use, by renovating exasting nonconforming structure containing three (3}
dwelling units into atwo-family structure and relocating one (1) dwelling unit to a
proposed new single-family dwelling on Lot, is not substantially more detrimental than
the existing nonconforming use to the neighborhood.
5. Accordingly by a UNANIMOUS vote, the Board hereby GRANTS the requested
SPECIAL PERMIT relief pursuant to §139-3r~1l, provided the Applicant shall plant and
maintain at least a live-foot wide natural vegetated buffer in western sideyard where the
new single-family dwelling is built.

Applicant is seeking relief by SPECIAL PERMIT under Nantucket
Zoning Bylaw §139-33A (alteration/expansion of a pre-existing
nonconforming structure/use). Applicant proposes to renovate and alter a

Addendum
The Applicant is seeking Special Permit relief under Zoning By-law § 139-33A to
alter and extend the non-conforming triplex use on the property, by relocating one (1) of
the dwelling units from the existing triplex into a proposed single-family structure. The
Locus is non-conforming as to use, with three (3) dwelling units where a maximum of
two (2) dwelling units is allowed, and is non-conforming as to side and rear setback, with
the existing multi-family structure lying as close as +/- 2.9 feet from westerly lot line, as
close +/- on the northerly rear lot line and as close as +/- 6.8 feet from the easterly side
lot line, where the minimum required side/rear setback is ten (10) feet. The proposed
single-family structure will cl~omply with all dimensional and parking requirements under

The resulting non-conforming use of the Locus, with three (3) dwelling units divided
into separate duplex and single-family structures, will not be substantially more
detrimental to neighborhood that the existing three (3) family structure. The Board is
