Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw §139-33A (alteration/expansion of a pre-existing nonconforming structure/use) Applicant proposes to alter a twelve-room guest house by reducing the number of guest rooms from 12 to ten (10); reduce the two (2) staff rooms in the lower level to one (1) room that would meet the Building Code requirements for the four (4) on-site employees while maintaining the existing manager's dwelling unit. Applicant further proposes to expand the footprint of the structure by demolishing a rear deck/porch and exterior stairs and constructing a new addition that would upgrade the existing commercial kitchen space and provide a fireproof stair tower to meet the Building Code requirements for emergency access. The addition would meet all dimensional requirements and would be sited outside the required setback areas. The ground cover would increase from 40%± to 49~+ on this 5,680+ square foot Lot, which is allowed a maximum ground cover of 50%. As the parking requirements must be calculated for the uses on the Premises as if newly constructed due to the expansion of the structure, Applicant is also seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw §139-18 to waive eight (8) of the required ten (10) parking spaces as two (2) are provided on site. Similar parking relief was granted in BOA File No. 072-90. See also BOA File No. 043-80. The Locus is nonconforming as to parking and use. The Premises is located at 38 ORANGE STREET, Assessor's Map 42.3.2, Parcel 221, Plan Book 3, page 31. The property is zoned Residential-Old-Historic. 2. The Decision is based upon the Application and materials submitted with it and the testimony and evidence presented at the hearing. The Planning Board made no recommendation as the matter was not of planning concern. There were no letters on file and no public comment at the hearing. 3. Applicant represented that the proposed alterations, including adding an enclosed stairtower that would provide the required emergency access to the guest house, enclosing an existing porch on the northeasterly rear portion of the structure, and expanding an existing portion on the southeast rear, are part of an overall renovation of the structure. Said renovation would result in a decrease in the number of rental guest rooms from 12, as permitted in the Decision in BOA File No. 072-90, to nine (9), reduction in staff rooms from two (2) to one (1) that would meet the Building Code requirements, and expansion of the owner's/managers apartment. The structure would not impact the nonconforming front or southerly side yard setback intrusions as the work would take place entirely outside of the required setback areas. Applicant is now asking for a waiver of seven (7) spaces as opposed to the noticed eight (8) as the number of rental rooms has decreased from the proposed ten (10) to nine (9) as of the hearing. 4. Therefore, the Board finds that there would be an overall expansion of the guest house structure, though not of the number of guest rooms, and further finds that said expansion would not be substantially more detrimental to the neighborhood than the existing nonconformities. The proposed use would be less intensive than the existing 12-room guest house use and would provide a benefit as the structure would be made more conforming as to the Building Code with the alterations and expansions. 5. Accordingly, by a unanimous vote, the Board GRANTS the requested SPECIAL PERMIT under Nantucket Zoning Bylaw §139-33A to allow the alterations and expansions as proposed, and shown on a site plan done by Sandcastle Construction, Inc., dated November 8, 1999, marked as Exhibit A and on file at the Board of Appeals, and under Bylaw §139-18 waiving seven (7) of the required nine (9) parking spaces with two (2) provided on site. 6. In further action, the Boards APPROVES the site plan identified in paragraph 5 above, under Nantucket Zoning Bylaw §139-23. Applicant further proposes to expand the footprint of the structure by demolishing a rear deck/porch and exterior stairs and constructing a new addition that would upgrade the existing commercial kitchen space ands provide a fireproof stair tower to meet the Building Code requirements for emergency access. The addition would meet all dimensional requirements and would be sited outside the required setback areas. The ground cover ratio would increase from 40±96 to 49+% on this 5,680+ square-foot Lot, which is allowed a maximum ground cover of 5 0%. As the parking requirements must be calculated for the uses on the Premises as if newly constructed due to the expansion of the structure, Applicant is also seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw §139-18 to waive eight (8) of the required ten (10) parking spaces as two (2) are provided on site.
